VISION STATEMENT

The City of Alhambra shall be the premier family-oriented and economically prosperous
community in the San Gabriel Valley.

Addressing the Council: Section 2.04.210 of the Alhambra Municipal Code establishes the procedures for
addressing the Council. Any person wishing to address the Council during the meeting must complete a Speaker
Request Card and submit it to the City Clerk.

When called upon by the Mayor, please step to the podium and give your name, address and organization or other
party you represent, if any, in an audible tone of voice for the record. Remarks are limited to 5 minutes.

All remarks shall be addressed to the Council as a body and not to any member thereof. No person, other than the
Council and the person having the floor, shall be permitted to enter into any discussion, either directly or through a
member of the Council, without the permission of the Mayor. No question shall be asked a Councilperson except
through the Mayor.

Standards of Decorum: Any person making personal, impertinent or slanderous remarks or who shall become
boisterous while addressing the Council shall be forthwith, by the Mayor, barred from the meeting.

Enforcement of Decorum: The Chief of Police, or his designee, shall be Sergeant-at-Arms of the Council meetings.
The Sergeant-at-Arms shall carry out all orders and instructions given by the Mayor for the purpose of maintaining
order and decorum at the Council meeting.

Persons Authorized to be Within Rail: No person, except City officials, their representatives, and newspaper
reporters, shall be permitted within the rail in front of the Council Chamber without the express consent of the Council.

Agenda Tracking Numbers: All numbers listed in bold after the title of each Agenda item are City Clerk tracking

Permit CP-18-2, Conditional Use Permit CU-18-2 and Variance V-18-4 for K-100 Karaoke
located at 7 North Third Street has been pulled from this agenda at the request of the
applicant. The public hearing will be re-noticed and heard at a later City Council meeting
date.

READING OF ORDINANCE TITLES


Government Code Section 36934 requires that all ordinances be read in full prior to City Council
taking action on the ordinance. By listing the ordinance title on the Council agenda, Council may
determine that the title has been read.

Recommended Action: By motion, determine that the titles to all ordinances which appear
on this public agenda have been read, and waive further reading.

PRESENTATION

1. CITY CLERK’S CERTIFICATION REGARDING EXAMINATION OF SIGNATURES


FOR A CHARTER AMENDMENT INITIATIVE PETITION – F2M18-63

On March 15, 2018 petition proponents Eric Sunada, Efren J. Moreno Jr. and Aldric J.
Soong filed with the City Clerk’s Office a proposed charter amendment entitled
“Alhambra Election and Campaign Finance Reform Act”, a Notice of Intent to Circulate
Initiative Petition and a Request for Official Ballot Title and Summary/Statement of
Proponent. On March 30, 2018, pursuant to Elections Code Section 9203, the City
Attorney provided an impartial ballot title and summary to the City Clerk’s Office and the
Assistant City Clerk furnished a copy of this ballot title and summary to a representative
of the petition proponents that same day. Pursuant to Elections Code Section 9208, the
petition proponents then had 180 days from March 30, 2018 to gather signatures of
registered voters in the City of Alhambra. Pursuant to Elections Code Section 9255, the
required minimum number of signatures for this charter amendment petition to be
submitted to Alhambra voters was 6,145. On September 25, 2018, the petition
proponents filed all their petition sections with the City Clerk’s Office. Upon completion of
the prima facie review of the petitions by the City Clerk’s Office, the City Clerk personally
delivered 638 petition sections of the charter amendment initiative containing 8,521
signatures to the Data Entry & Signature Verification Section of the Los Angeles County

Registrar-Recorder/County Clerk’s Office. By letter dated October 25, 2018, the Data
Entry & Signature Verification Section informed the City Clerk’s Office that required
number of 6,145 signatures from registered Alhambra voters was met. Therefore,
pursuant to Elections Code Section 9255, the charter amendment ballot initiative shall
be submitted to Alhambra voters at an established statewide general, statewide primary
or regularly scheduled municipal election. Additionally, pursuant to Elections Code
Section 9114, if the petition is found sufficient, the elections official shall certify the
results of the signature examination to the City Council at the next regular meeting of
the Council.

