ECP (work-related)

Dependent
1. legitimate, legitimated or legally adopted or acknowledged natural child who is:
- unmarried, not gainfully employed
- not over twenty-one (21) years of age or over twenty-one (21) years of age
provided he is incapacitated and incapable of self-support due to a physical or
mental defect which is congenital or acquired during minority
2. Legitimate spouse living with the employee
3. Parents of said employee wholly dependent upon him for regular support.

Beneficiaries
1. dependent spouse until he/she remarries
2. dependent children ( primary beneficiaries)
- In their absence, the dependent parents and subject to the restrictions imposed
on dependent children, the illegitimate children and legitimate descendants
(secondary beneficiaries)
- Provided, That the dependent acknowledged natural child shall be considered
as a primary beneficiary when there are no other dependent children who are
qualified and eligible for monthly income benefit.
Injury
- any harmful change in the human organism from any accident arising out of and
in the course of the employment.
Sickness
- any illness definitely accepted as an occupational disease listed by the
Commission, or any illness caused by employment subject to proof that the risk of
contracting the same is increased by working conditions. For this purpose, the
Commission is empowered to determine and approve occupational diseases and
work-related illnesses that may be considered compensable based on peculiar
hazards of employment

Limitation
No compensation shall be allowed to the employee or his dependents when the
injury, sickness, disability or death was occasioned by any of the following:
(1) his intoxication;
(2) his wilful intention to injure or kill himself or another; or
(3) his notorious negligence.

Dependents - The dependents shall be the following:


(1) The legal spouse entitled by law to receive support from the member;
(2) The legitimate, legitimated or legally adopted, and illegitimate child who is unmarried,
not gainfully employed, and has not reached twenty-one (21) years of age, or if over
twenty-one (21) years of age, he is congenitally or while still a minor has been
permanently incapacitated and incapable of self-support, physically or mentally; and
(3) The parent who is receiving regular support from the member.
Beneficiaries - The dependent spouse until he or she remarries, the dependent
legitimate, legitimated or legally adopted, and illegitimate children, who shall be the
primary beneficiaries of the member: Provided, That the dependent illegitimate children
shall be entitled to fifty percent (50%) of the share of the legitimate, legitimated or legally
adopted children: Provided, further, That in the absence of the dependent legitimate,
legitimated children of the member, his/her dependent illegitimate children shall be
entitled to one hundred percent (100%) of the benefits. In their absence, the dependent
parents who shall be the secondary beneficiaries of the member. In the absence of all the
foregoing, any other person designated by the member as his/her secondary beneficiary.

Dependents — Dependents shall be the following:


(a) the legitimate spouse dependent for support upon the member or pensioner;
(b) the legitimate, legitimated, legally adopted child, including the illegitimate child, who
is unmarried, not gainfully employed, not over the age of majority, or is over the age of
majority but incapacitated and incapable of self-support due to a mental or physical defect
acquired prior to age of majority; and
(c) the parents dependent upon the member for support;
Primary beneficiaries — The legal dependent spouse until he/she remarries and the
dependent children;
Secondary
