II. FORMAL OFFER

The testimony of the witness Ms. Matutina “Tet” Rosales is being

offered to prove that she knows the petitioner and the respondent in

this case; and that she personally witnessed the verbal insult by the

respondent to the petitioner. Tet, in the course of her testimony, will

identify evidence pertinent to this case and will also testify on other

allied matters.

I, MATUTINA “TET” ROSALES, of legal age, Filipino, single,

with address at #21 Morning Glory St. Navy Base, Baguio City, after

having been duly sworn to in accordance with law, hereby states that:

I am answering the questions propounded by Atty. Lorenzo

Angelo A. Ocampo of MALOAG CCA LAW FIRM fully conscious that I

am under oath and that I may face criminal liability for false testimony

or perjury;

This Judicial Affidavit is written in English, a language known and

understood by me, and the examination and execution thereof were

done at MALOAG CCA LAW FIRM, #69 Puso ng Baguio, Session

Road, Baguio City; and

This Judicial Affidavit shall serve as my direct testimony in this

case.

III. JUDICIAL AFFIDAVIT PROPER

1. Q- Please state your name, age, residence, and occupation.

A- Matutina Rosales or “Tet”, 30 years old, #21 Morning Glory

St. Navy Base, Baguio City.

2. Q- Why are you here now?

A- To directly testify regarding the verbal insult of Jacky to Jade.

3. Q- For the record, please state the name of the Lawyer who is

now conducting your examination and the place where it is being

held.

A- Atty. Lorenzo Angelo A. Ocampo is conducting my

examination in their law office at Puso ng Baguio, Session Road,

Baguio City.
4. Q- In what language do you want the examination to be

conducted?

A- In English, attorney.

5. Q- Do you undertake to answer the questions to be asked of you,

fully conscious that you will do so under oath, and that you may

face criminal liability for false testimony or perjury?

A- Yes, attorney.

6. Q- Do you know the petitioner Jade Flores- Bartolome?

A- Yes. She is my neighbor.

7. Q- How about the respondent Jacqueline Montefalco- Corpuz or

“Jacky” Corpuz?

A- Yes. She is also my neighbor.

8. Q- Are you related to any of them?

A- No.

9. Q- Are you familiar with any of them?

A- They are both my friends. They buy goods in my store and

sometimes, standby for a while to gossip.

10. Q- Do you work in your store full time?

A- Yes, attorney.

11. Q- So you were there when the incident happened in front of

your store?

A- Yes.

12. Q- Can you narrate what you witnessed on January 26, 2019?
 A- Yes, attorney. It was after lunch when Jacky bought load from

me then Chari and Tart passed by. She called them and started

to gossip about Jade. They were just outside my store so I can

hear them clearly. She was telling them about Jade being a

mistress and an adulterer at the same time. Later, Jade, together

with Marissa, approached me to buy vinegar. Suddenly, Jacky

uttered, “Oh ayan na yung kabit na may kabit.” then called Jade

as “sawsawan ng bayan.” That was the time when Jade shouted

at Jacky then the quarrel ensued.

13. Q- What were you doing then?

A- I was taking a video of the incident.

14. Q- When did you start recording?

A- When they started to gossip about Jade.

15. Q- In the video, would you be able to point out the characters?

A- Yes, attorney. Their voices were clear as well.