Recommended Action: City Council receive and file the City Clerk’s certification
regarding examination of signatures for a charter amendment initiative petition submitted
by petitioners Eric Sunada, Efren J. Moreno Jr. and Aldric J. Soong; and, direct staff to
agendize the calling of an election or as deemed appropriate.

CLOSED SESSION & CITY ATTORNEY ANNOUNCEMENT re SAME - F2M18-14


The City Council will move into a closed session pursuant to applicable law, including the Brown
Act (Government Code Sec. 54950, et seq.) for the purposes of conferring with the City’s Real
Property negotiator, and/or conferring with the City Attorney on potential and/or existing
litigation, and/or discussing matters covered under Government Code Section 54957
(Personnel), and/or conferring with the City’s Labor Negotiators as follows; provided, however,
prior to moving into closed session, the City Attorney shall make any announcements required

PUBLIC HEARING

2. RESOLUTION APPROVING A GENERAL PLAN MAINTENANCE AND


IMPLEMENTATION COST RECOVERY FEE – F2M18-17, F2M14-55, N2M18-122,
R2M18-35

This is the time and place set by Notice No. N2M18-122 for the City Council to hold a
public hearing to consider adoption of a proposed resolution to create a General Plan
Maintenance and Implementation Cost Recovery Fee. The City is currently updating its
General Plan. Immediately following this update, the state also mandates that the Zoning
Code be updated and then a new Housing Element must again be completed. In the
last few years, the Zoning Code was also amended several times to include new
regulations such as the Accessory Dwelling Unit (ADU) requirement, the Cannabis
proposition, Model Water Efficiency Landscape Ordinance (MWELO), and other
legislative actions required upon local agencies. While the state allows cities to recover
the costs of all these mandatory updates through fees, the City of Alhambra is
expending General Funds to cover these costs. As such, on-going and future costs are
an increasing burden on the General Funds at the expense of other priorities. The
proposed General Plan Maintenance and Implementation Cost Recovery Fee would
recover about 95% of estimated costs and will fund the necessary tasks for the next 20
years, through 2038.

Recommended Action: After receiving public testimony, the Mayor should close
the public hearing and the City Council should adopt Resolution No. R2M18-35 entitled:
A Resolution of the City Council of the City of Alhambra, California approving a General
Plan Maintenance and Implementation Cost Recovery Fee

PRESENTATION

3. 2018-2019 STRATEGIC PLAN UPDATE - F2M18-35

On April 19, 2018, the City Council and Executive staff held a strategic planning session
to update the City’s Strategic Plan. The session involved discussion regarding priorities
to be implemented into the City’s Strategic Plan. During the strategic planning process it
was also determined that staff will review the progress of the goals and objectives and
present the status to the City Council on a quarterly basis. Approximately every year, the
City Council and Executive staff will meet to revisit and/or update the priorities and set
goals and objectives for the City accordingly.

Recommended Action: City Council receive and file this informational report.

CONSENT AGENDA (Item Nos. 4 - 12)

All items listed under the Consent Agenda are considered by the City Council to be routine and
will be enacted by one motion unless a citizen or Council member requests otherwise; in which
case, the item will be removed for separate consideration.

4. AWARD CONTRACT: LAND MANAGEMENT AND PERMITTING SOFTWARE

SYSTEM – F2M18-21, RFP2M18-1, C2M18-60, M2M18-159

On January 22, 2018, the City Council authorized the distribution of a Request for
Proposals (RFP) for the acquisition of a cloud-based Land Management and Permitting
Software system. A total of nine responsive proposals were received prior to the
deadline. Proposal evaluations were conducted by a panel consisting of representatives
from a core interdepartmental team including Public Works, Finance, Utilities,
Information Technology, Fire, Community Development and Building, based on the
following criteria: 1) Project understanding and approach to accomplish the system
objectives; 2) Software technology and ability to meet the City’s goals; 3) Company
experience in general and specific to California cities; 4) Implementation strategy and
methodology; and 5) total cost. Based on the established scoring criteria and on-site
demonstration evaluations, Tyler Technologies’ solution became the clear “best fit” for
the City. Their on-site demonstrations, customer references and experience, and
compatibility of requirements for the City were determining factors in this decision.
Therefore, staff requests that the City Council award a contract to Tyler Technologies,
Inc.

