1. Review Magicdust’s existing copyright policy


At the present time, Magicdust does not have a separate and explicit copyright
policy. Although, there are some general statements about copyright, they could be
insufficient to protect Magicdust’s staff and customers from risks caused by using
third party copyright materials such as music, video, photos and software, etc.
This document is designed to serve as a policy guideline with the objectives of
• Raising staff and customers’ awareness about risks of using copyright
materials
• Assisting staff in using materials legally through understanding their
responsibilities and complying with the Australian Copyright Act.
2. What if the event of infringement occurs
When copyright material is used without permission in a way which is reserved
exclusively to the copyright owner, copyright is infringed. In such a case, the
copyright owner is eligible to take an action or file a suit in a court to get remedies
compensated based on final orders granted by the court such as damages, an
account of profits, delivery up of the infringing articles and an injunction.
If infringements of copyright relate to commercial dealings or are on commercial
scale, they can result in criminal offences.
There are different penalties applied to an individual and a corporation that is
accused of offences. A corporation is likely to be fined up 5 times the maximum fine.
3. Methods proposed to prevent any breaches of copyright

a. Try always to create our own products first to avoid using third party ones.
b. Be always careful of using anything on the Internet. Normally, they are
assumed to be copyright protected by default.
c. When using online or third-party materials, remember not to copy, share or
edit them without permission. If necessary, a license needs to be obtained to
use materials legally on our disposal.
d. If you are developing a product based on others’ one (source material), try
your best to make it as distinct and separate from the source file as possible.
4. Distribute new or revised policy and procedures to stakeholders
It is important to ensure all stakeholders to get the revised policy and procedure
notified. There are many ways of effective distribution to guarantee right information
will reach right people. In general, there are several methods which can be used:
a. Face-to-face communication: stakeholder meetings, team meetings
b. Hard-copy communication: reports, letters
c. Electronic communication: forums, email, facebook, web conferences
5. Plan for training workforce
All Magicdust staff should recognize the importance of compliance with the
Copyright Act. Especially, those who usually surf the Internet and use online or third-
party materials for creating a work need to understand their responsibilities and
procedures to avoid any potential copyright infringement.
• Conduct a training need analysis to identify staff’s knowledge gaps
• Staff will be provided with relevant policy documents
• They include an explanation of duty of care and implications for all staff.
• Training will be implemented by training personnel within a pre-set timeframe.
• Conduct a survey to get feedback about the performance

6. How to measure compliance


Conducting inspections or audits on a regular base (weekly or monthly) plays an
important role in ensuring the compliance with the policy, regulations and the Act.
The implementation can be conducted by Magicdust managers or external experts.
In additionally, an extra feedback form will assist managers in identifying existing
issues through reporting on any breaches of compliance and immediately able to fix it
to avoid severe consequences.
