DEED OF CHATTEL MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

This CHATTEL MORTAGE made and executed by Sheila Mae R. Calicdan with
postal address at Prk – 3B Pob. New Bataan, Compostela Valley Province hereinafter
known as the MORTGAGOR, in favour of John Carlo H. Rosello a legal age, Filipino
Citizen, single with postal address at Prk – 3A Pob. Compostela, Compostela Valley
Province hereinafter known as the MORTGAGEE,

WITNESSETH:

That the MORTGAGOR does hereby conveys by way of CHATTEL MORTGAGE unto
the MORTGAGEE the following described personal property in the possession of the said
MORTGAGER, to wit:

TYPE OF BODY : STEEL PLATE NO. : XYZ 012
YEAR MODEL : 2007 FILE NO. : 12345

That this CHATTEL MORTGAGE is given as security for payment to the MORTGAGEE
of the amount due on the promissory note for the sum of TWO HUNDRED THOUSAND
PESOS (₱ 200,00.00) Philippine Currency, receipt of which acknowledged by the
MORTGAGOR, upon the signing of this instrument, payable within the period of ONE (1)
year with interest thereon plus interest thereon at TWENTY THOUSAND PESOS
(₱20,000.00) per month. In case of non – payment, the MORTGAGOR undertakes to
voluntary surrender the unit which is the subject of the Promissory Note and Chattel
Mortgage. Failure and/or refusal on the part of the mortgagor to surrender the unit shall
constitute ESTAFA and/or violation of Article 319 of the Revised Penal Code and other
penal and administrative statutes which are crimes punishable by law.
That the condition of this obligation is that the MORTGAGOR should perform the
obligation to pay the hereinabove sited indebtedness of TWO HUNDRED THOUSAND
PESOS ( ₱200,000.00) Philippine Currency together with the accrued interest thereon,
this chattel mortgage shall once become null and void and of no effect whatsoever,
otherwise, it shall remain full force and effect.

IN WITNESS WHEREOF, the parties have hereunto set their hands this 4th day of
December 2018 in Davao City, Philippines.

We, the undersigned MORTGAGOR AND MORTGAGEE hereby jointly and severally swear
that we executed the foregoing Chattel Mortgage in order to secure the indebtedness therein
and for no other purpose or purposes contrary to the law.
