the Association with in the jurisdiction of the District
Registrar of Societies, Hyderabad.

Association all Rural and Urban slums of All Districts
in the State of Andhra Pradesh, National
level and international level.

RULES AND REGULATIONS:

The ARSHA BHARATHI SOCIAL WELFARE SOCIETY is a voluntary


organization and established to serve for all the poorest of the poor and their
children irrespective of caste, creed or race in rural and urban slum areas of
all districts in the State of Andhra Pradesh, National & International levels
with the following ideas:-

Article No. 1:

Arts & Fine Arts, Philosophy, Charities, Religion, Education, Science, Sports
& Games, Literature, Political Awareness, Crafts, Rural Development
Women & Child Welfare, Protection of Forests, Wild Life Protection,
Cleanliness, Environment, Yoga, Medicine and Health, Animals Protection
and Developmental Research etc., same Activities mentioned above and other
delightful activities are also taken up for the development.

Article No. 2:

The Rules and Regulations of the ARSHA BHARATHI SOCIAL


WELFARE SOCIETY shall be detailed hereunder: for the present if any
change or changes in them are required, they will be adopted by a majority
vote of Members keeping in view the Registration of the Association under
Act 1 of 1350F. The relevant changes will be intimated to the concernd
authorities with a copy of Act, the same will be exhibited on the Association
Notice Board for ready reference of the Members (section No.12 of the Act
will be followed scrupulously).
Article No. 3: CERTIFICATE

a. Certified that the Association has been formed with no profit motive
though commercial activity is involved in its working.
b. Certified that the Association would not engage in any agitational or
trade union activities to ventilate grivences, and
c. Certified that the office-bearers are not from the funds of the
Association.

Article No. 4: AREA OF OPERATION

A. The ARSHA BHARATHI SOCIAL WELFARE SOCIETY shall be an


organization operating within Hyderabad and other Districts in the
state of Andhra Pradesh, National / Abroad.
B. For the present, the office is functioning at Hyderabad District and as
when the necessity arises the organization can shift its office to any
place and the organization can open new branch offices in any place
within the A.P., National and Abroad. It can merge with any other
Society which has same ideas and intentions.

Article No. 5: MEMBERSHIP

a. Any person (Women / Men) above the age of 21 (Twenty one) years
shall be eligible to become a member of “ARSHA BHARATHI
SOCIAL WELFARE SOCIETY” provided, it should be recommended
by the Executive Body Members of the organization.
b. The membership admission fee is Rs. 25/- (Rupees Twenty Five Only)
and the membership fee is not refundable.

Article No. 6: CLASSES OF MEMBERSHIP

The membership of ARSHA BHARATHI SOCIAL WELFARE SOCIETY


shall be divided in three classes:
(1) Ordinary Member, (2) Life Member, (3) Patron Member.

i. The ordinary member shall pay Rs.25/- (Rupees Twenty Five) towards
admission fee per year and each ordinary member shall pay Rs.100/-
(Rupees one hundred only) towards annual subscription of the
organization.
ii. The life member shall pay Rs.500/- (Rupees Five Hundred Only) per
year towards annual subscription of the organization.
iii. The patron member shall pay Rs.1000/- (Rupees One Thousand Only)
towards annual subscription of the organization.

Article No. 7: HONOURARY MEMBERS & SUBSCRIPTIONS

a. The Governing body of the organization shall have power to appoint


or elect honourary members of the organization for one year period.
b. Any person who has contributed substantially either in money or by
service to the cause of education in the organization.
c. Subscriptions shall be paid yearly in advance and whenever it is paid
same person shall ensure for the official year in which the person
concerned is admitted to the membership of the organization.
d. Subscriptions are payable on or before 31st of March of the year to
which the subscriptions relate in respect of ordinary member alone. If
the subscription is notpaid on or before that 1st of October, a notice
shall be sent to the concerned member and if the arrears are not cleared
by 1st of November, the executive committee shall have power to
cancel the Membership.
e. Every application for membership ordinary, life and patron completing
with the requirements of the Rules and received 7 (Seven) days prior
to the date of the Meeting of the Executive Committee, shall ordinarily
be placed before the Executive committee at meeting for consideration
and executive committee shall be at liberty to admit or reject any
application without assigning any reason.
f. The General Secretary of the organization shall communicate the
admission or rejection to the applicant, and in case of rejection shall
also return the admission fee and advanced subscription received from
the applicant.
g. Any person admitting as life and patron members shall not be under
any obligation to pay any annual subscription.

