RESIDENTIAL RENTAL AGREEMENT

THIS RENT AGREEMENT is made and entered on this 18 Day of August 2018 between:-

Address: Plot No- 497/2, Sector- 7/B, Gandhinagar-382007, Gujarat, India.
(Hereinafter referred to as “THE LANDLORD” which expression shall include
his/her/their heirs,successors,attorneys,assignees,etc.)

Kotak Kanaiylal Parsotam, Age: Adult,


Address: Randal Krupa, Near Pragjibapa Ashram, Laxminagar, Porbandar, Gujarat.
(Hereinafter referred to as “THE TENANT”, which expression shall include
his/her/their heirs, successors, attorneys, assignees, etc.)

That the “Landlord” being the absolute owner of the property mentioned herein and
subject matter of suit hereby allows the “Tenant” with effect from 15.08.2018, to use
on a temporary basis the following described SCHEDULED PREMISES, located at Flat
No. T/303, “Swagat Afford”, Village - Sargasan, Ta&Dist: Gandhinagar.

DEFINITION AND DETAIL OF “SCHEDULED PREMISES”


1) Apartment No. T-303, Swagat Afford, Sargasan, Gandhinagar.
2) The electrical items like fans (4 in quantity) and tube light (3 in quantity) installed by
landlord at the SCHEDULED PREMISES as per tenants requirement are hereby declared
as part of SCHEDULED PREMISES.
3) The window and room curtains (10 in number and related accessories) installed by
landlord at the SCHEDULED PREMISES as per tenants requirement are hereby declared
as part of SCHEDULED PREMISES.

RECITALS:
The Landlord is the sole and absolute owner , in possession of the premises which is
more particularly described hereunder (hereinafter referred to as the SCHEDULED
PREMISES) having full and unfettered rights to let on rent the same or any portion
thereof.
The tenant intends to take on rent the SCHEDULED PREMISES to be used as residence.
The Landlord has agreed to give on rent and the Tenant has agreed to take on rent , the
SCHEDULED PREMISES on certain terms and conditions stated hereunder.
NOW THE AGREEMENT WITNESSED AS FOLLOWS:

1. RENT : -
The Tenant hereby agrees to pay a monthly RENT of Rs. 8500/- (Eight
Thousand Five Hundred Rupees only) to the Landlord of the premises in
advance every month on or before the 5th day of each English calendar Month,
through Cheque/NEFT/Cash. This is excluding the society maintenance charges
(if any), water bill , gas bill and electricity bill, etc.

2. REFUNDABLE SECURITY DEPOSIT :-

That the Tenant has paid to the Landlord a non-interest bearing refundable
security deposit of Rs.8500/- (Eight Thousand Five Hundred Rupees only) and
advance of 15 days of the month of August, 2018, amounting to Rs.4250/- (Four
Thousand Two Hundred and Fifty only) by Cash/Cheque/NEFT/RTGS to the
Landlord on 17/08/2018. Out of this payment the non-interest bearing security
deposit shall be refunded by the Landlord to the Tenant promptly at the expiry
or earlier termination of this agreement, whichever is earlier, after adjusting any
outstanding dues payable by the Tenant and on the Tenant delivering vacant
possession of the SCHEDULED PREMISES.

3. Electricity Bill /Gas Bill/Bills of such Utilities used by the Tenant:


That the Tenant shall directly pay the monthly Electricity consumption
charges/bills & Gas Bills and other such utility bills etc., to the concerned
authorities according to the meters, installed at the SCHEDULED PREMISES or as
billed by the concerned authorities. The amount concerned with above
mentioned bills is excluding the rent paid by the Tenant.

4. LICENSE PERIOD:
That the Landlord agrees to rent the “SCHEDULED PREMISES” to the
Tenant for a a period of 11 Months (hereinafter referred to as the “Agreement
Period”) commencing from 15th Aug 2018 and the rent is payable from that
date. (15th Aug 2018 to 14th June 2019)

5. NOTICE:
One month written notice from either side without assigning any reason will be
sufficient to terminate this agreement and the Tenant has to handover the
Vacant and Peaceful possession back to the Landlord, and Landlord has to
return the refundable Security Deposit amount to the Tenant, after adjusting any
outstanding dues payable by the Tenant.

6. RENEWAL OPTION:
After the expiry of this agreement if Landlord and Tenant both agree to renew
the agreement than Landlord shall have an option to renew this agreement
further & if this agreement is renewed than the license fee will be increased by
05 %.

7. Lock-In-Period:
There is a lock in period of Six month from possession date (if Tenant chooses to
vacate the premises before completion of Six month of agreement, the Tenant
is/are not eligible to get security deposit back from Landlord. (Security deposit
shall not be adjusted with any advanced monthly rent or unpaid dues on part of
the Tenant).

