yxþT×eà yMRÅ HG ELECTORAL LAW OF ETHIOPIA

yxþT×eà B¼¤R B¼¤rsïC HZïC b¥N WHEREAS, it has become necessary to enable the
¾WM hùn¤¬ L†nT úYdrGÆcW bq_¬ X nations, nationalities and peoples of Ethiopia to
bnÉnT bmrÈ*cW twµ×C x¥µŸnT ‰úcWN exercise their right to self administration without any
discrimination through their representatives elected in a
b‰úcW y¥StÄdR SLÈÂcWN btGÆR §Y
direct and free election;
¥êL xSf§gþ bmçnù፤
WHEREAS, it has become necessary that any
¥N¾WM yMRÅ XNQSÝs¤ ›lMxqF yM electoral activity shall be guided by an electoral law
RÅ mRçãCN xµTè bÃz HG XNÄþm‰ ¥D that meets international standards;

WHEREAS, it has become necessary to establish an
¥N¾WM xþT×eÃêE z¤U bydr©W b¸µ electoral institution that conducts free, fair and
ÿÇ hùlùxqF bXkùLnT §Y ytmsrt b¸S peaceful elections at every level in an impartial manner
«þR DMI xsÈ_ fÝÇN bnÉnT y¸gLIbT in which Ethiopians freely express their will on the
nÉ# FT¦êE s§¥êE MRÅ# bgLtŸnT y¸ÃS basis of equal popular suffrage and secret ballot
fIM tÌM ¥ÌÌM xSf§gþ bmçnù፤ system;

ytlÃy xmlµkT çcW y±ltEµ DRJ WHEREAS, it has become necessary to establish an
èC y¸útûbT X x§¥cWN bs§¥êE HUêE electoral system that enables political parties with different
mNgD lm‰Œ HZB y¸gL{ùbT m‰Œ HZB views to participate in the election and introduce their
bmr© §Y bmmSrT fÝÇN bnÉnT bmGlI objectives to the electorate in a peaceful and legal manner,
and that enables the people to elect their representatives
wkþlÖcÜN y¸mR_bT yMRÅ SRxT mzRUT based on informed decisions and free expression of their will;

WHEREAS, it has become necessary to put in place
bMRÅW tú¬ð yçnù y±ltEµ DRJèCM an instrument that enables political parties and
çnù yGL :ŒãC lFT¦êE# s§¥êE# nÉ ÄþäK independent candidates running for elections to play a
‰sþÃêE yMRÅ SRxT mSfN gNbþ xStêAå constructive role in ensuring fair, peaceful, free and
y¸ÃdRgùbT GLI xs‰R mzRUT xSf§gþ democratic elections;

system of looking into complaints and appeals;

NOW, THEREFORE, in accordance with Article
55 (1) and Article 102 of the Constitution of the

KFL xND GENERAL PROVISIONS

with the constitltions of the FDRE and Regional
mNGS¬T XNÄþhùM bl¤lÖC xGÆB constitutions and other relevant laws;

MRÅ nW”” 5/ “General elections” means elections to the
House of Peoples’ Representatives and

Regional State councils conducted in

accordance with relevant laws;

6/ |yxµÆbþ MRÅ´ ¥lT xGÆB ÆlW 6/ “Local elections” means elections to Zonal,
HG msrT y¸µÿD yøN# ywrÄ# Woreda, City, Municipality, Sub City or Kebele
ykt¥# y¥zU© b¤T# yKFl kt¥ councils conducted in accordance with relevant

7/ “By-elections” means elections conducted to fill

wYM b¥N¾WM MKNÃT bydr©W terminated due to recall or any other reason;

ïRÇ DU¸ MRÅ XNÄþµÿD sþwSN upon the decision of the Board in accordance
wYM XŒ twÄĶãC XkùL DMI with this Proclamation or where candidates get
b¥G߬cW MKNÃT x¹ÂðWN ml equal votes and becomes impossible to
yT b¥YÒLbT gþz¤ y¸µÿD MRÅ determine the winner;

9/ |HZb Wún¤´ ¥lT bxþ.Ø.Äþ.¶. Hgm 9/ “Referendum” means a system of voting
NGST msrT sþwsN yHZB F§¯TN conducted when decided in accordance with the
lmlµT XÂ yHZBN Wún¤ l¥wQ Constitution of the FDRE to assess public
DMI y¸s_bT SR›T nW”” interest and to know the decision of the public.

