Dear Ms. Brown:

As you know, in the recent years, the construction of pipelines across the
Commonwealth, especially the Mariner pipeline project in my district, has caused a great deal of
consternation and concern among Pennsylvania residents. That fact is evidenced by the 1000
citizens who participated in my telephone town hall on pipelines last week. Among the concerns
raised during my town hail were pipeline safety and siting issues, as well as the plight of several
property owners in my district who have had mechanic’s liens slapped on their private property
by a subcontractor, United Piping, Inc., for Sunoco on the Mariner II project.

For your review. I am enclosing an e-mail I received from one of my constituents who is
now facing the prospect of have a mechanic’s lien against his property. As you will note from
this e-mail correspondence, in essence, in addition to the construction impacts and environmental
concerns endured by property owners under whose property the pipeline runs, they could now be
faced with the financial ramifications and potential hardships of liens placed against their private
property for a construction project which they were forced to accept. They are rightly concerned
about the impact of this legal action on their personal and financial well-being especially if the
pipeline company (Sunoco) fails to meet its financial obligations.

In light of this information, would you be able to look into this issue and address the
concerns raised by my constituents? Can commission offer any assistance to the property
owners impacted by these liens? Thank you for your thoughtful attention to this matter.

Senator Schwank and elected officials;

I am writing in reference to Senator Schwanks conference call last evening with the DEP and PUG in regard to Pipeline
Safety. I was not able to attend the call due to prior commitments but I was informed of some of the topics, one of them
being Mechanics Lein. I received a 30 day notice of intent to file a lien against my property in excess of $492,000 by the
company UPI. This is an extremely disturbing proposition in that Sunoco could build their entire project and leave the bill
behind for the landowners to pay or be saddled with liens which make their property worthless. One property mentioned in
the suit could be on the hook for over $9 Million. In addition, the Twin Valley School District is liable for over $5 million in
liens. While Sunoco has no tangible ownership to the property, our agreement of use of land, is being utilized as a
connection to pass the bill along.

In addition, I agree with the comments of Public Utility status in general, that being that no other company is eligible to
utilize this pipe for their purposes, making it a private use. While this can be also viewed as a personal public beneficial
use it can also be argued that the only withdraw from this pipe for public function is for Propane, and no all public utilizes
propane either. this pipe and company enjoys the luxury of Public Utility Status while not sewing the public in the least.

This whole concept is an utter disaster and further exemplifies the trials and tribulations that landowners must endure in
this project. Due to the Public Utility status that Sunoco holds, the landowners can not deny the project, do not have any
say in design, do not hire nor in this case fire contractors, and they could be left with the bill in addition to the
environmental damages and loss of use of their property. Every property owner, including municipal and commercial
owners, are liable for the bill.

I have attached the Notice that includes my property information but not that of the other properties as I am not
comfortable divulging others deeds, right of way agreements or personal information.

I would appreciate a review and response on this topic as it is a significant issue for all property owners throughout the
state.
