AFFIDAVIT AND APPLICATION FOR ARREST WARRANT
AND THE ARREST WARRANT FOR THE PERSON(S) OF:
Angel Matthew Gallegos, dob: 07-23-1999, a white male, 5°11’, 125 pounds with brown
hair and green eyes, DPD number 826852, SID 3111259, SSN QUERIED, for two counts of
Murder in the First Degree, C.R.S. 18-3-102 (1) (a), a Class 1 Felony and one count of Assault in
the First Degree, C.R.S. 18-3-202, (1) (a), a Class 3 Felony.
I, Detective Randal Denison, 96007, Your Affiant states under oath that the facts known to the Affiant
which establish probable cause to believe that a criminal offense was committed, and that the offense
‘was committed by the above named person(s), are the following:
On Wednesday, May 30, 2018 Your Affiant and Detective Martin Smith were assigned to investigate
the shooting deaths of Raymond Flores, dob: 12-25-1992 and Rosendo Anthony Flores Martinez, dob:
07-26-2001 and the serious injury by gun shot of (AINE, dob: QNHE-2002 that occurred on
that date at approximately 12:11 pm in the parking lot of the Kimbo Market, 3925 W. 6! Avenve, in the
City and County of Denver.
On Wednesday, May 30, 2018 at approximately 12:40 pm Your Affiant was called by Homicide Unit
Supervisor, Sergeant Tom Rowe. Sergeant Rowe told Your Affiant that there had been a shooting at W,
6" Avenue and Perry Street and that'a {tal of three people’had been shot and two of them had died.
‘Your Affiant responded to, that location, arriving at 1:00 pm. Your Affiant observed that the area and
Streets around the N. E, comer of W. 6" Avenue and Perry Street to include thie Kimbo Market, 3925
W. 6* Avenue were cordoned off with crime scene tape, marked patrol cars and uniformed Police
Officers present to prevent unauthorized entrance.
‘Your Affiant met with Sergeant Rowe who had arrived at the scene prior to Your Affiant. Your Affiant
learned that the shooting had occurred in the parking lot of the Kimbo Market.
‘Your Affiant learned that the three victims, Raymond Flores, dob: 12-25-1992, Rosendo Anthony Flores
Martinez, dob: 07-26-2001 and@0IEE®, dob; @BEHB-2002 had all been transported by ambulance
to Denver Health Medical Center, (DHMC). Raymond Flores and Rosendo Anthony Martinez had both
‘been pronounced deceased as a result of their injuries, QUEEN was hospitalized in stable
condition as a result of his injuries,Page 2
Your Affiant observed an older model, dark blue, four door, Ford Explorer, bearing Colorado temporary
‘tag 140248X parked at an angle in the parking lot of the Kimbo Market. The right front passenger door
of the vehicle was open, and the vehicle was running,
Your Affiant observed apparent blood and clothing near the front door of the Kimbo Market and leamed
that one of the victims had been located there. Your Affiant observed two spent bullets and spent
cartridges cases in the parking lot. Your Affiant observed a can of, “Bear spray” on the ground in the
parking lot near the front door of the Kimbo Market. Your Affiant observed an area of apparent blood
and clothing on the south side of Sportsman's Liquor, 610 Perry Street.
The scene was subsequently documented with photography and measurements and evidence collected
by the Denver Police Department, Crime Lab, Crime Scene Unit.
‘Your Affiant personally spoke to a witness at the scene, QUININE who had been working
i at the Kimbo Market at the time of the shooting.
. GREED said that a male had come into the store
and was shouting about someone being outside. The male was holding the door shut from inside and
someone wes pushing the door from outside, She heard several gunshots and ducked down behind the
counter.
‘Your Affiant leamed that both the Kimbo Market and Sportsman's Liquor are equipped with recorded
CCTY, (closed circuit tv), security systems.
