Lake Blvd. #17 Mahopac, New York,10541 (646) 872-3546 NATURE OF CLAIMS and MANNER IN WHICH THEY ARISE The claims include, but are not limited to, civil action for declaratory, injunctive, and equitable relief, plus monetary damages, to redress Defendants’ unlawful employment/business practices against Claimant, including the unlawful manner in which the FDNY Chief Fire Marshal, Thomas Kane (Kane) & FDNY Deputy Chief Fire Marshal, John David "JD" Lynn (Lynn), retaliated against the claimant once claimant, as required by his employment, reported corruption to.the New York City Department of Investigation (DOI). Then the FDNY Bureau of Investigations and Trials (BITS) via its Assistant Commissioner, Carlos Velez, (Velez) unlawfully directed claimant's pension application to be indefinitely withheld from being lawfully processed. According to Velez, his action was based on claimant being "investigated," yet Velez provided no basis for said investigation. Furthermore, according to DOI, claimant is not under investigation This claim is in addition to the previously filed notice of claim dated July 11, 2018. The underbelly of this tragic situation is the extent that Lynn, Kane and Velez, will go in the continuation of the coverup of the death of FDNY Firefighter Michael Davidson. There is no doubt in the professional opinion of the Claimant that Edward Norton's (Norton) movie production company was the Precipitating cause of the conflagration that caused the death of Firefighter Davidson. As is consistent with the well documented racist history of the FDNY, the FDNY's Bureau of Fire Investigation (BFl) is blaming a poor African American from Harlem in causing the fire, while the Hollywood production company is given little if any scrutinyClaimant's opinion is based on the events leading up to the rush for judgment which was spearheaded by Lynn and endorsed by Kane. With manic urgency Lynn insisted, while Kane acquiesced to his subordinate (Lynn), that the boiler was the sole cause of the fire. The only problem with Lynn's perverted theory regarding the causation is that once the Claimant dug through the rubble, the boiler and its cinderblock encasement was intact. Alternatively, Lynn was vehemently opposed and refused the offer of the on scene Federal Agent from the ATF to ship the boiler to the Federal facility for analysis. Far be it for Lynn to allow a scientific review get in the way of his rush to judgment. Furthermore, Lynn and Kane ignored that fact that Norton's film company lied to the Claimant regarding the massive amounts of highly combustable, Petroleum based, movie set materials that were overloaded into the building. Additionally, Lynn & Kane ignored the evidence that some of the wood screws that Norton's film company installed into hardwood the floors were of adequate length to pierce electrical BX cables and in fact, after the collapse, some BX cable was found to be pierced. As of the date of this filing the report of the on scene ATF electrical engineer has not been requested nor received by BFI. Covering up the death of members of the FDNY is nothing new.