Recommended Action: City Council award a one-year contract to Tyler


Technologies, Inc.; authorize the City Manager to renew the contract for an additional
two years, subject to satisfactory performance and approval of future budget allocations
by the City Council; and, direct staff to undertake the steps necessary to finalize
Council’s action. (M2M18-159)

5. FY 2017 STATE HOMELAND SECURITY GRANT – F2M15-25, F2M1-106, C2M18-61,


M2M18-160

Staff requests that the City Council approve an agreement with Los Angeles County and
accept the FY 2017 State Homeland Security Grant Program (SHSGP). The Los
Angeles Operational Area (OA) Approval Authority for the Homeland Security Grant
Program established priorities for approval that focused on enhancing and expanding
existing specialized resources that will improve the Operational Area’s ability to prepare
for and respond to terrorism and weapons of mass destruction events, while providing
an opportunity for cities to apply for funding to meet their needs. The Fire Department
submitted a grant request to the Approval Authority administering the grant program for
the amount of $74,000 for Urban Search and Rescue (US & R) equipment, supplies and
training.

Recommended Action: City Council accept the FY 2017 State Homeland Security
Grant in the amount of $74,000 for the Fire Department; authorize the Fire Chief to sign
the FY 2017 State Homeland Security Grant Program agreement with Los Angeles
County, subject to final language approval by the City Manager and City Attorney, and to
make necessary purchases of Urban Search & Rescue equipment, supplies and training
as submitted to the OA Approval Authority and the State of California Office of
Homeland Security. (M2M18-160)

6. AWARD CONTRACT: ALMANSOR COURT FIRE MONITORING SYSTEM PROJECT


– F2M18-60, N2M18-115, C2M18-62, M2M18-161

On October 8, 2018, the City Council approved the distribution of a Notice Inviting Bids
for the Almansor Court Fire Monitoring System Project. On November 1, 2018, the City
Clerk received one bid for the Project. The bid was in the amount of $61,000. The bid
received from Western States Fire Protection is the lowest responsive bid.

Recommended Action: City Council award a contract, subject to final language


approval by the City Manager and City Attorney, to Western States Fire Protection Co. in
the amount of $61,000 for the Almansor Court Fire Monitoring System Project; and,
direct staff to undertake the steps necessary to finalize Council’s action. (M2M18-161)

7. AWARD CONTRACT: UPGRADE VENTILATION SYSTEM AT THE POLICE


DEPARTMENT’S FIRING RANGE – F2M18-52, RFP2M18-18, C2M18-63, M2M18-162

On August 27, 2018, the City Council approved the distribution of a Request for
Proposals (RFP) for an upgrade to the ventilation system on the Firing Range at the
Police Department. On October 25, 2018, two proposals were submitted for the project
which ranged from $37,999 to $47,861.81. On November 1, 2018, the project team
reviewed and evaluated both proposals for pricing, transparency, references,
experience, proposal detail, fulfilling the RFP requirements and the capability of their
management team. One vendor did not meet the required part specification stipulated in
the RFP and was rejected. At the conclusion of the review, the project team determined
the proposal from Therma LLC to be in full compliance and conformance with the RFP
specifications.

Recommended Action: City Council approve a contract, subject to final language


approval by the City Manager and City Attorney, by and between the City of Alhambra
and Therma, LLC to provide an upgrade to the ventilation system on the Police
Department’s Firing Range in an amount not to exceed $47,861.81; and, direct staff to
undertake the steps necessary to finalize Council’s action. (M2M18-162)

8. AUTHORIZE RFP: ELEVATOR MODERNIZATION AT THE POLICE DEPARTMENT


AND CITY HALL – F2M18-64, RFP2M18-20

The current elevators used at both the Police Department and City Hall are the original
elevators and have been gradually deteriorating in functionality over time. The elevators
have developed systemic problems and have flaws within crucial components that
require greater scale repair or rehabilitation. The elevators were inspected by a
professional technician and it was determined that new controllers, panels and an overall
modernization is required.