8. OCCUPANCY:
The Tenant shall use the SCHEDULED PREMISES for residential use only.

9. That the Tenant shall not carry out any structural additions or alteration in
premises to the building layout, Fittings or fixtures without the written consent of
the Landlord. Noted here is the permission granted by the Landlord to the
Tenant, to fix a latch on both sides of the Main door and for Drilling holes in the
Kitchen wall (not on the tiled part of the wall) for water purifier, as discussed and
agreed upon by both parties.

10. That the Tenant shall not keep any hazardous items/goods etc. in the said
premises which is prohibited by the law.

11. That the Tenant shall not carry out any antisocial activity prohibited under the
prevailing act of law.

12. That the Tenant shall not by him or through anybody cause/create/allow any kind
of nuisance/annoyance or hindrance in the said premises or its surrounding
neighborhoods and the society/association’s norms, rules and regulation will be
binding to the Tenant and its occupant.

13. The terms of this agreement shall not be altered or added nor shall anything be
omitted from this agreement except by means of as agreement in writing duly
signed by the parties hereto. The Tenant shall not be entitled to any further
renewal for any other reason whatsoever.

14. That the Tenant shall permit the Landlord and his/her authorized persons/agents
to enter upon the said premises for inspections and to carry out repairs etc. as and
when necessary, at reasonable a time with preliminary notice and the Tenant shall
permit.

15. Tenant is not liable for any damage to the premises on account of natural
calamities.

16. That the Tenant shall bear the current day to day minor repairs and maintenance
to the premises and always keep the premises in, as handed over condition. The
day to day repairs such as fuses, leakages, water taps, electrical fittings, wires,
switches, etc. and maintenance of electrical/sanitary and all other fittings and
fixtures shall be carried out by the Tenant at its own cost and expense. If there is
any major repairs not caused by the Tenant and his direct negligence, and is a fault
of the premises, then that shall be repaired by the Landlord as soon as possible.
Damage to wall by any means (i.e. Drill, punch or nail/screw) is not allowed within
premises. However it is necessary, things should bring in notice with Landlord.
17. If the Tenant fails to comply on any of the terms or fail/forget to pay monthly
License fee in proper time or commit a breach of the terms and condition said in
this agreement as mentioned in this agreement, Landlord shall have the right to
terminate this agreement by giving notice in writing to the Tenant and the Tenant
and his/her occupants shall hand over the vacant peaceful and physical possession
back to the Landlord within the last date of the month and also clear all the due’s
according to this agreement of Residential Rent, and the Landlord will return the
refundable Security Deposit amount to the Tenant, after adjusting any outstanding
dues payable by the Tenant.

18. The Tenant shall not change the use of the said premises sub-license, assign, sublet
transfer any part or whole of the said premises, nor transfers the tenancy rights in
the said premises, to anyone in any circumstances.

19. (i) Upon the expiry (unless renewed) or sooner termination of this agreement
and/or, (ii) Upon the expiry of the initial term and if renewed, and upon expiry of
renewed or sooner termination of this agreement or the renewed terms, the
Tenant shall remove themselves from the said premises and also remove all their
furniture and other articles and things brought in or up to the SCHEDULED
PREMISES by the Tenant in pursuance of this agreement and ensure to return the
said premises to the Landlord in the same state and condition (subject however to
any improvement made with the consent of the Landlord) and they were on the
date of the agreement, subject to reasonable wear and tear excepted, and the
Landlord will return the refundable Security Deposit amount to the Tenant, after
adjusting any outstanding dues payable by the Tenant.

20. It being the express intention of both the parties that this is purely residential rent
agreement that is between the Landlord and the Tenant.

21. That the Landlord hereby warrants to the Tenant that he is the member of the
said society/association and is entitled to enter into and execute the agreement.
The Landlord further warrants that there are no outstanding payments or taxes
require to be made to the said society/association or to anybody or authority or
any proceedings pending in connection with the ownership or otherwise of the
said premises

22. Any dispute that may arise between the Parties shall be subject to the jurisdiction
of the courts of Gandhinagar (GJ).
23. The Landlord shall deliver the said premises to the Tenant complete in all
respects along with electricity and water connection and clearing all the dues
towards the society / association’s maintenance charges and the local authority
taxes like Municipal Corporation.

24. Power Electricity Reading at the time of taking possession was 2513 units. And Gas
Reading at the time of taking possession 0013076.4 units.
25. That the original copy of agreement shall be retained by the Landlord.

26. In case any party found giving wrong information, then the same party shall be
liable for his part of responsibility.
In Witness whereof the Tenant and the Landlord have hereunto set and subscribed their
respective hands and seal on the Day, Month and Year first above written.
