(OF EMILY D. BOTOR)

That I, EMILY D. BOTOR, of legal age, single, Filipino citizen and a

resident of Purok 10, Dontogan Barangay, Baguio City, Philippines, after being
duly sworn, hereby depose and state that:

PRELIMINARY STATEMENT
The person examining me is PrivatePros. Leonard K .Andananwith
office address at Suite 245, 3rd Floor, La Azotea Bldg. Session Rd., Baguio
City. The examination is being held at the same address. I am answering his
questions fully conscious that I do so under oath and may face criminal liability
for false testimony and perjury. Questions were propounded to me in English
of which I am knowledgeable and conversant and the answers were also give in
English.

PURPOSE: The testimony of EMILY D. BOTORis being offered for the

following purposes:

1. To prove material allegations contained in the Information.

2. To testify as to the incidents which led to the filing of this case;
3. To identify the pertinent document/s in relation to this case; and
4. To testify as to other related matters.

1. Q: Please state your name, age and other personal circumstances for the
record.
A: I am EMILY D. BOTOR, of legal age, single, Filipino citizen and a resident
of Purok 10, Dontogan Barangay, Baguio City.

2. Q: In relation to this case, do you remember any important document/s?

A: Yes, Sir.

3. Q: What is this document/s?

A: A receipt Sir.

4. Q: Are there any other documents that you’re aware of?

A: None sir.

5. Q: So, you said there is a receipt. Is it a handwritten receipt or a printed

receipt?
A: It is a handwritten receipt Sir.

6. Q: Who executed this receipt?

A: It was executed by Amy Dogui-is and Evelyn Julian Sir.

7. Q: For whom was it executed for? And to whom was it given?

A: To Lolita S. Bornales Sir.

8. Q: Why did Amy Dogui-is and Evelyn Julian execute this receipt?
A: It serves as an evidence of their agreement Sir.

9. Q: Let’s be clear. You used the word “their”. Who are you referring to?
A: Sir, I was referring to Amy Dogui-is, Evelyn Julian, and Lolita S. Bornales.

10. Q: Madame witness, who are these people? Are they your friends?
A: No, Sir. They are my fellow residents at Purok 10, Dontogan Barangay,
Green Valley, Baguio City.

11. Q: Do you know other information about them?

A: Yes, Sir. Amy Dogui-is used to be our purok leader at Purok 10 in
Dontogan Barangay, Green Valley. Evelyn Julian is her friend. And Lolita S.
Bornales is a widow who bought the land from them

12. Q: Earlier, you mentioned the word agreement. What was this agreement all
about?
A: Sir, it’s about the sale.

13. Q: What sale?

A: It’s a sale of a lot.

14. Q: Who owns this lot?

A: Amy Dogui-is and Evelyn Julian Sir.

15. Q: Who bought the lot?

A: Lolita S. Bornales Sir.

16. Q: Why do you have knowledge about their transaction?

A: Sir, because I was the witness who signed on the receipt.

17. Q: Who asked you to participate and be a witness?

A: Lolita S. Bornales Sir. Because I went with when she checked the lot.

18. Q: Were you accompanied by other persons?

A: Yes. Sir. Amy Dugui-is joined us.

19. Q: Anyone else Madame witness?

A: Amy Dugui-is called Evelyn Julian Sir.

20. Q: What did the four of you do there?

A: Amy Dugui-is and Evelyn Julian prepared the receipt. Lolita S. Bornales
paid the amount of Thirty Thousand Pesos (₱ 30, 000. 00); and we all signed
the receipt.

21. Q: What else did you do there?

A: Amy Dogui-is and Evelyn Julian pointed and showed to Lolita S.
Bornales the lot Sir.

22. Q: Lastly, do you have something to add in this testimony?

A: None as of now.
