COMPLAINT UNDER SECTION 12 OF THE CONSUMER

PROTECTION ACT, 1986

RESPECTFULLY SHOWETH:

1. That the Complainant is a law abiding citizen of India residing within the

territorial jurisdiction of this Hon’ble Forum.

2. That the Opposite Party ------------------ are running the business of an

electronic repairs shop.

3. That the complainant had given his Television Set (Panasonic 32 Inch LCD)

for repair purposes to the Opposite Party on 15.09.2018 as the Television

had not been working properly.

4. That the Opposite Party had informed the Complainant that the Mother

Board and certain other parts of the Television were not functioning and had

to be replaced with new parts.

5. That the Opposite Party had told the complainant that the new parts would

be purchased by the Opposite Party and the complainant had agreed to this.

6. That the complainant had been assured by the Opposite Party that the

Television would be returned within 5-6 days after conducting the repairs.

7. That the Television had been returned to the Complainant on 30.09.2018

after the payment of Bill of Rs.6350/- (Rupees Six thousand Three hundred

and forty) which included the cost of the replaced Mother Board and T-Con

at Rs. 6100/- and service charges of Rs. 250/-. Copy of Bill is attached

herewith as Annexure –A.

8. That however, despite the repairs and the alleged replacement of the old

parts with the new ones, the television did not work properly. The

complainant even noticed certain breakage in the side portion of the

Television which was not there prior to giving for repairs to the Opposite

Party.

9. That when the Complainant informed the Opposite Party No. 2 that the

Television was not functioning despite the repairs, the Opposite Party No. 2

started quarrelling with the complainant.

10. That the Complainant had asked for the actual bill of the new parts installed

in the Television, however, the Opposite Party did not provide the same and
 neither was the Complainant returned the old parts removed from the

television.

11.That the Complainant got sent Notice dated 12.10.2018 to the Opposite

Party but no reply was received from the Opposite Party. Copy of the Notice

dated 12.10.2018 and Postal Receipt are attached herewith as Annexure-B

and Annexure – C respectively.

12.That the Hon’ble Forum has jurisdiction to hear and decide the present

complaint as the shop of the Opposite Party is situated in Tilak Nagar which

falls within the territorial jurisdiction of this forum.
