DEED OF ASSIGNMENT

WITH ASSUMPTION OF MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF ASSIGNMENT WITH ASSUMPTION OF


MORTGAGE made and executed in the place and date mentioned herein below by
and between:

MARILYN P. PRAGATA, Filipino, married to Brian F. Dalangin, of legal age


and with address at Block 6, Lot 27, Phase I, St. Joseph Homes Subdivision, Inosluban,
Lipa City, Batangas hereinafter referred to as the “ASSIGNOR”;

- and -

SPS. VICTOR D. NANIONG, JR. AND RAQUEL L. NANIONG,


Filipinos, both of legal age and residents of Block 6, Lot 25, St. Joseph Homes
Subdivision, Inosluban, Lipa City, Batangas, hereinafter referred to as the
“ASSIGNEES”.

WITNESSETH:

WHEREAS, the ASSIGNOR is the purchaser from the developer JT MOLAND


REALTY DEVELOPMENT CORPORATION, of a Residential Unit located in Lot
27, Blk 6, St. Joseph Homes, Inosluban, Lipa City, Batangas 4217;

WHEREAS, the ASSIGNOR now intends to CEDE, TRANSFER and CONVEY


ANY AND ALL RIGHTS over the Residential Unit mentioned above, including all
the improvements therein;

WHEREAS, the ASSIGNEES have offered to BUY and the ASSIGNOR has agreed
to SELL all rights over the Residential Unit for the amount of THREE HUNDRED
THOUSAND PESOS (PhP300,000.00), Philippine Currency;

NOW THEREFORE, for and in consideration of the foregoing premises, the


ASSIGNOR hereby CEDES, TRANSFERS and CONVEYS any and all rights over
the Residential unit mentioned above, including all the improvements therein, and the
ASSIGNEES hereby accept the same, subject to the covenants hereinafter indicated:

1. The ASSIGNEES shall now BUY and the ASSIGNOR shall SELL all rights
over the Residential Unit for the amount of THREE HUNDRED
THOUSAND PESOS (PhP300,000.00), Philippine Currency;

2. The ASSIGNEES shall likewise assume the mortgage obligation over the
Residential Unit before the Home Development Fund (HDMF) balance starting
on June 30, 2018 with monthly amortization amounting to Four Thousand
Two Hundred Thirty Seven and Thirty Two Centavos (PhP4,237.32).

3. The ASSIGNEES shall assume all the duties and obligations of the
ASSIGNOR imposed upon the latter in relation to the Deed of Mortgage
and/or pertinent documents/contracts executed before HDMF;

4. This Deed of Assignment with Assumption of Mortgage shall be binding upon


the ASSIGNEES, their heirs, executors, administrators and other successors-in-
interest.

IN WITNESS WHEREOF, we have hereunto affixed our signatures this 4th


day of June 2018 at Lipa City, Philippines.