l¸µÿD MRÅ m‰Œ HZB bMRÅ are registered at polling stations as electors for
ÈbþÃW bm‰unT y¸mzgBbT elections conducted at every levels;

11/ “Elector’s Identification Card” means an
01/ |ym‰ôC MZgÆ m¬wqEÃ µRD´ ¥lT identification card issued to an elector upon
xND sW bm‰unT ktmzgb bº§ bM registration at polling stations;

12/ “Political Organization or Political Party” means
02/ |y±ltEµ DRJT wYM y±ltEµ ­RtE´
¥lT y±ltEµ PéG‰ÑN bHUêE mNgD a grouping legally registered to promote its
l¥‰mD bHG tmZGï y¸NqúqS bùDN political programme in a lawful manner;

13/ “Constituency” means an electoral district
03/ |yMRÅ KLL´ ¥lT lMRÅ xfÉ{M established by dividing the nation’s territories
XNÄþÃmC XÂ HZbù wkþlÖcÜN in accordance with the law and in a manner
XNÄþmR_ bHG msrT yhg¶tÜ G²T conducive for the execution of elections and for
tkÍFlÖ y¸d‰J yMRÅ xµÆbþ the people to elect their representatives;

14/ “Polling station” means a location where voter

ÿÇ MRÅãC MZgÆ y¸µÿDbT# for elections conducted at every levels;

15/ “Observer” includes both local and foreign

16/ “Local election observer” means a legally registered
06/ |yhgR WS_ yMRÅ ¬²bþ´ ¥lT bHG and independent domestic organization that in
ytmzgb XÂ l¥NM ÃLwgn glLt¾ accordance with the license given to it by the Board
hgR bqL DRJT çñ kïRÇ b¸s«W observes elections by assigning its representatives;

17/ “Foreign election observer” means governments or

b§ÒcW SMMnèC m¿rT wYM mNG organizations, or governmental and non-
ST xSf§gþ çñ sþÃgßW MRÅN XNÄþ governmental agencies operating in or out of the
¬zbù y¸UB²cW mNGS¬T wYM ›l country invited to observe election in accordance
MxqF# xHgù‰êE# KflxHgù‰êE yçnù bh with international law to which a country is a party
gR WS_M çn khgR WÀ y¸Nqúqsù or upon the invitation of the Government where
mNGS¬êE wYM mNGS¬êE ÃLçnù DR necessary.

MRÅ KLL XÂ MRÅ ÈbþÃ MRÅN of each constituency or polling station elected
XNÄþ¬zbù bHZB y¸mr«ù glLt¾ by the people to observe elections;
yxµÆbþ nê¶ ãC ÂcW””

09/ |tq¥u wkþL´ ¥lT bMRÅ 19/ “On site representative” means a person
lmwÄdR btmzgb y±ltEµ DRJT represented by a political party or private
wYM yGL XŒ y¸wkL bMRÅ candidate running for election to a specific
KLLÂ bMRÅ ÈbþÃ tqMõ yMRÅ constituency or polling station and observe the
£dTNÂ ywklWN xµL mBT election process on site and follow the respect
mkbRN y¸k¬tL sW nW”” of the rights of the body he represents;

@/ |tNqúÝ> wkþL´ ¥lT bMRÅ lmwዳ 20/ “Mobile Observer” means a person represented
dR btmzgb y±ltEµ DRJT wYM by a political party or candidate running for
bGL XŒ twKlÖ bxND MRÅ KLL election and observes the election process and
WS_ b¸gßù yMRÅ ÈbþÃãC XytNq follows the respect of the rights of the body he
úqs yMRÅ £dTNÂ ywklWN DRJT
represents by moving to different polling
wYM yGL XŒ mBT mkbR y¸k¬
tL sW nW”” stations in a constituency;

@1/ |xb¤tܬ s¸ ÷¸t½´ ¥lT bydr©W 21/ “Grievance Hearing Committee” means a
b¸gŸ bKLL QRNÅF AHfT b¤T# committee established in accordance with this
MRÅ KLL XÂ yMRÅ ÈbþÃ l¸nsù Proclamation during elections to give
QʬãC xStÄd‰êE Wún¤ y¸s_ administrative decisions to complaints lodged
at a regional electoral office, a constituency and
bzþH xêJ msrT lMRÅ wQT
a polling station level;

‰êE MRÅ ïRD AHfT b¤T nW”” Electoral Board of Ethiopia;

ysWnT mBT yts«W xµL nW”” 23/ “Person” means any natural or juridical person.

