•October 7, 2016 –The vehicle was seized pursuant to the Controlled Substances Statute and the
Act for the Protection of Vehicular Property, 9 L.P.R.A. § 3201, et seq.,
• August 18, 2016- The Inspection Certificate was issued. An irregularity was detected during
said inspection regarding the lack of serial number of left fender.
• October 7, 2016- The registered owner of vehicle, Lourdes Perdigon Acevedo was given notice
of forfeiture.
• November 14, 20017- Lourdes Perdigon Acevedo brought suit challenging the confiscation by
filing a complaint against the Commonwealth of Puerto Rico.
• December 8, 2016- Petition to release the vehicle upon bond being posted was filed by plaintiff.
• December 15, 2016- The answer to complaint was filed by the Commonwealth of Puerto Rico.
• December 15, 2016- A motion for transfer of venue was filed by the Commonwealth of Puerto
Rico.
• December 22, 2016- A motion for summary judgment was filed by plaintiff.
• May 3, 2017- A hearing to discuss Motion for Summary Judgment and Motion in Opposition to
Summary Judgment was held.
• May 23, 2017- Notice of Automatic Stay by virtue of Title III of Promesa was filed by the
Commonwealth of Puerto Rico.
• Petition to release the vehicle upon bond being posted has not been granted.
•December 5, 2016- Motion for extension of time (20 days) to file Petition to release
the vehicle upon bond being posted was filed on the last day of the twenty (20) days period after
the filling of the complaint, that the complainant is entitled to post a bond in favor of the
Commonwealth of Puerto Rico before the Clerk of the corresponding Court.
• December 8, 2016- Petition to release the vehicle upon bond being posted was filed by plaintiff.
