WITNESSETH AS FOLLOWS:
WHEREAS, No.1 to 14 are the site owners of Ramaiha Layout which is
been carved out from SY No:335 to an extent of 7 Acre 08 guntas situated at
Attibele Village, AttibeleHobli, Anekal Taluk.
WHEREAS, during the lifetime of Ramaiha S/o Venkatappa, got Khata
transferred to his name for the ancestral property bearing Sy No 335 to an
extent of 5 Acre 38 Guntas excluding karab 1 acre 10 guntas situated at
Attibele Village, Attibele Hobli, Anekal Taluk.
The said Ramaiha S/o Venkatappa had mortaged property bearing Sy
No 335 to an extent of 5 Acre 38 Guntas situated at Attibele Village, Attibele
Hobli, Anekal Taluk to Najundeshwara Dodda Pramanada Cooperative Society
Ltd Attibele. On 30/7/1971.
The said Mortgage was released by Najundeshwara Dodda Pramanada
Cooperative Society Ltd Attibele to Ramaiha S/o Venkatappa On 29/11/1993.

The said Ramaiha S/o Venkatappa and his two sons Viswanath S/o
Ramaiha and Venkatesh S/o Ramaiha had executed Registered GPA for entire
property bearing Sy No 335 to an extent of 5 Acre 38 Guntas situated at
Attibele Village, Attibele Hobli, Anekal Taluk, to one named Choudhary G R S/o
Veeraswami Naidu.
The said Choudhary G R S/o Veeraswami Naidu had executed registered
sale deed to one named Venkateshwarulu S/o Narasimhaulu for entire
property bearing Sy No 335 to an extent of 7 Acre 08 Guntas situated at
Attibele Village, Attibele Hobli, Anekal Taluk,

The said Venkateshwarulu S/o Narasimhaulu had got converted the


above land vide B.Dis ALN (A) 22/1994-95 and formed 132 sites and sold

WHEREAS, there are disputes been pending in respect of the Properties


owned and possessed by all the site owners. The said disputes are pending
before Quasi Judicial Authority, i.e., before the Thasildhar, Assistant
Commissioner and Deputy Commissioner Bangalore.
WHEREAS, No.1 to 14 of us are concerned due to our pre-occupation and
engaged in our day today avocation, we could not able to discharge various
obligations in respect of immovable properties owned and possessed by
family of Parvathappa so also to look after the pending cases before the
Hon’ble Courts and also to attend those cases on all hearing dates as well as in
future cases.

WHEREAS, due to the aforesaid reasons we could not able to attend the
pending cases and also future cases if any as such we thought it fit to appoint
Sri. Shariff, who is the son of Hussain as our lawful attorney to do following
acts, deeds and things which are hereunder.

NOW THIS G.P.A WITNESSETH AS FOLLOWS:

1. To represent us before the Civil Judge Court both Junior and Senior Sub-
Division, Bangalore Rural District in respect of the pending cases and future
cases if any.

2. To represent us before the Assistant Commissioner, South Sub-Division,


Bangalore and also the Deputy Commissioner, Urban district in respect of
pending cases on our behalf so also future cases if any.

3. To sign necessary application/s, affidavit/s, statement/s, joint memo,


written statement, petitions, objections etc., and to swear the affidavits before
the notary or any other authority and to submit the same to the Hon’ble
Courts or any other authority on our behalf.
4. To engage the advocates and to negotiate with the advocates, to give
instructions and to sign Vakalath and all other papers which are required to
conduct the pending cases and future cases if any in fair manner on our behalf.

5. To file the original documents or certified copies to the Hon’ble Courts


in pending cases and future cases so also to take back the said documents on
our behalf.

6. To tender evidence in all the pending cases or future cases by way of


submitting affidavit evidence and to tender for cross examination on our
behalf so also to secure the witnesses and for the purpose of examining the
witnesses before the Hon’ble Courts and to sign necessary papers on our
behalf.

7. To prefer appeals, revision petition/s, writ petition/s, miscellaneous


petition/s etc., arising out of the pending cases or to file any such other fresh
cases before the Hon’ble Civil Judge Courts, Magistrate Courts or before the
Hon’ble District Courts, Hon’ble High Court of Karnataka and to sign such
other papers which are required for the same on our behalf.

8. To sign the affidavits and to swear the affidavits on our behalf either
jointly or individually and to submit the same to the Hon’ble courts in the
pending cases or future cases before the Hon’ble High Court of Karnataka or
other courts at Bangalore Jurisdiction.
9. To file fresh cases in respect of the Properties owned and possessed by
site owners as and when the same are required to file the same and to
prosecute those cases in fair manner on our behalf.

10. To negotiate with the revenue officials for the purpose of getting the
documents Viz., RTC, Mutation, Survey Reports, Phodi order etc., into our
names in respect of immovable properties and also to sign the papers,
documents, applications, affidavits etc., on our behalf.

11. To lodge complaints against the person/s who may going to obstruct the
possession of the lands owned by site owners before the Jurisdictional Police
Station and to take necessary actions against those persons by filing Private
complaints, civil disputes etc., on our behalf.

12. To pay property tax, developmental charges, betterment charges in


respect of the properties owned by above named person to the concerned
authority on our behalf.

13. To negotiate with the opposite parties for the purpose of compromise
and to sign such compromise petition before the Hon’ble Courts, Lok-Adalath
and mediation centre on our behalf and also to sign the compromise petition,
to receive the consideration and to admit the same before the Hon’ble Courts
on our behalf.

14. To develop the properties owned by the family of Late M. Narayanappa


and to look after, manage, alienate the same on our behalf.
15. In the event of any other signatures are required, our attorney is duly
empowered to sign such papers in order to protect and safeguard the lands on
all possible manner without giving any scope for mis-use.

16. To do all any other acts deeds, things which are necessary to protect the
pending cases and future cases so also to prosecute the cases on our behalf in
all possible manner.
17. We hereby ratify and confirm all acts of our attorney as if we have done
it by ourselves.
