(1) The supply of electrical power shall be controlled by
the state and conducted by the Government and re-
gionalgovernments based on the principles of regional
autonany.
(2) To conductthe supplyof electrical power as referred
to in paragraph (1), the Government andregional gov-
ernments shall, according to their respectIVe author-
ity, set policies on, regulate, supervise and conduct
the supply of eJecbicaJ power.

(1) The supply of electrical power by the Government and
regional governments shall be conducted by a state-
owned oompany and regionalgowmment-owned com-
panies.
(2) Private rorporate bodies, rooperatives, and seIf.,sup-
porting communities can participate In the supply of
eled:rical power.
(3) Toconductthe supply of electrical power as referred
to in Article3 paragraph (1), the Govemment and re-
gional governments shall provide fund$ for :

a. groupsof low-incomepeople;
b. development of fadlities for the supply of electrical
power in least developed regions;
C. development of electrical powerin remote and bor-
der areas; and
d. development of rural electricity.

Article 5
(1) The authority of the Government in the field of elec-
tricity shall cover:
a. setting nationalelectricity polides;
b. making regulations in the field of electricity;
c. setting guidance, standards and criteria in the field
of electricity;
d. issuing guidance to set tariffs of electrical power
for consumers;
e. makinggeneral plan for nationalelectricity;
f. setting business areas;
g. jcsuing permits for the sales and purchase of elec-
trical powerwith other countries;
h. issuing business pennits for the supply of elGcbical
power to corporate bodies :
1. whose business areas involve more than one
provinces;
2•. which are run bya state-owned company; and
3. which sell electrical power and/or lease elec-
tricity networks to the holders of business per-
mits engaged in the supplyof electrical power
set by the Government;
i. issuing operenon permits whose InstaHation fadll-

CHAPTER V
TIiE USE OFPRIMARY ENERGY SOURCES
Article 6
(1) Primary energysources foundat home and/or origi-
natingfrom abroad shalloptimally be taken advan-
tage of according to the national energy policies to
ensure the supply of electrical power Ina sustain-
able way.
(2) The use of primary energy sources as referred to in.
paragraph (1) shall be done by prioritizing new energy
andrenewable energy sources.
(3) The use of primary energy sources found at home as
referred to In paragraph (1) shall prioritize the inter·
ests of national electricity.
CHAPTER VI
GENERAL PlAN FOR ELECTRICITY
Article 7
(1) The general plan for national electricity shall be
drawnup based on the national energy policies and
endorsed by the Government after consulting the
House of Representatives of the Republic of Indo-
nesia.
(2) Thegeneral plan for national electrldtyasreferred to
in paragraph (1) shall be drawn up by Involving re-
gional governments.
(3) The general plan for regional electricity shall be
drawn up based on the general plan for national
eJectrlclty and endorsed by the regional govern-
ment after consulting the Regional Legislative
Council.
(4) Theguidance to drawup the general plan for electric-
ity as referred to In paragraph (1) and paragraph (3)
isto De set by the Minister.

Electricity business consists of :
a. the supplyof electrical power; and

The supply of electrical power as referred to in
Artide 8 letter a consists of :
a. the supply of electrical powerfor publicInterests; and
b. the supplyof electrical power for own interests.
Article 10
(l) The supply of electrical power for pubfic IlItelests as
referredto inArticle 9 letter a covefS the types ofbusl-
ness:
a. generation of electrical power,
b. transmission of electrical power;
c. distributionof electrical power; and/or
d. sales of·~1edricaI power.
(2) The supply of elec:triall power for pubic inberests as
referred to in pamgraph {l} can be mnducted in an
Integrated way.
(3) The supply of electrical power for public interests as
referred to in paragraph (2) shall be conducted by 1
(one) corporate bodyin 1 (one) business area.
(4) The restriction on busl ness area as referred
to In paragraph (3) shall also apply to the
supply of electrical power for public inter-
ests covering only the di~trJbutjon of elec-

