PETITION

COMES NOW THE PETITIONERS, CLAUDIA CATADMAN AND

MARISSA CATADMAN, through the undersigned counsel and unto this
Honorable Court most respectfully aver:
 1. That the Petitioner CLAUDIA CATADMAN is of legal age, widow,
Filipino and resident of Brgy. Bantayan, Dumaguete City, where she
can be served with summons and other processes of this Honorable
Court;

2. That the Petitioner MARISSA CATADMAN is of legal age, married,

Filipino and resident of Brgy. Candau-ay, Dumaguete City, where she
can be served with summons and other processes of this Honorable
Court;

3. That the petitioners are the sole heirs of the decedent CIRILO
CATADMAN;

4. That the decedent died on 24th of November 2018, Brgy. Bantayan,

Dumaguete City and a resident thereof, evidenced by his death
certificate hereto attached as Annex A;

5. That the decedent died intestate, without Will or Testament, and

without any outstanding debts in favor of any person or entity;

6. That the decedent is the absolute and registered owner of a parcel of

land covered by Transfer Certificate of Title No. 12345, more
particularly described as follows;

Lot No. 01 of the subdivision plan (LRC) Psd-123, being a portion of

Lot 01-A, Dumaguete Cadastre, LRC Cad. Rec. No. 12) situated in
the City of Dumaguete, Island of Negros. Bounded on the N., points 4
to 1 by Calle Victoria; on the NE., point 1 to 2 by Lot 02; on the S.,
points 2 to 3 by Lot 345 both of Dumaguete Cadastre; and on the SW.,
point 3 to 4 by Lot 03-A of the Subdivision plan… containing an area
of FIVE HUNDRED SQUARE METERS, more or less.

PRAYER

Wherefore, premises considered, it is respectfully prays upon this

Honorable Court that judgment be rendered declaring:
 (a) That, upon proper notice, publication and hearing, the
abovementioned property of deceased CIRILO CATADMAN be
partitioned among the surviving heirs;
(b) That such other relief be granted as shall be deemed just and
equitable in the premises.

same issues in the Supreme Court, the Court of Appeals, or any other
tribunal or agency;

pending in the Supreme Court, the Court of Appeals, or any other tribunal or
agency;

6. If we should thereafter learn that a similar action or proceeding has been

filed or is pending before the Supreme Court, the Court of Appeals, or any
other tribunal or agency, we undertake to report that fact within five (5) days
therefrom to this Honorable Court.
