EQUIPMENT RENTAL AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement is executed and entered into by and between:

HERDIGARDE HAULING SERVICES, a duly registered and organized company, existing under and by virtue
of the laws of Republic of the Philippines with office address Unit 5 Ivory Bldg. El Grande Ave. BF Homes
Parañaue City. Represented by its General Manager HERDIGARDE T. FERRERIA, hereinafter referred to
as the FIRST PARTY;

AND

______________________________. a duly registered and organized company, existing under

and by virtue of the laws of Republic of the Philippines with/office and business addresses located
at_____________________represented in this act by _______________, owner herein after referred to
as the SECOND PARTY;

WITNESSETH:

WHEREAS, the FIRST PARTY permittee of the eight (4.08) hectares quarry area located at Brgy.
Tanza Cavite with an expansion area of more than 8 hectares, both are with existing quarry permits and
ECC.and the EXCLUSIVE contractor to extract and dispose of the quarry resources within said property;
are with existing quarry permits no. ECC-R4A-01706-0190

1. Validity of this contract shall start from signing between the FIRST PARTY and the
SECOND PARTY to conference from date of the actual arrival of the units (backhoe Hitachi____) at
quarry site and it will be straight HAULING CONTRACT AGREEMENT until six months and it is renewable
thereafter as both parties agreed.

2. The___ units excavator and its operator and Helpers shall be mobilized/transported to
the staging point mutually agreed by both parties where the Hauling Routes will be from quarry to
dumping site., followed by additional units accordingly per requirements of the FIRST PARTY.

3. The SECOND PARTY shall provide the Salary of drivers and Helpers and Diesel
consumption of the EXCAVATOR

4. In case of government imposition of MORATORIUM or stoppage of Quarry Operation

both parties will terminate the contract, subject for amendments depending on the time of Quarry
Permit were lifted.

6. EQUIPMENT rate shall be One six thousand pesos (Php 1,600.00)per HOUR.

7. Mode of payment shall be on a weekly billing . Cut-off is every Saturday, and payment to
follow not later than Wednesday. (25% of total amount contract every week)
 8. Move and demove shall be provided by the FIRST PARTY.

IN WITNESS WHEREOF, the parties hereunto affixed their signature this ___ day of November,