3. Scope of Application
YH xêJ l«Q§§ MRÅ XNÄþhùM XNÄ
This Proclamation shall be applicable to general
GÆBntÜ lxµÆbþ MRÅ# l¥àà MRÅ# elections and as appropriate to local elections, by-
lDU¸ MRÅ XÂ bHgmNGStÜ msrT elections, reelections and referendums carried out in
l¸µÿD HZb Wún¤ tfɸ YçÂL”” accordance with the Constitution.

PART TWO
KFL hùlT THE NATIONAL ELECTORAL
SlMRÅ ïRD b«Q§§ BOARDGENERAL
M:‰F xND Chapter One
SlMRÅ ïRD The National Electoral Board

1/ The National Electoral Board of Ethiopia
1/ t«¶ntÜ lxþØÄþ¶ yHZB twµ×C MKR (hereinafter referred to as “the Board”)
b¤T yçn B¼¤‰êE MRÅ ïRD /kzþH accountable to the FDRE House of Peoples’
bº§ |ïRD´/ XytÆl y¸«‰ yHG Representatives is hereby established as an
sWnT ÃlW k¥N¾WM tI:ñ nÉ independent and autonomous organ for
yçn X‰sùN yÒl yMRÅ xSfɸ conducting elections having its own legal
xµL bzþH xêJ tÌqÜàL”” personality.

2/ yïRÇ ê AHfT b¤T xÄþS xbÆ 2/ The Head Office of the Board shall be in Addis
YçÂL”” ïRÇ yMRÅN S‰ l¥Sf{M Ababa. For the purpose of conducting elections,
kØÁ‰L XSk MRÅ Èbþà mêQ„N the Board shall have permanent and temporary
bmzRUT ̸ X gþz¤ÃêE QRNÅF branch offices from federal down to polling
AHfT b¤èC Yñ„¬L”” station level.

5. ›§¥ 5. Objectives

ïRÇ y¸ktlùT ›§¥ãC Yñ„¬L”” The Board shall have the following objectives:

1/ HgmNGStÜN msrT b¥DrG nÉ# 1/ ensure the establishment of a government


glLt¾Â FT¦êE MRÅ b¥µÿD bH elected through a fair, impartial and fair
ZB DMI ytmr« mNGST XNÄþÌ election conducted in accordance with the
Constitution;

¥TN y¸ÃkB„ y±ltEµ DRJèC 2/ ensure the existence of an electoral system that
XÂ GlsïC bXkùLnTÂ ÃlxDLã enables political parties and private candidates
y¸wÄd„bT yMRÅ £dT mñ„N that respect the Constitution and institutions
¥rUg_# established by it compete equally and
impartially;
3/ z¤¯C bHgmNGStÜ bt¯Â{ûT yÁä
K‰sþ btlYM dGä ymMr_Â 3/ enable citizens to exercise their constitutional
ymmr_ mBT bnÉnTÂ bXkùLnT democratic rights to elect and be elected.

6. yïRD xƧT 6. Members of the Board

1/ The Board shall have nine members appointed in

b«Q§Y ¸nþST„ xQ‰bþnT bHZB the House of Peoples’ Representatives upon
twµ×C MKR b¤T y¸ëÑ z«Ÿ recommendation by the Prime Minister.

