Re: Agenda – November 20, 2018 – Ordinance Amendment Title 3, Chapter 10, MJ Rec Sales

Mayor/Council:

I was asked by Council Member Holm to add this item to the agenda regarding modifications/additions
to the existing City Code 3-10 (marijuana codes) to incorporate recreational marijuana retail sales.

The existing code, as you recall, was created with the ability to add this type of use for licensing if/when
a decision was eventually made. Thus the changes will not entail a whole new ordinance but will be a
modification of existing language to add such retail recreational sales as an authorized establishment
than can be licensed under certain parameters. Given that this use would proceed within the existing
bounds created by the current ordinance on zoning, etc., which would not be changing, I should be

able to have the modified language ready for a first reading at the December 4 meeting followed by

the second reading/ adoption on December 18 . The ordinance would then go into effect around mid-
January 2019.

As with any such code change, I need the Councils authorization to proceed with the related legal and
drafting work necessary to create the ordinance for consideration. With you approval I can proceed
with that work.
