CANCELLATION OF CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:

This CANCELLATION OF CONTRACT TO SELL entered into by and between:

, a corporation duly organized and existing by virtue of the laws of the Republic of the
Philippines with office address at, represented herein by, hereinafter called as the “SELLER”

-and-

, of legal age, single, Filipino and with residence/ postal address at, hereinafter called as
the “PURCHASER.”

WITNESSETH THAT:

WHEREAS, a Contract to Sell dated September 26, 2012 was executed by the PARTIES over
a parcel of land located at, with a total area of 180 square meters, which contract was notarized
by.

WHEREAS, the PARTIES have mutually agreed to CANCEL, RESCIND and TERMINATE the
said Contract to Sell and the SELLER has agreed to return to the PURCHASER all amounts paid by
the latter for the said parcel of land.

NOW, THEREFORE, for and in consideration of the foregoing premises and the full refund
of the total amount paid amounting to P1,879,142.40, receipt of which is hereby acknowledged
by the PURCHASER, the Contract to Sell dated September 26, 2012 between the SELLER and the
PURCHASER is hereby CANCELLED, RESCINDED AND TERMINATED.

The SELLER hereby waives and releases all rights and claims whatsoever against the
PURCHASER, and the PURCHASER hereby waives and releases all rights and claims whatsoever
against the SELLER, its assigns, affiliates or successors-in-interest. The PURCHASER likewise
waives and releases all rights, title and interests in the described real property.

IN WITNESS WHEREOF, the PARTIES have hereunto set their hands on February 27, 2018
at Davao City, Philippines.