2/ The prime Minister shall, before nominating
2/ «Q§Y ¸nþST„ mSfRtÜN y¸Ãàlù Board members who fulfill the criteria, ensure
sãCN lïRD xÆLnT lMKR b¤T that there has been sufficient consultation
k¥Qrbù bðT bMKR b¤tÜ mqmÅ forum for political organizations that have seats
çcW l¤lÖC y±ltEµ DRJèC XŒ in the House of Peoples’ Representatives to
lþçnù y¸Clù GlsïC nÉÂ glLt¾ ascertain that the nominees are independent and
mçÂcWN b¥rUg_ gùÄY §Y impartial.
túTæ XNÄþñ‰cW y¸ÃSCL bqE
yMKKR mDrK XNÄþñR ÃdRUL””
3/ The composition of Board members shall take
3/ yïRÇ xƧT _NQR B¼¤‰êE têIåN into consideration national contribution, and
X ys¤èCN túTæ kGMT WS_ gender representation, and at least one member
ÃSgÆ çñ kxƧtÜ mµkL bþÃNS of the Board shall be a lawyer. The members
xNÇ yHG Æläà mçN xlbT”” shall:

h. lHgmNGStÜ ¬¥Ÿ yçnù# a) be loyal to the Constitution;

l. k±ltEµ DRJèC wgNtŸnT nÉ b) be non-partisans;

m. bmLµM SnMGƉcW y¸¬wqÜ d) be known for their good conduct.

4/ yïRÇ xƧT yS‰ zmN xMST xmT 4/ The term of office of the Board members shall
çñ ¥N¾WM yïRD xÆL lt=¥¶ be five years. However, a Board member may
xND yS‰ zmN BÒ bDU¸ serve for only one additional term.

5/ k§Y bNxùS xNqI 4 ytdnggW 5/ Without prejudice to sub article (4) of this Article, the
House of Peoples’ Representatives may terminate the
bþñRM xÆlù b‰sù MKNÃT klqq
term of a Board member if he resigns for personal
wYM yHZB twµ×C MKR b¤T reasons or if the House of Peoples’ Representatives
xND yïRD xÆL believes that

h/ bHmM MKNÃT tGÆ„N btgbþW a) the Board member is unable to properly


hùn¤¬ ¥kÂwN xYCLM wYM carry out his duties due to illness;

l/ kÆD ySnMGÆR gùDlT ¬Yèb¬L b) the Board member has committed


BlÖ sþÃMN kïRD xÆLnT serious misconduct.
lþÃsÂBtW YC§L””

6/ MKR b¤tÜ k§Y bNxùS xNqI 5 ytd 6/ The House of Peoples’ Representatives shall, upon
nggWN Wún¤ sþÃSt§LF bHgmNGStÜ making decision in accordance with sub article (5)
above, give instruction to the prime minister to
msrT «Q§Y ¸nþST„ l¤§ XŒ
recommend another nominee in accordance with the
XNÄþÃqRB òL”” Constitution.
7/ yïRÇ sBúbþ XÂ MKTL sBúbþ 7/ The Chairman and Deputy Chairman of the Board
kxƧtÜ mµkL b«Q§Y ¸nþST„ shall be appointed by the House of Peoples’
xQ‰bþnT bHZB twµ×C MKR b¤T Representatives from among the members upon the
Ysy¥lù”” recommendation of the Prime Minister.

8/ yïRÇ AHfT b¤T ê `§ð DMI ym 8/ The Chief Executive of the Secretariat of the
S«T mBT úYñrW yïRÇ {¼ð Board shall be a non-voting member and

7. yïRÇ SLÈNÂ tGÆR 7. Powers and Duties of the Board

ïRÇy¸ktlùT SLÈN tGƉT Yñ„¬L\ The Board shall have the following powers and duties:

1/ bHgmNGStÜ XÂ bzþH xêJ msrT 1/ execute impartially any election and referendum
y¸µÿD ¥N¾WNM MRÅ X HZb conducted in accordance with the Constitution
Wún¤ bglLtŸnT y¥Sf{M# and this Proclamation;

2/ bydr©W X bygþz¤W y¸µÿÇ MRÅãC 2/ facilitate and ascertain that elections held
nÉ FT¦êE bçn mNgD y¸µÿÇbTN periodically and at every level are conducted in
hùn¤¬ y¥mÒcT X y¥rUg_# a free and fair manner;