Article No. 8: RE – ADMISSION

Any person, who has resigned or been removed from the membership, may at
any time be re-admitted at the discretion of the Executive Committee on a
fresh application belong made therefor and on payment of arrears, if any in
full, which is only for the purpose of Rules of election of organization.

Article No. 9: RESIGNATION

A member may resign her/ his membership by a notice in writing addressed


to the Chairman of the organization, provided however, that a resigning
member shall be liable to pay the subscription due for the year in which the
notice of the resignation is received together with arrears of subscriptions if
any.

Article No. 10: REMOVAL OF MEMBER

a. Any member who is in arrears of subscription shall be removed from


the rolls with due notice by the General Secretary. She/ he will
however, be re-admitted only on payment of all arrears due by her/
him.
b. Any member who is of unsound mind, and in the view of the
Executive Committee conducts her/himself in a way which is
prejudicial to the interests of the organization, shall be liable to be
removed by the Executive Committee of the organization.

Article No. 11: MANAGEMENT

a. The affairs of the ARSHA BHARATHI SOCIAL WELFARE


SOCIETY organization shall be controlled and managed by an
Executive Committee consisting of: -
Chairman
Vice Chairman
Executive Director
General Secretary
Joint Secretary
Treasurer
Organizer
Director
Field Executive

And they shall be elected by the General Body of the organization


once in every 6 (six) years. The total strength of the Members of body
are only 9 (Nine).
b. The Members of the Executive Committee shall hold the office
ordinarily for a period of 6 (six) years or until their successors are
elected and assume office on 31st day of March.
c. Three office bearers can be elected from the eligible members who
have the right to vote in their tenure of 6 years.
d. The present Members of the Executive Body as noted in the
Memorandum of Association shall have to remain in office for a
period of 7 (seven) years commencing from 14th December following
the date of Registration of this Association by the District Registrar of
Societies, Hyderabad under the provisions of Registration Act.
Therefore they will have to remain in office for a period of Five years
only, as prescribed in Article No. 8 (b).
e. Retireing Members of the Executive Committee shall be eligible for
re-election.
f. Interim vacancies in the Executive Committee shall be filed by
cooperation from among the existing members.

Article No. 12: POWER OF THE EXECUTIVE COMMITTEE

The Executive Committee is competent to undertake and discharge all the


functions and activities incidental to and for the attainment of the objects of
this organization, setout in the Memorandum of Association.

Article No. 13: FUNCTIONS OF THE EXECUTIVE COMMITTEE

a). The Executive Committee shall have power to purchase vacant site or
sites in Ranga Reddy or its surrounding Districts in the name of ARSHA
BHARATHI SOCIAL WELFARE SOCIETY and on behalf of the
organization to construct a building or buildings in the site or sites for
establishment and run its Institution. or anywhere in India / International
level.
I. To locate the office of the organization with suitable quarters to the
staff members with all modern facilities and amenities.
II. To establish and organize a library with printed or manscript books
with special reference to education development.
III. To provide a rest house and a place for meeting for the use of
Members of the organization / visitors/ Inspecting officers etc.
IV. To construct schools / colleges buildings for residential, non-
residential for vocational certificate course and construct a hall for
conducting the cultural activities.
V. To Construct Buildings for Orphans, sr. citizens, widows, Child
labour, Handicapped, patients and provision for Garden, Hospital etc.
VI. To take up modern agricultural development activities and agricultural
training programmes for the development of poor farmers and weaker
sections.

b). The Executive Committee shall prepare and submit to the General Body
of the organization at such Annual General Body meeting a report on the
work of the organization together with an audited statement of accounts for
the previous proceding year and may make suggestions or
recommendations for consideration of the General Body. The annual report
shall contain a brief review of the progress of education, i.e., by opening
new schools, new activities, taking over the administration of the existing
schools and improvements carried out in the existing schools etc., in the
entire area of operation during the year under report.
c). The Executive Committee shall have power to receive gifts to purchase or
sell, mortgage, lease, exchange or otherwise deal with movable and
immovable properties owned by the organization for the implementation of
the aims and objectives more fully described in the Memorandum of
Association.
d). The Executive committee shall have power to borrow from time to time
for the purpose of the organization and to pledge Government security and
other aspects movable and immovable of the organization as security for
such advances.
e). The Society has right to take up any type of contracts.
f). The Society has right to file the cases in the Court and defend them for the
development of the Society.
g). To arrange tournaments and entertainments periodically.

