SERVICE AGREEMENT

This Service Agreement is executed on this _____ day of _______ 2019 at ______
between:

____________ with a principal place of business at _____________, represented by


its _________________, _________________________, referred to as “EMPLOYER”.

-and-

__________________, legal ages, Filipino, residing at _______________ referred to


as “EMPLOYEE”.

Both collectively referred to as “PARTIES”.

Antecedents

The EMPLOYER has procured the services of the EMPLOYEE in its printing
business located at ___________.

The PARTIES executed a Collective Bargaining Agreement, attached as Annex A,


which allows the EMPLOYEE to retire at an early age provided he has rendered at
least 15 years of service or to retire at the age of 60 years old or more but not
beyond the compulsory retirement age of 65 years old.

The EMPLOYEE decided to avail the early retirement option after rendering the
minimum years of required service. Additionally, the EMPLOYEE requested for
a renewal of his Contract of Employment even after his retirement.

The EMPLOYER is of the opinion that the EMPLOYEE continues to possess the
necessary qualifications and experience to assist and benefit the EMPLOYER in its
business.

ACCORDINGLY, the PARTIES have mutually agreed to enter into a new Service
Agreement subject to the following terms and conditions:

1. COMMENCEMENT DATE
The term of this Service Agreement shall commence on ______.
2. JOB TITLE AND DESCRIPTION
The assignment, duties, and responsibilities of the EMPLOYEE shall
be the same as in his original Contract of Employment attached as Annex B.
It is also understood and agreed upon by the EMPLOYEE that he will, at all
times, faithfully and to the best of his ability perform all the duties required
of his position. In carrying out these duties and responsibilities, the
Employee shall comply with all policies, procedures, rules and regulations
of the EMPLOYER.

3. QUALIFICATION
The EMPLOYEE should be mentally, emotionally and physically fit
for the entire duration of the Service Agreement. The EMPLOYER shall have
the right to continuously ascertain the qualification of the EMPLOYEE
under this Service Agreement.

4. PROBATION
The EMPLOYEE shall no longer undergo a probationary period.

5. EMPLOYEE COMPENSATION AND BENEFITS


Employee Compensation and Benefits shall be the same as those
provided in the original Contract of Employment of the EMPLOYEE. The
EMPLOYEE shall also be immediately covered by the existing Collecting
Bargaining Agreement.

6. OTHER WORKING CONDITIONS


This Service Agreement shall be likewise subject to the same terms
and conditions provided in the original Contract of Employment of the
EMPLOYEE. However, it should not be construed as a continuation of the
EMPLOYEE’s term of employment.

7. TERMINATION
The EMPLOYEE agrees and acknowledges that he has the right to
terminate his employment at any time for any reason provided he has given
sufficient notice to the EMPLOYER. Conversely, the EMPLOYER shall have
the right to terminate this Service Agreement at any time for a sufficient
cause. This Service Agreement should not, in any way, extend the
compulsory retirement age of the EMPLOYEE.