trlcal power and/or the sales of electrical
power.
(5) The business areaas refelTecI to In paragraph (3) and
paragraph (4) shall be set by the Government.
Article 11
(1) The supplyof elecbical power for publicInterests as
referred to In ArtIcle 10 paragraph (1) shall be con-
due:ted by state-ownedmmpany, regional govemment-
ovmed oompanies, private corporate bodies, coopera-
tives, andseff-.supportfng communities engaged Inthe
supplyof electrical power.
(2) The sta~ company asreferred to In paragraph
(1) shall be given the first priority to conduct the sup-
ply of electricalpower for publicinterests.
(3) For the areaswhich have not enjoyedelectricity, the
Governmentor reglonelgovernments shall,according
to their respective authority,givea chance to regional
govemment-owned oornoanies, Private corporate bod-
Ies, or cooperatives as the operatorof business Inthe
supply Of electrical powerin an integrated way.
(4) In the absence of regional govemment-owned com-
pany, private corporate body, or cooperative capable
of supplying electrical powerinthe areas, the Govern-
ment shall assign the state-owned.company to supply
electrical power.
Article 12
The supply of electrical power for own Interests
as referred to In Artide 9 letter b covers :
a. generation of electrical power;
b. generation of electrical poweranddistribution of elec-
triCal power; or
c. generation of electrical power, transmission of electri-
cal power and distribution of electrical power.

Article 15
The electrical power-supporting businesses as re-

a. conSUlting services in the fIefd of installations for
the supply of electrical power;

e. maintenance of electrical POWer Installations;
f. research and development;

having certificates, dassiftCations and qualifICations
according to the law.
(3) In conducting the electricalpower supporting service
businesses, state-owned companies, regiona' govern-
ment""OWned companies, private corporate bodiesand
cooperatives shall prioritize domestic products and
potentials.
(4) Further provisions on certification, classification and
qualifications of electriCal power-supporting service
businesses are to be provided for In a Government
Regulation.
Artide 17
(1) Theeledrical power-supportlng Industrial businesses
as referred to in Article 15 letter bcover ;
a. electrical power instrument IndUstry; and/or
b. electriCal power userindustry.
(2) The electrical power-supporting industrial business as
referred to in paragraph (1) shallbe oondueted by state-

The Rightsand ObligationS of the Holders of Pennits
for the Supply of
Electrical Power
Artide27
(1) In the interestsof the public, the holdersof permits for
the supply of electrical power which conductthe sup-
plyof electrical power as referred to In Artk::Ie 10 para-
gRiph (1) shell heve the right to :
a. Q'OSS rivers or lakes, either above or beneath the
sul"faa!;
b. Q'OSS the sea, either above or beneath the sur-
face;
c. cross public roads andrallwav tracks;
d. enter publicor personal places for temporary use;
e. use landand cross above or beneaththe land;
f. cross above or below buildings built on or beneath
the land; and
g. cut aoo/or fell hindering trees.
(2) In carrying out the activities as referred to in para-
graph (1), theholders of permits for thesupply of elec-
trical power shall do soaccording to the law.
Article 28
The holders ofpermits for the supply ofelectrical
powershall:

a. provide electrical powerwhichmeetsquality standard
andreliability;
b. provide as good serviees aspossible to consumers and
the public;
c. meetelectricity safety conditions; and
d. prioritizedomestic products and potentials.
Part FIVe
The Rights and Obligations d Consumers

