PETITIONER thru counsel and unto the Honorable Court


formally offers, in support of the instant petition, the
following documentary exhibits with respective purposes as
follows:

EXHIBIT “A” and series, the petition, to EXHIBIT “G” and


series, exclusive, were previously admitted in evidence in

compliance with jurisdictional requirements per Order dated
25 February 2014;
EXHIBIT “H” and series, the NSO authenticated-
Marriage Contract of petitioner and husband Nilo N. Aler
with Registry Receipt No. 93-06 dated 11 February 1993 with
the late Municipal Mayor Benito Astorga, of Daram, Samar,
as solemnizing officer.

PURPOSE:
To prove that the petitioner and her husband had
lawfully married each other on 11 February 1993.

EXHIBIT “I” and series, the NSO-issued Certificate of


Birth of petitioner’s daughter “Charlot Colon Emnas” dated
07 August 2000.

PURPOSE:
To prove the fact of birth of petitioner’s daughter
Charlot on 13 October 1993 in Brgy. Bagacay, Daram,
Samar; to prove the erroneous entry in her middle and last
names “Colon Emnas” as appearing therein when it should
be “Emnas Aler” hence the full name “Charlot Emnas Aler”
and not “Charlot Colon Emnas” as said daughter is a
legitimate child of said petitioner and husband; to prove that
the affidavit of acknowledgment/admission of paternity of
petitioner and husband was flawed or based on a wrong
belief but nevertheless made in good faith.

EXHIBIT “J” and series, the NSO-issued Certificate of


Birth of petitioner’s son “Nilford Colon Emnas” dated 07
August 2000.

PURPOSE:
To prove the fact of birth of petitioner’s son Nilford on
28 March 1995 in Brgy. Bagacay, Daram, Samar; to prove the
erroneous entry in his middle and last names “Colon Emnas”
as appearing therein when it should be Emnas Aler or the full
name “Nilford Emnas Aler” not “Nilford Colon Emnas” as
said son is also a legitimate child of said petitioner and
husband; to prove that the affidavit of
acknowledgment/admission of paternity of petitioner and

husband was flawed or based on a wrong belief but
nevertheless made in good faith.
EXHIBIT “K” the second or subsequent certificate of
marriage of petitioner and husband with Registry No. 2000-
11 with the Rev. Fr. Jose O. Balasbas, Parish Priest, Daram,
Samar, as solemnizing officer, dated 06 January 2000.

PURPOSE:
To prove that petitioner and husband, despite their
previous marriage, Exhibit “H,” re-married again on 06
January 2000 due to their erroneous but honest belief that
they are still unmarried or that their church wedding
consummates their marriage.

EXHIBIT “L” the NSO OnDDot Query Service re


birth/legitimation of “Aler, Charlot”

EXHIBIT “L-1” the NSO OnDDot Query Service re


birth/legitimation of “Aler, Nilford”

PURPOSE:
To prove that per said NSO directive, the supposed
legitimation by the afore-named children of petitioner
cannot prosper as petitioner and husband are already
married before their dates of birth; that finally, per NSO
directive, petitioner filed the instant petition to correct her
children’s certificates of live birth with the court, particularly
that mentioned in its prayer.

THE FOREGOING exhibits, which copies are appended


to the records and affirmed by the Public Prosecutor to be
faithful reproduction of the original, are also being offered to
form part and parcel of the testimony of petitioner.

WHEREFORE, premises considered, it is respectfully


prayed that the foregoing documentary exhibits with

COMES NOW petitioner by counsel and unto the


Honorable Court respectfully states that during the last
hearing of 30 June 2014, it was moved that the Municipal
Civil Registrar, Daram, Samar, be subpoenaed to appear
during the 04 August 2014 hearing and identify some
documents; that after clarifications with said public official,
petitioner deemed it apt to forego with his testimony as it is
no longer necessary; that instead petitioner shall formally
offer her documentary exhibits in support of her petition
within reasonable dispatch.
WHEREFORE, premises considered, it is respectfully

(The traditional midwife administered their births, we were
then busy until the time we forgot or neglected that
registration. We have no enough knowledge regarding
registrations in the Civil Registry in Daram, samar. They
were not registered immediately.)

mistaken. I thought our marriage was not yet complete
since we had no church wedding yet. It was my belief that a

birth certificates, whose names are these?)

(They are my first and last names when I was still a maiden
or unmarried.)

(What can you say on that surnames of your children as
entered in their respective birth certificates?)

kami nga mag-asawa hadto pa han Pebrero 11, 1993. Late
registration man adto nga pagpa-rehistro ira kapanganakan.
(It is erroneous since their surnames should have been
“Emnas Aler.” It should be my surname and that of my
husband since we were already legally married since
February 11, 1993. Their births were belatedly registered.)

(Aside from the erroneous entry which you just pointed, are
there still some erroneous entries in the birth certificates of

(These are errors since we were already married during their
births.)

acknowledge or mag-admitar ka kag-anak kay lehitimo
naman namon hira nga mga anak.
(We thought lso that they are not legitimate since we are
not yet married until we came to know that we are already
legally married. So it is no longer necessary for us to
acknowledge or to admit the paternity as they are already
legitimate children.)

(What if any action was had regarding the late birth
registration of our children?

B. Han Hunyo 2013, kumadto kami han Local Civil Registrar
han Daram, Samar, kay nasugad man nagka-problema an
mga birth certificate han akon mga anak.
(In June 2013, we went to the Local Civil Registrar in Daram,
Samar, since as it now appears there had been a problem on
the birth certificates of my children.)

(What transpired on your visit to that office?
B. Ginhatag ha amon han Civil Registrar an baton han NSO
“On DDot Query Service” nga nasiring nga dumangop kami
ha husgado nga ma-correct an mga birth certificate han
akon mga anak kay kasal naman kami han akon asawa
antes han kapanganakan han akonmga anak. Sanglit, l

(We were given by the Civil Registrar an answer to the NSO
“On DDot Query Service” instructing us to secure a lawyer to
correct the birth certificates of our children since I am
already married with my husband before the births of our
children. So they are already legitimate children.)

MANIFESTATION AND MOTION

COMES NOW petitioner by counsel and unto the


Honorable Court respectfully states: That-

1. On 11 December 2013, the hearing of the petition


was suspended considering petitioner’s predicament
regarding the failure of the newspaper editor (who was a
victim during the onslaught of super-typhoon “Yolanda”) to
execute the necessary affidavit of publication pursuant to
the Order of 16 September 2013;
2. Fortunately, just today, the direly-needed
newspaper publications and the said affidavit were delivered
to this counsel;

3. The petitioner thus is ready to present evidence in


compliance with jurisdictional requirements.

WHEREFORE, premises considered, it is respectfully


prayed this petition be set for hearing on 25 February 2014
at 8:30 in the morning.
