Bold Music Independent Contractor Agreement

1. Accountability/Appearance
a. The instructor MUST contact new students by phone at least 24 hours prior
to their first lesson with Bold Music.
b. The instructor must be on time to every lesson
i. It is always beneficial to arrive 5 minutes early
ii. In the case of an unforeseen delay that is out of the instructor’s
control, they must inform client and George Ramsay
1. Traffic should be accounted for—it is not an excuse for
tardiness
c. Attire
i. Instructors should dress and conduct themselves in a professional
manner:
1. No holes in clothing
2. No inappropriate messages or ideas on clothing
3. No tank-tops
4. Dress conservatively
5. Nothing overly baggy
6. No athletic wear
d. Proper notice for cancellations/makeups
i. If the instructor cancels a lesson for any reason, they are required to
make it up within 30 days of the originally scheduled lesson to ensure
payment for that lesson
ii. Instructors must give at least 2 weeks notice for any vacation/time
they will miss teaching
iii. Emergency cancellations
1. Clients, George and Dean must be informed immediately; a
solution will be agreed upon by all parties
2. Makeups
a. Any cancelations by the instructor must be made up in a timely manner and
communicated to Bold Management.
b. Beginning January 1, 2018, students are allowed one makeup/reschedule
per month, provided they give the instructor 24+ hours’ notice. If a student
plans to miss more than one lesson in a given month, they must notify the
instructor AND Bold management at least 30 days in advance of the first
absence.
i. Cancellations less than 24 hours before scheduled lessons, with the
exception of emergencies, etc. do not require makeups.

1. Instructors may choose to schedule makeups for last minute


cancellations at their discretion.
ii. To avoid any conflict and ensure proper documentation, instructors
must keep accurate attendance records in their Staff Portal.
c. Instructors have 30 days from the time of a qualified cancellation to make up
a missed lesson, unless other arrangements have been made.
i. The instructor is responsible for scheduling makeups, not clients.
ii. If the makeup lesson is not held within 30 days of the missed lesson,
or an exception has not been agreed upon beforehand by Bold Music,
the instructor and the client, the instructor will not be compensated
for the missed lesson.
3. Pay
a. Instructors receive the following pay per lesson, at a rate of $40 per hour
taught:
i. $30 per 45 minute lesson
ii. $40 per 60 minute lesson
b. All billing and finances will be handled between the client and Bold Music.
c. Payment is direct deposited into the instructor’s bank account once a month,
on the third business day of that month, for all lessons taught during the
previous month.
i. For example, the instructor receives payment on the 3rd business day
in April for lessons taught in March.
d. Instructors are expected to teach 4 lessons per month per student, unless
otherwise agreed upon.
i. On months with a 5th lesson day, one lesson day can be skipped or
used as a makeup day if needed, but instructors are not paid for a 5 th
regularly scheduled lesson unless otherwise agreed upon.
e. Instructors will receive a Form 1099 for each calendar year in order to file
taxes as an independent contractor.

4. Using the Staff Portal


a. Instructors MUST mark attendance for each scheduled lesson in their Staff
Portal within 24 hours of the scheduled lesson time.
i. Attendance not marked in a timely manner will result in the instructor
not getting paid for those lessons/makeups
ii. All lessons NOT taught on the scheduled lesson day/time MUST be
marked absent, and must be accompanied by a note explaining the
reason for absence and any makeup information

a. Student cancelled day before. Rescheduled for 12/20 at


12pm.
2. Example of a bad note:
a. Stuck in traffic
b. “Bad” notes or no note will also result in the instructor
not getting paid for the lesson.
5. Behavior
a. Never use inappropriate language
b. Be polite
c. Under no circumstances are you to touch a student in any inappropriate way
(rough, physically abusive or sexually inappropriate), for any reason.
d. Instructors must not be under the influence of any drugs or alcohol when
dealing with clients, and Bold Music reserves the right to drug test at any
time.
e. Instructors are liable for any damage they cause to a client’s home, property
or possessions.

6. Loyalty
a. Any students Bold Music obtains for an instructor is a client of Bold Music
and may not be taught by the instructor outside of his or her Bold Music
agreement.
i. Any referrals received through Bold Music clients must also be
scheduled and taught through Bold Music, in accordance with this
agreement.
b. By signing this contract, you agree to a background check
7. Scheduling
a. It is the responsibility of the instructor to maintain an accurate schedule and
availability.
i. Instructors must notify Bold Music Management whenever they make
adjustments to their teaching schedule/availability (changes can be
emailed to kara@boldmusiclessons.com).
ii. Schedules must be kept up to date and accurate
1. Instructors may be subject to a $25 penalty any time a student
is booked when the instructor is unavailable but has not
communicated their updated availability to Bold Music
Management.

iii. Instructors may not agree to a new student, and then change their
mind after the student has been booked and confirmed
1. Doing so will result in a $25 penalty
a. If you agree to work with a student, we expect you to
honor that agreement! Make certain you are able to take
a student before agreeing to it.
8. Termination
a. By signing this, the instructor agrees to give at a minimum one month’s
notice before quitting the job
b. Bold Music reserves the right terminate your contract at any time, for any
reason.