(1) Consumers shallhavethe right to :
a. receive good services;
b. get amtinuous electrical powerof gooct quality and
reliability;
c. receive electrical power to which they are entitled
at reasonable prte.es;
d. get repair services in case of efectrical power dis-
turbance; and
e. receive compensation Tn case of bIadcout caused
by errors and/or carelessness on the part of the
holder.;of permItS for the supply d electrica1·lXJWer
according to the conditions set· in the electrical
powersales purchase agreement.
(2) Consumers shall be obliged to :
a. take security measures to prevent danger that may
arise from the useof electrlcal power;
b. safeguard electrical power installations owned by .
consumers;
c. useelectriallpower according to Its appropriation;
d. pay electrietty bdls; and
e. abide by technical requirements in the electricity
fJeld.
(3) Consumers shall be held responsible If becaUse Oftheir
negligence they inflict losses to the hoIdeY of permit

h. the fulfillment of licensing requirements;
i. the application of electricalpower tariffs; and
j. the fulfillmentof the quality of services provided by
electrical power-supporting businesses.
(2) In conducting the control as referred to in paragraph
(t), the Government and regionalgovernments can :
a. makefield inspections;
b. ask for reports on the realizcnion of businesses in
the electricityfield;
c. conduct:a research andevaluation of reportsonthe
realization of businesses in the electridtyfield; and

licensing provisions.
(3) In conducting the technical control as referred to in
paragraph (1), the Governmentand regional govern-
ments shall be assisted by electricity inspectors andl
or dvil servantinvestigators.

be provided for in a Government Regulation.

INVESTIGATION

(1) Besides investigators from the Indonesian Police, cer-
tain civil servants whose scope of tasks end responsi-
bilities covers the eiectridty field shallbe given special
authority to serveas investigators as referred to in the
Penal Code to investigate criminal offences in the elec-
tricity field.
(2) The civil servant investigators as referredto in para-
graph (1) shall havethe authority to :
a. checkthe truth of reportsor information related to
criminal offencesin electricity business;
b. investigate anybody suspected of committing a
criminaloffence in electricity business;
c. summon people to be heard and investigated as
witnesses or suspects in criminaloffencesrelated
to electricity business:
d. search placesbelievedto have beenusedto com-
mit criminaloffences related to elecbicity business;
e. check facilities andinfrastructures used to carryout
electricitybusiness and stopthe useof instruments
believed to have been used to commit criminal of-
fences;
f. seal and/orconfiscate instruments c:J e\ectricity busi-
ness usedto commitcriminal offences asevidence;

CHAPTER XIV
ADMINISTRATIVE SANCTIONS
Article48
(1) Anybody found violating provisions in Article 16 para-
graph (3), Article 17 paragraph (3), Article 27 para-
graph (2), Article 28, Article 33 paragraph (3), Article
35, Article 37, Article 42, or Article 45 paragraph (3)
shall be liable to administrative sanclionS in the form
of:
a. written warning;
b. havinghis/heractivityfrozen temporarily; and/or
c. having his/her business permit revoked.
(2) The administrative sanctions as referred to in para-
graph (1) shall be set by the Minister, governors, or
regents/mayors according to their respective author-
ity.
(3) The procedure of imposing the administrative sanc-
tions as referred to in paragraph (1) is to be provided
for in a Government Regulation.

Rp2,OOO,OOO,OOO (two billion rupiahs).

Thedevelopment of the electricity sectorisaimed
at promoting public welfare andintellectualizing the na-
tion to achieve the goals of national development,

ther materially or spiritually, based on the state ide0l-
ogy Pancasila andthe 1945 Constitution of the Republic
of Indonesia. Electrical power, as one of the result:> of
the exploitation of natural resources, playsan impor-
tant role for the state to achieve the goals of national
development.
Realizing that electrical power Is importantfor the
state to create pUblic welfare in all aspects and in line
with Article 33 paragraph (2) of the 1945 Constitution
of the Republic of Indonesia, this Law stipulates that
the supply of electrical powerIscontrolled by the state
and used for the greatest possible prosperity of the
people and therefore, It Is organized by the Govern-
mentandregional governments.
The Government and regional governments, ac-
cording to their respective authOrity, set polices on,
regulate, supervise andconduct the supply of elecbical
power.

duct the supply of electrical power by assigning state-
owned company andregional govemment-owned com-
panies. To improve further the state capacity in the
supply ofelectrical power, this Law gives achance to
