Mongol Nation, an Unincorporated Association. Defendant filed an MIL to exclude
testimony or evidence of guilty pleas entered by alleged co-conspirators in United
States v. Cavazos (CR 08-1201). Defendant asks that the Court preclude such evidence
on the grounds that it violates the Confrontation Clause. The government stated that it
does not intend to offer plea agreements entered in Cavazos unless the individual who
entered into a plea agreement is called as a witness and either refuses to testify or
offers testimony inconsistent with the admissions made in the agreement."
Approximately37 members of Mongol Nation entered guilty pleas. Currently, the
government has indicated that three of those individuals will testify. The Court needs
sufficient time to transport inmates if necessary. Therefore, before issuing its final
ruling, the Court instructs the parties to submit additional briefing addressing both
scenarios: if the government offers guilty pleas of non-testifying individuals and if the
government offers guilty pleas of testifying individuals. This briefing must be

(IN CHAMBERS) ORDER DENYING DEFENDANT'S MOTION TO CORRECT

DOCKET ENTRY 96 (Dkt. 97 ) by Judge John A. Kronstadt: The Court has received
the Defendant's Motion to Correct Docket Entry 96 (the "Motion") where Defendant
seeks to correct or strike docket text relating to the apparent association of Mr. Al
Cavazos with Defendant. On June 9, 2015, the Clerk received a letter from Mr.
Cavazos, which was entered on the docket through the CM/ECF System (the "Letter").
Because, due to administrative processes, each document filed through the CM/ECF
System must associate the document with a party/filer, the Letter was associated with
Defendant rather than the Government. Although Mr. Cavazos was a former member
of Defendant (Mot., Dkt. 97 at 2), notwithstanding the procedurally based docket entry
discussed above, the Court takes no position and makes no determination whether this
Letter or its author should be deemed to be, or is in any way, associated with
Defendant. Further, because the Letter contained what appeared to be certain
privileged information and it was unknown at the time of its filing how Mr. Cavazos
might be associated with this action, the Letter was sealed and treated as an in camera
submission. Accordingly, the Letter has not been provided to the public, the
Government, or Defendant. In light of the foregoing, the Court DENIES the Motion.
Further, Defendant is advised that, in the future, all motions shall comply with L.R.
6-1. In certain circumstances, it is appropriate to present an issue to the Court through
a stipulation and a corresponding proposed order. On other occasions, an application
for ex parte relief may be made. Therefore, any documents that are filed in the future