Article No. 14: ACCOUNTING YEAR

The official year of accounting of this organization shall be from 1st day of
April to 31st day of March of the succeeding year, according to the English
calendar.

Article No. 15: THE GENERAL BODY AND ITS FUNCTIONS

A). The General Body of the “ARSHA BHARATHI SOCIAL WELFARE


SOCIETY” shall meet at least once in every year during the month of
April on 15th in accordance with the English calendar year and this
meeting has:
1. To consider and pass the annual report with the audited statement
of accounts, which will relate to the period from 1st day of April to
31st day of March of the previous year.
2. To consider and also pass the budget estimates for the ensuring
year.
3. To approve the expenditure statement of the previous year.
4. To appoint an auditor for the ensuring year and to fixup his
remuneration.

B). The General body is the supreme body of the organization and normally
all decisions on routine matters will be considered and passed. If majority
of those present at the meeting vote in its favour.
C). The General body have power to appoint (5) sub-committees and
supervise its works.

i. Scholarship sub-committee has to find out the ways and means of


securing funds for scholarships and other aids to intelligent and
deserving students irrespective of the caste or creed to which they
belong and to make recommendations for distribution of the amount so
allotted for the purpose.
ii. Financial sub-committee has to investigate and suggest the various
ways and means for improving the general financial condition of the
organization.
iii. Judiciary committee has to look after the Judiciary aspects of the
society.
iv. Operations committee will recruit professionals for vocational course
Institutions for expanding society.
v. Other sub-committee or adhoc committees or standing committees
may be appointed by the General Body as and when required, to deal
with and report on particular matters connect with the work of the
organization.

Article No. 16: FUNCTIONS AND POWER OF OFFICE BEARES

1. Chairman:-
a. The chairman can be life member and can be exempted from Election.
He / She shall preside all the meetings of the organization and the
meetings of the executive body or Governing body and General body
as well. He /She is the Chief Functioning Authority and contact person
for all purposes of the organization activities.
b. The Chairman may of her/his own accord, and shall on the written
requisition of eight members of the Executive committee, specify the
subject or subjects to be discussed, convene a meeting of the
Governing Body.
c. The chairman may in any emergency, pass temporary orders in
writing, suspending the action taken or orders passed to any of the
office bearer and her/himself take such further action as she/he
consider urgent and necessary and all orders of Governing body for its
consideration and final orders within ten days thereafter.
d. The chairman have power to appoint, punish, suspend or dismiss
servants employed in the conduct of the affairs of the organization,
subject to in case of dismissal only, the right to appeal shall lie by the
dismissed servant to the Governing Body, whose decision will be
final.
e. The chairman have power to spend amount of Rs.10,000/– (Rupees
Ten Thousand Only) for any emergency work of the organization
without prior permission of the Governing Body.
f. He can caste his vote in case of tie.
g. The chairman by using his special power can remove any member who
is harmful and if his activities are against the objectives of the society
or creating damage to the organization.
h. The chairman have power to operate bank account along with General
Secretary (combined only) on behalf of the organization.

2. Vice – Chairman:-
He shall assist the Chairman in discharging his functions in the absence of
the Chairman.
3. Executive Director:-
He is incharge for organizing executive committee / general body
meetings and any other activities as per the decision of the Executive
Committee. He shall look after Social, Cultural, Recreational, Educational
and Health Services for the welfare of members of the Association.
4. General Secretary:-

In the absence of any specified Directors or the Governing Body, the


General secretary shall:-

a. Call for the meetings of the organization and the Governing body.
b. Circulate among the members the items of business to be discussed
at each meeting.
c. Record the proceedings of all the meetings in books to be kept for
the purpose and obtain the signatures of the chairperson of the
meeting.
d. Carry on the correspondence of the organization with the
authorities concerned.
e. Be incharge of the current records of the organization.
f. Be responsible, subject to the control of the Governing body for the
management, funds from the Treasurer.
g. Make all disbursements connected with the organization by
requisitioning necessary receipts.
h. Keep on amount of Rs.1,000/- (Rupees One Thousand Only) with
her/him for any contingent expenses.
i. Prepare the annual report of each year, obtain the approval of the
Governing body there to and submit it to the general body at its
annual meeting together with the audited statement of accounts.
j. Prepare the budget for the ensuing year and after obtaining the
approval of the Governing body, place it for sanction of the General
Body.

