IN THE MATTER OF
CORRECTION OF ENTRIES IN
THE CERTIFICATES OF LIVE
BIRTH OF CHARLOT EMNAS
ALER AND NILFORD EMNAS
ALER, ETC.
1
compliance with jurisdictional requirements per Order dated
25 February 2014;
EXHIBIT “H” and series, the NSO authenticated-
Marriage Contract of petitioner and husband Nilo N. Aler
with Registry Receipt No. 93-06 dated 11 February 1993 with
the late Municipal Mayor Benito Astorga, of Daram, Samar,
as solemnizing officer.
PURPOSE:
To prove that the petitioner and her husband had
lawfully married each other on 11 February 1993.
PURPOSE:
To prove the fact of birth of petitioner’s daughter
Charlot on 13 October 1993 in Brgy. Bagacay, Daram,
Samar; to prove the erroneous entry in her middle and last
names “Colon Emnas” as appearing therein when it should
be “Emnas Aler” hence the full name “Charlot Emnas Aler”
and not “Charlot Colon Emnas” as said daughter is a
legitimate child of said petitioner and husband; to prove that
the affidavit of acknowledgment/admission of paternity of
petitioner and husband was flawed or based on a wrong
belief but nevertheless made in good faith.
PURPOSE:
To prove the fact of birth of petitioner’s son Nilford on
28 March 1995 in Brgy. Bagacay, Daram, Samar; to prove the
erroneous entry in his middle and last names “Colon Emnas”
as appearing therein when it should be Emnas Aler or the full
name “Nilford Emnas Aler” not “Nilford Colon Emnas” as
said son is also a legitimate child of said petitioner and
husband; to prove that the affidavit of
acknowledgment/admission of paternity of petitioner and
2
husband was flawed or based on a wrong belief but
nevertheless made in good faith.
EXHIBIT “K” the second or subsequent certificate of
marriage of petitioner and husband with Registry No. 2000-
11 with the Rev. Fr. Jose O. Balasbas, Parish Priest, Daram,
Samar, as solemnizing officer, dated 06 January 2000.
PURPOSE:
To prove that petitioner and husband, despite their
previous marriage, Exhibit “H,” re-married again on 06
January 2000 due to their erroneous but honest belief that
they are still unmarried or that their church wedding
consummates their marriage.
PURPOSE:
To prove that per said NSO directive, the supposed
legitimation by the afore-named children of petitioner
cannot prosper as petitioner and husband are already
married before their dates of birth; that finally, per NSO
directive, petitioner filed the instant petition to correct her
children’s certificates of live birth with the court, particularly
that mentioned in its prayer.

( OF LORNA EMNAS ALER BEFORE ATTY. MEDINO L. ACUBA
AT HIS LAW-OFFICE AT 299 CURRY AVENUE, CATBALOGAN
CITY ON 02 JUNE 2014 AT 2:00 O’CLOCK IN THE
AFTERNOON.)
7
(I am that petitioner.)

B. Oo, aadi an amon Marriage Contract nga may ada
Registry No. 93-06 nga ginhatag han National Statistics
Office, Catbalogan City (Exhibit “H”)
(Yes, here is our Marriage Contract with Registry No. 93-06
furnished by the National Statistics office, Catbalogan City.)
18P. Kay ano nga rason nga waray dayon karehistro an ira
kapanganakan?
(Why are their births not seasonably registered?)
B. Kay hilot man la adto an nagpa-anak ha ira, baga
nalibang kami hasta nakalimutan ug napabayaan namon
adto nga pagpa-rehistro. Waray kami sadang nga hibaro
hine nga panrehistro labi na ha Civil Registry han Daram,
Samar. Dire man dayon hadto narehistro dayon.
(The traditional midwife administered their births, we were
then busy until the time we forgot or neglected that
registration. We have no enough knowledge regarding
registrations in the Civil Registry in Daram, samar. They
were not registered immediately.)
9
19P. Ha yana rehistrado na an mga kapanganakan han iyo
duha nga anak didto han Civil Registry han Daram, Samar?
(Presently, are the births of your two children registered with
the Civil Registry of Daram, Samar?)
B. Oo.
(Yes.)
21P. Kun sugad may ada na ine nga imo mga anak mga
birth certificates?
(So your children have now their birth certificates?)