‘Your A ffiant viewed the recorded video of the shooting from both the Sportsman’s Liquor and the Kimbo
Market. Your Affiant observed two males walk into the parking lot of Kimbo Market and go towards
the front door. The taller of the two males was wearing a black and red, “hoodie” with the hood up and
red shorts. The second, shorter male was wearing grey short sleeve shirt and dark colored shorts, The
shorter male entered the store and picked up a container of milk. The male with the red and black hoodie
stays outside and appears to be looking around as if he is watching the streets in the area. The blue Ford
Explorer drives into the parking lot and stops. Three males exit the vehicle and approach the front door
of Kimbo Market. The male in the red and black hoodie enters the store and attempts to hold the door
shut as the three males from the Ford Explore try to enter. The male in the red and black hoodie produces
a handgun and begins shooting at the three males. The male in the red and black hoodie exits the store
and continues to shoot at the three males as he runs from the area, The second male exits the store and
runs from the area. Neither of these two males were located or identified at that time.
Still photographs of the two unidentified males who ran from the shooting were obtained from security
video and distributed to Denver Police Officers who were familiar with the area of the crime. Officers
believed the shorter of the two males to possibly be ST dob: QIN who resides a =

At 9:30 pm Your Affiant and Detective Smith accompanied by uniformed Denver Police Officers went

During the interview of SINNER he said he walked to the store to purchase milk for SIND.
While walking to the store some males in a blue SUV had confronted and challenged him, asking what
“hood” he was from. Along the way he met with a male known to him as Angel who is 17 or 18 years
old. Angel asked him if the males in the SUV were harassing him and agreed to accompany him fo the
store. Angel told him he would, “have his back”, Angel stayed outside while he went in to purchase the
milk for his (§HNB. The SUV pulled into the parking lot and three males got info an argument with
Angel. Angel took out a pistol and started shooting at the males. One of the males sprayed, “bear spray”,
(GHEE said he ran from the area and returned S89. G@HEEEEEB said he did not know Angel had a gun
and did not know the three males from the SUV and had never seen them, before.
described Angel as approximately 17 years of age. During the interview Detective Roger Torgeson
provided @EEEMEEB access to Facebook. QUEM identified a Facebook page with the user name,
“Poncho Makin Moves" as the Facebook page of the male known to him as, “Angel” and the man who
shot the men at the store,
Detective Torgeson researched the Facebook page of, “Poncho Makin Moves” and located a name of,
“Angel Gallegos” associated with the page when it was created,
Detective Smith researched records for males named Angel Gallegos who appeared to match the
information provided by (AMEND. Detective Smith located records for a male named Angel
‘Mathew Gallegos, dob: 07-23-1999 who appears to match the description provided by aa
and images captured from the security video.
On Thursday, May 31, 2018 Your Affiant personally spoke to fellow Homicide Unit Detective Eric
Bueno. Detective Bueno told Your Affiant that on Wednesday, May 30, 2018 at 1:50 pm he had gone to
Denver Health Medical Center and spoken with the injured victim, 2. [7
told Detective Bueno that he had been with AIEEE, Raymond Flores, dob: 08-27-2002 and a friend
known to him as Anthony Martinez, age 16. They had been in a 2002 Ford Explorer.
told him that Raymond Flores was driving. Anthony Martinez was in the front passenger seat and he was
in the back seat. They were driving near the comer store at 6 Avenue and Perry Street when they drove
past two males who, “mean mugged” them, He described the males as 15-17 years of age. He said one
‘was taller was about 5°9” and was wearing a red and black, “hoodie”. The second male was shorter and
wearing gray. GUNMEN said they were offended by the look the males gave them and drove
around the block to confront them. They pulled into the parking lot of the comer store and all got out of |
the vehicle. They started arguing with the two males. The taller male in the red and black hoodie
produced a gun and started shooting at them. He was shot in the buttock.
On Thursday, May 31, 2018 at 11:05 am Your Affiant and Detective Smith met with G8 and
Detective Smith showed GNNNINIEG a copy of
Colorado Driver's License photograph of Angel Matthew Gallegos, dob: 07-23-1999, minus any
identifying information. @UREREEEIND positively identified this photograph as the man know to him as
Angel and the man who shot the men at the store.