5. Joint Secretary:-
He shall do the work entrusted by Executive Committee. Also he shall
assist and discharge the General Secretary's duties and functions in his
absence.

6. Treasurer:-
a. The Treasurer shall have power to collect membership fee,
subscriptions, donations, rents and such other moneys as may be,
due to the organization and deposit the same in the Bank Account
of the organization.
b. Keep accounts of income and expenditure and place them before
the Governing body at its meeting.
c. Make all disbursements only through the chairman of the
organization.
d. Maintain all vouchers properly prepared and signed, supported by
the sanction and by the counter – signature of the chairman.
e. Obtain the services of the servants of organization under the orders
of chairman in the transactions of the organization affairs.
f. Be responsible for the expenditure incurred with all money and
maintain accounts and other documents connected therewith.
g. The treasurer shall after obtaining the authorization of the
Governing body, open a current or savings account in the name of
the organization in a scheduled bank having its office, and entitled
to operate the same provided that the amount shall be withdrawn
from the bank by cheque or otherwise and such cheques or other
instruments of withdrawal be either in favour of chairman or the
Treasurer / General Secretary.
h. The Treasurer has to invest funds of the organization in fixed
deposits or saving deposits in the Bank as decided by the
Governing Body from time to time.

7. Organizer:-
He shall organise the meetings and assist the General Secretary within the
functions of General Body or any other meetings.
8. Director:-
He is overall incharge for the five sub-committees and ensure the
functioning of the sub-committees and report its progress to the
Chairman from time to time.
9. Field Executive:- Carryout the directions of the chairman from time to
time and Inspect the spots where development works undergoing and
report the progress to Chairman.

Article No. 17: REGISTERS, MAINTENANCE, ETC.,

The “ARSHA BHARATHI SOCIAL WELFARE SOCIETY” has to maintain


all the registers and records necessary to enable the members to know at a
glance the present stage of the activities and the amount collected for various
works and Members present on rolls under each category.

Article No. 18: FUNDS AND THEIR UTILISATION

1. The funds of the organization would be invested as per section II (5) of the
Income Tax Act.1961.
2. The accounts would be maintained regularly and would be audited by a
Chartered Accountant as per explanation to Sec. 228(2).
a. The income and the property of the organization derived from
whatever source shall always be applied towards the promoting of
the objects of the organization and no portion thereof shall be paid
or utilized directly or indirectly for the purpose of any individual,
bonus or otherwise who-so-ever by way of profit to the members of
the organization, provided that nothing therein contained shall
prevent the payment of money in good faith, remuneration to any
employee or servant of the organization or to any other person in
return for the services actually rendered, shall be appointed to any
fee except repayment of the expenses incurred by her/him for the
work of the organization.
b. The executive committee shall work gratiously, the committee may
debit to the organization account any expenditure actually incurred
by them in doing the work of the organization in the manner
indicated below.

i. Postal charges supported by proper vouchers and correspondence.


ii. The traveling expenses of members of the executive committee for
journey made by them in connection with the work.
iii. Contribution to institution engaged in rural uplift and social uplift
activities or works within the limits sanctioned by the General body
for each year or any special or specified occasion:
iv. Establishment charges of permanent or temporary, charges
sanctioned by the General Body.
v. House rent, furniture, cost of samean, stationery, electricity charges
and other defined charges within the annual budget allotment
sanctioned for each year by the General Body.
vi. The Executive committee shall not incur any other items of
expenditure than those specified above without the previous
sanction of the General Body of the organization.

3. The institution / organization is irrevocable


4. The funds of the organization would be utilized only towards the objects
and no portion of it would be distributed in any manner to the Trustees or
persons defined in section 13(1) of the Income Tax Act 1961.
5. In the case of winding up dissolution, the net funds would be transferred
to institution having similar objects and enjoying exemption under section
II & 80 G of the Income Tax Act, 1961.
6. The benefit of objects would be available to the general public irrespective
of caste, creed, religion or sex:
7. Any amendment to the instrument would be carried out only with the
approval of the Commissioner of Income Tax Department.
8. The activities would be confined to the Territory of India & Abroad.
9. The activities would be purely religious / non-religious in nature, not
motivated for profit.
10.Not more than 5% of the Income of the organization would be applied for
any religious purpose or given to religious institutions. If necessary,
organization will spend more funds with prior approval of Society by a
Resolution.

