Lam Chris Comell’s brother. I am not a party to or interested in the above- captioned action. I am a US. citizen, over the age of 18 years, and am competent to be a witness. I make this declaration based on my personal knowledge. 2. In July 2003, I traveled to Seattle, Washington to attend my sister’s surprise birthday party. Prior to my trip, I called Chris to ask if I could borrow one of his guitars, a purple 88 Les Paul guitar. It was a very brief conversation, right before Chris went on stage I recall Chris said I could borrow the guitar. He did not tell me where the guitar was located. He just told me to go see Denny and if Denny couldn’t help me, Erie Garcia could. 3. Denny Markopoulos lived in the house next door to Chris and Susan’s house in West Seattle. I had been there before. I was upset that it was just laying out because I was, really fond of that guitar. I picked it up, tuned it, strummed it a bit, and put it back in its, case, I also saw the Gretsch guitar that Chris had played in the Black Hole Sun video there, and an old Fender Jag sunburst guitar there. 4, Eric Garcia came over and I told lim that Chris hed said I could borrow the 88 Les Paul. Eric told me it was in the garage and took me over there to get it, Eric went into the garage. I stayed by the door. I saw Eric pull some blankets back and go in undemeath them to get the guitar. I saw a couple of other guitars under there, none that 1 could identify. I did not see a rack of guitars in the garage. ‘The guitars I saw were totally hidden from view by the blankets. The only way anybody could have seen those guitars would be if someone had pulled the blankets back and shown them. 6. I did not think anything at the time about the guitars being hidden under blankets in the garage. I was just there to pick up the Les Paul. I never mentioned to Chris ‘that guitars were behind blankets in the garage. I did not know how or where Chris’s guitars were stored before then, so I had no reason to think that storing them behind blankets in the garage was unusual. I did not even know if the other 2-3 guitars I saw under the blankets were Chris’s guitars, so there was no reason for me to tell Chris about them. 7. Istill have the 88 Les Paul, Chris can have it back any time he wants it. It is his guitar.
