to amend the Assam Education (Provincialisation of Services of Teaihers

and Re-Organisation of Educational Institutions) Act, 20 I 7.

Preamble Wtrersas it is expedient to amend the Assanr Education Assam

(Provincialisation of Servicss of Teachers and Re-Organisation of Act No.
Educational lnstitutions) Act, 2017, hereinafter referred to zui rhe principal XXV $I'

It is hereby enacted in the Sixty-ninth Year ofthe Republic of India as

Shoc title, extent l. (l) This Acr may be called the Assam Education (Frovincialisation
and of Services of Teachers and Re-Organisation of Educational
c(}mmencement Irutitutions) (Amendment) Act, 201 E.

Q) It shall hava the like extent as the principal Act.

(3) It shall come into force at once.

Amendment of 2. In the princrpal Acg in $ection 2, for clause (w), thc following
Section 2 shall be substituted, namely:-

"(w)"Venture Degree College" lneans a Degree College

imparting education beyond Higher Secondary stage established
by the people of the locality prior to 1.I.2006 and which has also
rceeived affilirtion from the concerned Universiry, concurneooe
from the State Governmsnt on or before 0I.0t.2006 atleast for
TDC Part-l and whereof the services of teaehers have not been
provincialised under any Act csactpd by the Stste tegislature so
far;"
Amendment of 3. ln the principal Act, in Section 3, in sub-section(l), for the
Section 3 existing clauses (i), (vii) and (ix), the following shall b€
substituted rcspcctively, namely:-
"(i) The Vcnture Educational Institutions which have been
established and had obtained the required permission, recognition,

affiliation, concrurence, as the case may be, required for the

concemed institution from the respective competent Authorily or

Authorities on or before 0l-01-2006:

Pmvided that 0rc permission for l{ year HS clauses in

rcspcct of Higher Secondary School, concunence for l" year HS
classes in respcct ol Senior Secondary School (erstwhile Junior
College), recognition liom Board ol'Secondary Education, Assam
for class-IX in respect of High School, concuncnce for TDC Prt-
I in respect of Degrce Collep rcccived fiom tho Govcmocnt on
or before 0l-01-2006 shdl be treatcd as thc pcmrission,
ooncurrcncc or recognition as thc css€ may be, for thc purposc of
provincialisation of scrvices of teaclrers atrd/or tutors undcr this
Act:
Provided t'urther thar the ordcr tbr such permission,
r€cognition and concutrcnce strall have to bc issued on or bcfore
0l-01-2006 urd any order issued thereafter with any rctrospective
effect, shall not be considcr€d for the purpose of pmvincialisation
of services of any teacher and tutor, as thc case may be, of the
institr*ion;";
"(vii) For provincialimtion of servicos of one teacher or
tutor, as the case nroy be, in each subject including the core
subjects, in case of Venture High Sohool or Venture High
Madrassa or Ventue Highcr Secondary School or Vcnture Senior
Secondary School, at least l0 studanB must have appemed in the
last final examination in tlut particular subject from that
institution. Further, for provincialisaion of scnrices of morimum
limit of three teachers or tutors in a particular subjeot, as the case
may bq in casc ot a Venture Degree College, at least 15 students
in that particular subject, must have appeared iu the last linal
examination from that college;";
"(ix) For provincialisation of services of additional rcachcr
or tutor, as the case rnay be, for a particular subject including tbc
corc subjects, in addition to the post mentioocd in Section
3(1)(vii), in any Venture High School or Venture High Madrassa
or Vcnture Highcr Secondary School ur Vcnturc scr ur
Secondary School, the minimum students appcaring in the last
fiaal examination of thc highest class of thc said school for that

particular subject must exceed eighty for one additional post and
orp hundred fifty for the second additional post, Further, for
provincialisation of services of additional teacher or tutor, as the
ca$e may bc, for a particular subject, in addition to the posts
mentiored inSection 3(lltvii), in a Venture Degree Collcge, the
minimum students appcaring in the last final examination of the
highest class for that particular subject must be more than one
hundred fifty forone additional posq";

Amendnrcnt of 4. ln rhe principal Act, in section 4, in sub-section 12), tbr the

existing clause (i), the following shall be substituted, namely:'

"(i) must have been working as a teachr in the concerned

Venturc Educational Institution as mcntionod in Section 3(lxi)

that have bccn recognizd by the competent authority on or

before 01.01,2006;"

5. h the principal Act, for the words 'Tunior College" and

*Lectrq* whersver they occtu, the words
*Scnior Secondary

School" and *Post Goduate Teschefl respectively, shall be

substituted.
