This is a cease and desist intended for the director of Alberta Health and All Directors of subsidiary
organizations, facilities, institutions, ancillary staff, solicitors and proprietors.
Immediately cease all illegal actions not adhering to the jurisdiction pertaining to section 32 of the
canadian charter of rights and freedoms, and section 52 of the canadian constitution act which
supersedes the provincial mental health legislation that is currently being used to justify illegally
conducted actions against Jericho Labonte - Private Individual.
The individual in custody is a private individual as defined in black's law dictionary and outlined in
section 32 of the charter of rights and freedoms.
Jericho is being illegally held and detained in Alberta Health Services custody; as Section 32 of charter
over-rides and supersedes all mental health legislation, jurisdiction or mandate in which the alberta
health facilities are currently illegally detaining Jericho against his consent and without contract under
the Uniform Commecial Code as well as operating outside of Charter Law.
All staff and ancillary employees are refusing to adhere to continuous asserted statements of illegal
conduct, and justifying the unwarranted and illegal detention / apprehension without adhering to the
jurisdiction and legislation of section 32 of the Canadian charter of rights and freedoms.
Jericho has claimed and iterated on multiple occasions to staff and doctors, that all authorities currently
conducting this illegal apprehension / detention are operating outside of legal mandate and jurisdiction
of the charter, and that their actions are currently being conducted on a continuous illegal basis, with
response from all staff refusing to adhere to the legislation of the Canadian charter of rights and
freedoms.
Failure to comply will result in further litigation as well as a fee schedule will come into effect as of Dec
17, 2018.
The said fee schedule will be provided alongside this cease and desist order and all organizations
involved in detaining Jericho will be held liable for further , fees, costs and nominal compensatory and
punitive damages outlined in the provided fee schedule / civil lawsuits.
Further detention / apprehension in custody of Jericho Labonte will constitute acceptance of terms and
conditions laid out within the provided fee schedule.
Jericho is a Private Individual as defined in the clear definition of section 32 of the charter of rights and
freedoms.
Alberta Health does NOT have legal jurisdiction or mandate to be able to; hold, detain, asses,
apprehend, or confine Jericho under any mental health legislation as it is; defacto, non-applicable, and
operating outside of legal mandate.
The mental health act only has jurisdiction over Legal Persons, and Jericho is not a Legal Person / has
claimed to be a Private Individual numerous times to all doctors and staff.
This has been documented and stated at Ponoka Centennial Facilities, Alberta Hospital, Royal Alex and
Alberta Health Services Headquarters.
Full litigation is intended and has been explicitly expressed to several authorities acting on behalf of
alberta health services, and further civil lawsuits to recover damages and costs outlined in the provided
fee schedule will be claimed if illegal actions / detention continues.
a) to the Parliament and government of Canada in respect of all matters within the authority of
Parliament including all matters relating to the Yukon Territory and Northwest Territories; and
b) to the legislature and government of each province in respect of all matters within the authority of
the legislature of each province.
(2) Notwithstanding subsection (1), section 15 shall not have effect until three years after this section
comes into force.”
The purpose of this section is to make it clear that the Charter only applies to governments, and not to
private individuals, businesses or other organizations.
Canadian Constitution act - section 52. (1) The Constitution of Canada is the supreme law of Canada,
and any law that is inconsistent with the provisions of the Constitution is, to the extent of the
inconsistency, of no force or effect.
This will serve as your legal notice to cease and desist all further actions described above. You are
hereby instructed to comply with this letter immediately or face legal sanctions under applicable Federal
and Provincial/Territorial law. Full Litigation is intended and will be filed for immediately.
