I, Daniel T. Satterberg, Prosecuting Attorney for King County in the name and by the
12 authority of the State of Washington, do accuse JAY DEE HARP, III of the following crime[s],
which are of the same or similar character, and which are based on the same conduct or a series
13 of acts connected together or constituting parts of a common scheme or plan: Assault In The
Second Degree, Malicious Harassment, committed as follows:

That the defendant JAY DEE HARP III in King County, Washington, on or about
16 December 30, 2018, did intentionally assault another and thereby recklessly inflict substantial
bodily harm upon ;

The State incorporates by reference the Certification for Determination of Probable Cause

prepared by Detective Michael A. Glasgow of the KCSO/Burien Police Department for case
6
number C18055784.

Pursuant to CrR 2.2(b), the State requests bail set in the amount of $100,000.
8
Although bail was set at first appearance in the amount of $25,000, the requested bail amount
9
more appropriately takes into account the violent nature of the defendant’s attack and the danger
10
the defendant poses to the community if released from confinement.

Here, the defendant spent the majority of the Seahawks v. Cardinals game harassing and
12
making crude, vulgar comments to the victim lesbian couple sitting nearby. The defendant asked
13
them repeatedly to “suck his dick” and called the victim a “fucking dike.” When the defendant
14
returned from purchasing a beer, the defendant grabbed the victim’s wife, unzipped her jacket,
15
and grabbed her breast. When several bystanders intervened to stop the defendant’s unacceptable
16
and crude behavior, the defendant fought them off and punched the other female victim in the
17
face, causing a nose bleed, significant pain, and breaking her front tooth in half.

It took multiple officers to detain the defendant and he continued to aggressively fight
19
and assault the arresting officers, punching one of them in the stomach. The defendant continued
20
his engaged screaming throughout his arrest and subsequent detention by the police. The
21
defendant had to be tased in order for the several officers to finally gain control of the
22
defendant’s violent behavior.

While the defendant has no known criminal history, the defendant’s willingness to

sexually assault a female – a complete stranger – in a crowded sports stadium and then violently
4
punch another female victim in the face demonstrates that he is a clear danger to the community.

Bail in the amount of $100,000 is necessary. The State also asks for no contact with the victims.

That Michael Glasgow 76804 is a Deputy with the King County Sheriff's Office and is familiar with the investigation
conducted in King County Sheriff's Office C18055784. There is probable cause to believe that HARP 3, JAY DEE,
10/3/1984 committed the crime(s) of:

• Malicious Harassment, in Seattle; and


• Assault In The Second Degree (a - Substantial Bodily Harm), in Seattle; and
• Assault In The Third Degree (Law Enforcement Officer), in Seattle

County of King, in the State of Washington.

This belief is predicated on the following facts and circumstances:

This incident occurred at Century Link Stadium located at 800 Occidental Av. S. in the City of Seattle, in the County of
King, in the State of Washington. This incident occurred around 1608 hours on 12/30/2018 during the 3rd quarter of the
Seattle Seahawks versus the Arizona Cardinals football game. The incident occurred in Section 118 around seats 12,
13, and 14.

A male fan, wearing all Arizona Cardinals apparel was sitting in the same row as , , and . This
male had to walk past all three of them to exit the isle. He did this many times during the game, each time returning with
beer. Each time he walked pasted them, according to , the male would step on their feet. also reported
that during the entire game the male was making multiple harassing comments to them like:
- "Do you suck dick?"
- "Do you need a man in your life?"
also reports that the male was saying harassing things to them during the game like:
- While motioning towards his mid-section and thrusting his hands asked if she "Wanted some dick?"
- "Suck my dick"
- "Fucking dike"
Sometime in the third quarter of the game the male again left the isle. Upon return he had another beer. As he walked
past them the male pushed and then grabbed by her jacket. He made a comment that was heard by and
but what was say is unknown. The male pulled on ' jacket and unzipped it. One witness later stated that it
looked like the male had grabbed ' breast and was not letting go. She tried to push him off of her and he threw
his beer right in her face. told the male that "he could not put hands on my wife". At this point, other fans in the
area came to help. The male was grabbed and taken to the ground. At one point, the male was able to get loose from
being held down, stood up, and punched directly in the face with a closed fist. This caused a small laceration to
the bridge of her nose, her nose to bleed, and chipped a large portion of one of her front upper teeth off. This punch
caused pain to her entire face.
Trooper Kenyon Wiley with Washington State Patrol was working at the stadium. He was flagged down about this fight.
He was the first law enforcement to get to the fight. When he arrived he found the suspect male being held down by
another male. He attempted to gain control of the male but he resisted. Trooper Wiley was wearing a fully marked
Washington State Patrol Aerostitch motorcycle uniform.
Deputy R. Sanders with KCSO was the second law enforcement to arrive. He immediately started to assist Trooper
Wiley with getting control of the suspect. Captain Old with Washington State Patrol arrive at the fight shortly thereafter.
He was wearing a Washington State Patrol uniform with a florescent green traffic vest on. Capt. Old saw that Trooper
Wiley and Dep. Sanders were struggling with the suspect. Capt. Old stated that the suspect looked at him and in a rage
told him that they better let him go. Capt. Old told him to calm down as he reached for one of his arms and was telling
him to quit resisting. The suspect said "No, fuck you!" and punched Capt. Old in the abdomen with his right fist. The
suspect had to be tased to finally be able to gain control and be handcuffed.
The suspect was identified as Jay Dee Harp. Harp continued to resist against law enforcement as they took him to the
holding area of the stadium. It was clear to law enforcement that Harp was highly intoxicated. He was booked for
investigation of Malicious Harassment and Felony Assault.
In 's written statement she stated:
"I have been an active member of the LGBT community for decades and fought for marriage equality as an adult. The
man's chronic and repeated comments about our sexuality, based on my experience, suggest my sexual orientation