B. Oo. Aadi man. (Birth Certificate of Charlot Emnas Aler
[Exhibit “I] and Birth Certificate of Nilford Emnas Aler [Exhibit
“J”). Dungan ko ine hira ginpa-rehistro hadton Agusto 7,
2000.
(Yes, here they are. They were simultaneously registered on
August 7, 2000.)
22P. Ine nga mga birth certificates han imo mga anak
nagmamalatumat nga an ira mga ngaran amo hi “Charlot
Colon Emnas” (Exhibit I-1) sugad man “NIlford Colon
Emnas” (Exhibit “J-1”) aada hit Entry No. 1 hit ira tagsa-
tagsa nga birth certificate. Ano man an masisiring mo hito?
(These birth certificates of your children tell us that there
names are Charlot Colon Emnas) so is “Nilford Colon Emnas
ntry No. 1 in their respective birth certificates. What can you
say about these?
B. Kay kasabot namon nga dire pa rehistrado amon mag-
asawa kasal. Nalipat la ako. Kasabot ko man nga dire
kumpleto an amon kasal kay waray pa man kami kasla ha
simbahan. An anay akon kasabot nga madig-on an kasal
ha simbahan.
(I thought our marriage was not yet registered. I was
mistaken. I thought our marriage was not yet complete
since we had no church wedding yet. It was my belief that a
church wedding is more binding.)
10
(When did you have your church wedding?)
B. January 6, 2000.
27P. Ano man ito yana it masisiring mo hit mga apelyido hit
imo mga anak nga nakasurat hit ira tagsa-tagsa nga birth
certificate?
(What can you say on that surnames of your children as
entered in their respective birth certificates?)
B. Sayop ito, kay unta an ira apelyido “Emnas Aler”. An
akon apelyido ug han akon asawa kay legal na man ngayan
kami nga mag-asawa hadto pa han Pebrero 11, 1993. Late
registration man adto nga pagpa-rehistro ira kapanganakan.
(It is erroneous since their surnames should have been
“Emnas Aler.” It should be my surname and that of my
husband since we were already legally married since
February 11, 1993. Their births were belatedly registered.)
28P. Labot pa hine nga sayop nga imo ginsayod, may ada pa
ba sayop han entries han mga birth certificates han imo mga
anak?
(Aside from the erroneous entry which you just pointed, are
there still some erroneous entries in the birth certificates of
your two children?)
B. Oo.
(Yes.)
11
B. An amon petsa ngan lugar han pag-asawa namon (Entry
No. 18). Nakabutang ha mga certificate nga “not married,”
(Exhibits “I-2 and “J-2”) .
(The place and date of our marriage (Entry No. 18). It was
respectively indicated therein as ‘not married’ )
31P. Labot la hine nga imo nasabi nga mga sayop han birth
certificates han iyo mga anak, may ada pa ba iba nga sayop
ito?
(Aside from these errors in the birth certificates of your
children, are there still other errors?)
B. Oo.
(yes.)
12
B. Han Hunyo 2013, kumadto kami han Local Civil Registrar
han Daram, Samar, kay nasugad man nagka-problema an
mga birth certificate han akon mga anak.
(In June 2013, we went to the Local Civil Registrar in Daram,
Samar, since as it now appears there had been a problem on
the birth certificates of my children.)
36P.Hain naman ine nga an baton han NSO “On DDot Query
Service?”
(Where is that answer from the NSO “On DDot Query
Service?”
B. Adi man. (Exhibit “L” and “L-1”)
(It is here.)
13
(In particular, what should the court do regarding the birth
certificates of your children?)
B. An bug-os nga ngaran han akon babaye nga anak
“Charlot Colon Emnas mahingadto ha “Charlot Emnas Aler”
an kan Nilford Colon Emnas ngadto “ Nilford Emnas Aler.”
(The full name of my daughter Charlot Colon Emnas be
corrected to “Charlot Emnas Aler” and for Nilford Colon
Emnas to “ Nilford Emnas Aler.”
41 P. Ano pa man.
(What else?)
B. Ha katapusan ano pa man.
(In the end, what else?)
B. Ma-cancelar liwat han amon “Acknowlegment” ngan han
amon “Affidavit of Acknowledgment, may petsa 18 August
2000” nga nakabutang han ira Certificates of Lives Birth.
(To cancel the “Acknowlegment” and the “Affidavit of
Acknowledgment, dated 18 August 2000” indicated in their
Certificates of Lives Birth.)
