Part 4: Selection Process

The District’s Governing Board (“Board”) will consider price in addition to the Proposal’s conform-
ance to the requirements of the RFP, the construction manager’s experience and qualifications,
the construction manager’s references, and any other relevant factors as determined by the
Board acting in its sole discretion. The District may or may not interview finalists. The Board re-
serves the right to reject any and all Proposals in the best interest of the District, as determined
by the Board acting in its sole discretion, and to modify the scope of services by addendum prior
to the final date for submission of proposals.

Note: Pursuant to Government Code section 4529.12, District employees are prohibited from
participating in the selection process when they have a financial or business relationship with any
private entity seeking to enter into a contract with the District, and the District requires compli-
ance with all laws regarding political contributions, conflicts of interest or unlawful activities.

Part 5: Construction Management Services Agreement


The selected construction manager must enter into a written agreement for the construction serv-
ices using the District’s standard form agreement for Construction Management Services (the
“Agreement”), a copy of which is available upon request after the District short lists the partici-
pants. No modifications to the Agreement and no other form of agreement will be accepted.