Article No. 19: QUORUM FOR THE MEETING


a. ANNUAL GENERAL BODY MEETING:
The annual General Body meeting of the organization shall be held on
15th day of April in every year and the quorum for the General Body
shall be 2/3rd of the Members on rolls. Exactly persons present
personally and also entitled to vote, whichever is less.
b. EXECUTIVE BODY MEETING:
The Executive Body shall consist of not less than 9 (Nine) members.
The quorum of the Executive Body shall be 2/3rd of the members on
rolls.

Article No. 20: ELECTIONS

The final electoral roll shall be prepared and published on the Notice Board
of the organization 15 (fifteen) days before the actual date of nomination
filing. The preparation and the publication under this rule shall made by the
chairman with the help of the General secretary.

i. No member shall be entitled to vote unless her/his name appears in the


final electoral roll of the organization prepared for the purpose.
ii. Incase of contest, election of the office – bearers and other members of
the Executive Committee shall by ballot from among the candidates
nominated at the meeting for election. Chairman can caste his vote in
case of tie.
iii. After the close of the polling, the results shall be announced either on
the same day or at any time or other time as may be fixed by the
Returning Officer and the persons elected will have to take office on
30th September without fail.

Article No. 21: DISPUTES

If any dispute arises in the Society, it has to be solved internally. If the


dispute not solved internally, the Chairman / President has to take initiative
and solve the dispute with the majority Members' opinion. But the dispute
should not be taken to the court under any circumstances.

Article No. 22: APPLICATON OF RULES

These rules shall come into force with immediate effect and shall apply to all
office bearers and members of executive committee elected from the date of
their election in the year

Article No. 23: INDEMNITY

Each of the member of the organization shall stand always indemnified in


respect of all the financial transactions entered into by them jointly or
severally as authorized by the executive committee, for and on behalf of the
organization with any individual bank, firm or corporation or institution or
other authority, against all claims, losses and damages incurred by the said
member, provided that such indemnification shall be from and out of the
movable and immovable assets belonging to and possessed by or managed by
the organization.

Article No. 24: GENERAL

i. The procedure and the provisions laid down in the Societies


Registration Act, shall apply in all matters not specifically and
expressly adopted and provided for these rules.
ii. Should any doubt arises as to the constitution of or construction of
Rule or Rules, the committee shall refer the same to the Registrar of
Societies, Hyderabad for his instructions and act according to his
directions.
iii. The organization may invite the Departmental officers of
Governments, specially the Education department of the district and
the State and also other officers of other States whenever they happen
to visit our office, in connection with their routine tours and they may
also be requested to attend the meetings and suggestions in
implementing all or any of the objects specified in the Memorandum
of Association.

Article No. 25: COMPLAINTS

Any complaint or suggestion which any member desires to make, may be


entered by her/him in the book kept for the purpose in the premises of the
organization. All such complaints and suggestions shall be considered by the
committee and the committees decision may be communicated to the
individual member concerned. However, any matter involving major
questions, shall be referred to the General Body.

Article No. 26: AMENDMENTS

No amendments or alternations shall be made in the Rules of this


organization unless it is voted by 3/5th of the members present at a General
Meeting convened for the purpose and confirmed by 3/5th of the members
present at the second special meetings as provided for under the Societies
Registration Act 1 of 1350F. The Bye-laws can be modified for the purpose
of Indian National Integration, security and secularism. The existing society
will be upgraded in future as a Charitable Trust.

Article No. 27: WINDING UP PROCEDURE


In case the organization decides to windup its activities and funds of the
organization that will remain after the full satisfaction, the liabilities of the
organization will be transferred or paid to some other institutions with similar
aims and objectives only. This will have to be determined by the votes of
3/5th of members of the organization present personally or by proxy at the
time of the dissolution of the organization. The detailed instructions on the
subject contained in relevant sections of the Societies Registration Act will be
scrupulously followed.
