ARCHITECTURAL DESIGN COMPETITION (ADC)
- is to state the principles upon which competitions are based and
by which Promoters/ Owners should be guided in organizing ADCs.
It has been drawn up in the interest of Project Proponents/ Owners
and Competitors.
Owner -person or organization that undertakes or promotes an ADC
Consulting Agreement means a binding covenant or understanding
entered into by a professional consulting architect (PCA) and/or
consulting firm (i.e. RAF only) with an Owner/ Client, whether in
Government, private sector or CSO or the international community
(with projects on Philippine soil), that provides such terms and
conditions mutually agreed upon by the parties, under which
specific work, study or joint venture requiring special or technical
skills and expertise, shall be undertaken

Jury - appointed by the Owner to assess the entries to the Consulting Architectural Firm (CAF) refers to an architectural
competition. Jurors-members of the Jury-consists of a majority of corporation, association, group or partnership duly registered with
RLAs, assisted by a lay Juror to represent the intention of the the Securities and Exchange Commission
Owner.
Direct Costs or Reimbursable Expenses-living and travelling
expenses of employees, partners, and principals when away from

Foreign Consultant (FC) or Foreign Architect (FA) refers to an
individual, not a citizen of the Philippines
Multiplier refers to a factor which compensates the Professional

Salary Cost means the cost of salaries (including sick leave, vacation,
holiday and incentive pay applicable thereto
COMPENSATION OF PACS
Per Diem or Hourly Basis is compensated for all the time he
devotes to the work, including travel time

Retainer is used when the services of a Professional Consulting
Architect (PCA) is expected to be required at intervals over a period
of time
Salary cost times a multiplier, plus direct cost or reimbursable

Percentage of total project cost is calculated as an agreed
percentage of the ultimate cost of the project/service.

CONCILIATION/ MEDIATION: An attempt to achieve an amicable

settlement

Conciliation is a way of settling disputes between parties arising

(except labor disputes). The dispute is referred to a panel of
conciliators tasked to bring the parties to an agreement.

Mediation is a way of settling disputes between parties arising from,

or connected with construction contracts in the Philippines (except
labor disputes). A single neutral third party, called mediator, brings
the disputing parties to a negotiation.

Arbitration is defined as the investigation and determination of

matters of differences between contending parties by one or more
unofficial persons, called arbitrators or referees, chosen by the
parties [Bouvier’s Law Dictionary 225]. It is in tended to avoid the
formalities, the delay, the expense and vexation of ordinary
litigation [Curtis-Castle Arbitration, 42 Am.St., Rep 200].
