DEED OF SALE

KNOW ALL MEN BY THESE PRESENTS:

This Deed of Sale made and executed by and between:

ELSIE A. BAYUBAY, of legal age, widow, Filipino citizen and a resident

of Brgy. Liberty, Laguindingan, Misamis Oriental, hereinafter referred to as the
SELLER;

- and -

ROMEO S. CABALLERO, of legal age, Filipino citizen, married and a

resident of Brgy. Biga, Lugait, Mismis Oriental, hereinafter referred to as the
BUYERS;

WITNESSETH:

1. That the SELLER is one of the heirs of the late Narciso Arafol and a co-
owner of a parcel of land covered and embraced by TCT No. 33082 consisting of
SEVENTEEN THOUSAND SIXTY SEVEN (17,067) SQUARE METERS, more or
less, and which more particularly described as follows, to wit:

“A PARCEL OF LAND, Lot No. 812 GSS 580, (Lot 279-B, Csd.
10-004957) situated at Barrio Taparak, Municiplity of Alubijid,
Province of Misamis Oriental, Island of Mindanao. Bounded on the
NW., along line 1-2 by Provincial Road, on the NE., along line 2-3 by
Lot 811 (Lot 279-A, Cad. 10-004957), on the East along line 3-4-5 by
Alubijid River; on the SW., along line 5-1 by Lot 813 (Lot 279-C, Cad.
10-004957-D); All of GSS-580. Beginning at a point marked “1” on
the plan being S. 35 deg. 59’ W., 3358.64 m. from BLLM No. 1, GSS-
580 thence:
N. 40 deg. 59’ E., 129.30 m. to pt. 2;
S. 59 deg. 17’ E., 104.21 m. to pt. 3;
S. 72 deg. 00’ W., 49.74 m. to pt. 4;
S. 03 deg. 20’ W., 162.12 m. to pt. 5;
N. 41 deg. 32’ N., 177.45 m. to pt. of beginning containing an
area of SEVENTEEN THOUSAND SIXTY SEVEN (17,067) square
meters more or less. All points referred to are indicated on the plan
and marked on the ground. Bearings true date of survey Oct. 25,
1987, executed by Geodetic Engineer Olegario E. Valles and was
approved on Feb. 2 1988.

2. That for and in consideration of the sum of ONE HUNDRED THOUSAND

PESOS (Pho 100,000.00) Philippine Currency, paid in cash by the BUYER
receipt in full thereof is acknowledged by and to the full satisfaction of the
SELLER, the latter does by these presents hereby SELL, CEDE, TRANSFER
and CONVEY absolutely and unconditionally unto the BUYERS, their heirs and
assigns my undivided share of ONE THOUSAND SEVEN HUNDRE SIX square
meters (1,706 sq. m.) ONLY free from all kinds of liens and encumbrances
whatsoever;

3. That by virtue hereof, the SELLER does by these presents hereby WAIVE
and RELINQUISH any and all rights that she has over the parcel of land herein
sold in favor of the BUYERS and shall defend her rights against all kinds of
claims of whomsoever.