3/ MRÅN l¥Sf{M y¸ÃSfLgù snìC 3/ prepare and distribute documents and materials
qÜúqÜîC y¥zUjTÂ y¥s‰=T# necessary for conducting elections;
4/ MRÅN xSmLKè lHZbù ySnz¤UÂ ym 4/ widely provide to the public civic and voter
‰ôC TMHRT bSÍT ymS«T XÂ education relating to elections, issue license to
TMHRT l¸s«ù xµ§T fÝD ymS«T#
other bodies engaged in civic and voter
ymk¬tLÂ ymöÈ«R#
education, follow and supervise their activities;
5/ lMRÅ ¬²bþãC fÝD ymS«T#
ymk¬tLÂ ymöÈ«R# 5/ issue licenses to election observers and follow
and supervise their activities;
6/ y±ltEµ DRJèCN ymmZgB# fÝD
ymS«T\ bHgù msrT ymk¬tL 6/ register and issue license to political parties,

with the law;

1/ bKLL dr© MRÅ y¸ÃStÆBR QRN 1/ There shall be an election coordinating


ÅF AHfT b¤T YÌÌ¥L”” branch office at Regional State level.

2/ yïRÇ AHfT b¤T yQRNÅF AHfT 2/ The Secretariat of the Board shall, among
b¤tÜN `§ð l¤lÖC s‰t®CN yÑà residents of the Regional State who are
BÝT µ§cW glLt¾ kçnù yKLlù competent and non-partisan, recruit the head
nê¶ãC mµkL xwÄDé Yq_‰L”” of the branch office and other staff.

3/ ïRÇ yKLlÖC SÍTÂ ym‰ôCN B²T 3/ The Board, in consideration of the size of the
msrT b¥DrG lKLL QRNÅF AH Regional States and the number of voters,
fT b¤èC t«¶ yçnù ¥StÆb¶Ã AH may establish permanent or provisional
fT b¤èC b̸nT wYM bgþz¤ÃêEnT coordinating offices that are accountable to
lþÃÌqÜM YC§L”” y¥StÆb¶Ã AHfT Regional State Branch Offices. The duties
b¤èC tGÆR# h§ðnT xs‰R ïRÇ and responsibilities of the coordinating
b¸ÃwÈW dNB YwsÂL”” offices shall be determined by the regulation
to be issued by the Board.

09. yïRÇ yKLL QRNÅF AHfT b¤T tGÆ 19. Powers and Duties of Regional Branch Offices

XÃNÄNÇ yïRÇ yKLL QRNÅF AHfT Each Regional Branch Office of the Board shall

measure against the person.

yMRÅ AHfT b¤èC `§ðãC YçÂL”” 4/ The responsibility of ensuring the security of
yMRÅ IhfT b¤èC `§ðãC wYM yMRÅ polling stations rests on the chief electoral
Èbþà yHZB ¬²bþ xµ§T yÈbþÃWN dHNnT officers. Where the chief electoral officers or
l¥SkbR y±lþS `YL XNd¸ÃSfLG µmnù public observers of the polling station believe
XNÄþmdB§cW y¸mlktWN xµL m«yQ that a police force is needed to defend the
YC§lù”” çñM yHZB ¬²bþãC _Ãq½ÃcWN security of the polling station, they may make
y¸ÃqRbùT bMRÅ AHfT b¤èC `§ðãC a request to the concerned body. However,
x¥µYnT YçÂL”” public observers shall present their request
through the chief electoral officers.

WS_ mGÆT yl¤lbTN sW wYM 5/ The chief electoral officer may order the expulsion
yMRÅWN XNQSÝs¤ l¥wK yäkrN of a person who should not be present in the
¥N¾WM sW kMRÅ ÈbþÃW XNÄþwÈ polling station or has attempted to disturb the
lþÃZ YC§L”” YHN T:²Z çkbr sW electoral process. Where the person disobeyed the
µl y±lþS hYL «Rè kMRÅ ÈbþÃW order, the chief electoral officer may call upon a
policeman to take the person out of the polling

6/ ¥N¾WM Hgw_ snD Yø bMRÅ ÈbþÃ 6/ The chief electoral officer, acting upon

yMRÅ ÈbþÃW `§ð yhùlùM y±ltEµ allegedly possesses unlawful documents in a
DRJT X yGL XŒ wkþlÖC XNÄþhùM polling station in the presence of all
yHZB ¬²bþãC btgßùbT t«RȶWN representatives of political organizations and
lþfT> YC§L”” t=Æu çñ ktgßM private candidates. The chief electoral
xSf§gþW HUêE XRM© XNÄþwsD officer may order taking necessary legal
ÃdRUL ”” action against the person if the information
turns out to be true.