Recommended Action: City Council authorize staff to solicit proposals for the
modernization of the three elevators at the Police Department and one elevator at City
Hall.

9. AWARD OF CONTRACT: SIDEWALK ASSESSMENT AND REPAIR SERVICES –


F2M18-65, C2M18-64, M2M18-163

The City of Alhambra recently joined the California Joint Powers Insurance
Authority (CJPIA). The CJPIA Executive Committee has created a master services
agreement to allow member agencies to take advantage of favorable pricing related to
sidewalk inspection and maintenance. After following its own selection process, the
CJPIA developed an agreement with Precision Concrete Cutting. Staff would work with
Precision Concrete Cutting (PCC) to develop an inspection of all right of way sidewalk
within the City. PCC would inspect the sidewalk, document any sidewalk deviations
and provide a report to the City. As part of this agreement, PCC would also repair
certain sidewalk hazards. The contract would be for four years beginning January 2019.
Pursuant to the City Council’s authority under Alhambra Municipal Code Section
3.36.080(E), the City Council may dispense with further procedures and enter into a
contract when it meets a specific purchase need. In this instance, the CJPIA has
requested that the City undertake the inspection and maintenance work and has
developed the agreement with favorable pricing for the City to engage the services of
PCC.

Recommended Action: City Council award a four-year contract, subject to final


language approval by the City Manager and City Attorney, to Precision Concrete Cutting
in a total amount of $800,000 for sidewalk inspection and maintenance; and, direct staff
to undertake the steps necessary to finalize Council’s action. (M2M18-163)

Recommended Action: City Council review and approve as submitted the Minutes
of the October 8, 2018 regular meeting of the Alhambra City Council and the Minutes of
the October 22, 2018 regular meeting of the Alhambra City Council.

11. PERSONNEL ACTIONS – F2M18-2

Recommended Action: City Council ratify the actions of the City Manager set forth
in that certain Personnel Actions document dated November 13, 2018, showing the
various appointments, classifications, salary changes, etc., since the last City Council
meeting.

ORDINANCE – SECOND READING

13. ORDINANCE AMENDING ALHAMBRA MUNICIPAL CODE CHAPTER 3.36


RELATING TO THE PURCHASING OF SUPPLIES AND EQUIPMENT AND CHAPTER
3.38 RELATED TO CONTRACTS FOR CONSULTING AND PROFESSIONAL
SERVICES – F2M18-17, O2M18-4745

Staff requests that the City Council consider second reading and adoption of an
ordinance amending Alhambra Municipal Code Chapter 3.36 relating to purchase of
supplies and equipment and Chapter 3.38 related to contracts for consulting and
professional services. The Office of Management and Budget (OMB) has issued an
addendum to the Federal Uniform Compliance Requirements for Federal Awards (or
uniform guidance). One of the changes affecting non-for-profits receiving federal award
is the uniform guidance which aims to reduce the administrative burden on organizations
that receive federal awards while mitigating the risk of waste, fraud and abuse. The City
receives federal funding through various grant programs. As a result, the City is subject
to the requirements of the updated federal uniform guidance for grant awards. In order to
continue to receive federal awards and grants, the City must comply with the uniform
guidance by updating some of the City’s existing policies and procedures. The City
Attorney’s Office has reviewed staff recommended changes to the Municipal Code
Chapters 3.36 and 3.38 as it relates to the uniform guidance to ensure the
recommended changes incorporate and comply with both local ordinances and the
uniform guidance.

Recommended Action: City Council direct the City Attorney to give second
reading by title only to the following ordinance entitled:

Ordinance No. O2M18-4745: An Ordinance of the City Council of


the City of Alhambra, California, amending Chapter 3.36 of the
Alhambra Municipal Code relating to the purchasing of supplies and
equipment, and Chapter 3.38 of the Alhambra Municipal Code,
related to contracts for consultant and professional services

after which the Council, by motion, may adopt Ordinance No. O2M18-4745.
