RE: Letter of Suspension

Dear Officer Starks:

You are hereby notified that you are suspended as a member of the Little Rock Police Department for a
period often (10) calendar days without pay. Your days of suspension will be Saturday, October 15, 2016,
through Monday, October 24, 2016. You will return to your regular assigned duties on Wednesday,
November 9, 2016, following your suspension pursuant to Internal Affairs File #II2016-00002. You are
suspended for violating the following listed sections of the General Orders and Rules and Regulations of
the Little Rock Police Department:

General Orders 303


Section IV.A.

Which states, "Officers employing force to control, arrest or prevent the escape of any person, will, prior
to the end of the officer's tour of duty, submit a detailed report outlining the circumstances and exact type
and amount of force used in the following instances:

Subsection 1, which states, Whenever the use of force results in, may reasonably result in, or is alleged to
have resulted in a physical injury to the person. Such force includes, but is not limited to, those instances
when: ·

b) An officer strikes, or attempts to strike, another person with his hands, feet, baton, or other
instrumentality, device, or method of force, whether or not injury results to the person."

Which states, "Dereliction of duty on the part of any officer, detrimental to the proper performance of the
functions of the Department, is cause for disciplinary action. The offender shall be punished according to
the severity of the violation, the results brought by the dereliction, and the effect it has upon the discipline,
good order, and best interest of the Department. The following subsections constitute dereliction of duty:

Subsection 1/4001.02, which states, Failure to observe and adhere to the Rules and Regulations, Policies
and directives of the Department."

Section 1/4002.00

Which states, "Officers shall not engage in any conduct which constitutes conduct unbecoming _an officer
or neglect of duty."

Section 1/4003.00

Which states, "No officer shall engage in any personal act or conduct which, if brought to the attention of
the public, could result in justified criticism of that officer or the Department. No officer shall be personally
involved in disturbances or police incidents to his/her discredit."

You violated the aforementioned sections of the General Orders and Rules and Regulations on February
12, 2016, when you were off-duty and went to the Rave Theater to watch a movie with two other officers,
one of which got into an altercation with a citizen at the end of the movie. You failed to identify yourself
as a police officer, call for a patrol unit or immediately notify a supervisor of the incident. The incident
was also commented on by local television stations and on their website. Your conduct during this incident
is not consistent with the conduct expected of a Little Rock Police Officer.

On June 30, 2016, you were afforded an administrative hearing concerning the above listed violations. Your
supervisors have reviewed the facts contained in Internal Affairs Files #112016-00001 and a determination
was made that you be suspended for a period of ten (10) calendar days without pay. Pursuant to General
Order 21 0.II.B.(6), you will not be allowed to participate in any off-duty employment during your
suspension period.

You are hereby advised that if you do not feel this suspension is proper and just, you do have the right to
appeal to the Little Rock Civil Service Commission. Such appeal must be in writing directly to the
Commission within ten (10) calendar days from the date you were notified of the suspension, setting forth
your reasons why you do not feel this action is proper. It is the officer's responsibility to ensure that appeal
notices arrive in the Human Resources Department by the deadline.
