2018 CONSTITUTION AND BY-LAWS OF THE CAGAYAN STATE UNIVERSITY –

CARIG GRADUATE SCHOOL STUDENT COUNCIL

PREAMBLE

We, the students of the Cagayan State University Carig Graduate School, imploring
the aid of Almighty God, realizing the need to establish an autonomous, representative and
democratic Student Council that will unite the Carig Graduate School Studentry and bring
forth harmonious relationship with other sectors of society in order to instil moral uprightness
and excellency for the advancement of noble ideals and aspirations, bind ourselves in
commitment and hereby ordain and promulgate this constitution.

ARTICLE I

IDENTITY AND DOMICILE

Section 1. The organization shall be known as Cagayan State University (CSU) Carig
Graduate School Student Council.

Section 2. Its office address shall be at Carig Campus, Cagayan State University, Carig Sur,
Tuguegarao City, Cagayan.

ARTICLE II

DECLARATION OF PRINCIPLES AND OBJECTIVES

Section 1. The CSU Carig Graduate School Student Council subscribes to the following
principles:

a. That education shall develop man’s physical, mental, social and cultural
potentials in order to realize his part in social change;
b. That education shall embrace critical thought and ability to make informed
judgment, free of dogma and myths;
c. That Carig Graduate School Student Council shall be a democratic,
representative and autonomous organization;
d. That Cagayan State University, as a state university, is a higher education
institution supported by the countrymen’s wealth, thus, shall carry out its
primordial role as an instrument towards society’s advancement; and
e. That Carig Campus, as a part of the university system, shall carry out its
responsibility towards the realization of the university’s vision and
mission.

Section 2. The CSU Carig Graduate School Student Council shall, at all times, strive:

a. To uphold a truly representative, autonomous, and democratic Student
Council;
b. To serve as an active forum for student ideas and sentiments;
c. To uphold and ensure democratic participation and representations in any
policy-making body which directly affect student rights and welfare;
d. To guarantee the promotion, advancement, and protection of student
welfare;
e. To uphold the ideals and principles of the university; and
f. To forge unity with other sectors of the university in particular and society
in general for the attainment of these objectives.

ARTICLE III

CONSTITUENTS, RIGHTS AND DUTIES

Section 1. All bona fide students of the Carig Graduate School duly enrolled and pursuing
any of the academic degree/programs offered by the university shall be constituents of the
CSU Carig Graduate School Student Council.

Section 2. The constituents shall have the following rights:

a. To enjoy freedom of expression;


b. To elect the officers of the CSU Carig Graduate School Student Council;
c. To cast vote in CSU Carig Graduate School Student Council initiated
plebiscite, referenda and elections ;
d. To be elected to any position in the CSU Carig Graduate School Student
Council subject to the provisions of the Article on Election and
Installation, Article V, of this constitution;
e. To have their grievances heard and speedily remedied;
f. To have their academic records and clearances speedily processed, and
confidentiality of such records be maintained;
g. To be free from exploitation, involuntary servitude and unjust
punishments; and
h. To be accorded due process of law.

Section 3. It is the duty of every constituents to:

a. Support and participate in the CSU Carig Graduate School Student


Council initiated activities and projects, cast his vote in the referenda,
plebiscite and elections;
b. Pay necessary dues and fees accorded through this constitution and other
existing rules and regulations;
c. Exercise his rights responsibly; and
d. Abide by all the provisions of this constitution.

ARTICLE IV

THE STUDENT COUNCIL

Section 1. The CSU Carig Graduate School Student Council shall be the highest governing
body of all graduate students at Cagayan State University – Carig Campus.

Section 2. It shall be composed of a President, Vice President, Secretary, Assistant Secretary,


Treasurer, Assistant Treasurer, Auditor, Assistant Auditor, two (2) Project Managers, Public
Information Officer, and Program Representatives.

Section 3. The officers of the Student Council shall have the following duties and functions:

a. The President
1. Call for and preside over all meetings;
2. Plan, recommend and present to the members of the Student Council
any project or activity that are deemed necessary and advantageous;
3. Approve expenditure items and direct the Treasurer to make an annual
financial report of the Student Council;
4. Represent the Association in meetings and activities duly called; and
5. Appoint members of the Ad Hoc Committees to ensure proper
coordination and efficiency of the undertaking of the Student Council.

b. The Vice President


1. Perform all duties and responsibilities of the President in case of
absence, death, permanent disability, removal from office, or
resignation;
2. Assist the President at all times; and
3. Perform other duties and functions as may be assigned or delegated by
the President.

c. The Secretary
1. Take down or record all minutes of meetings of the Student Council
and the general membership;
2. Act as a custodian of all records and documents of the Student
Council;
3. Prepare the agenda of meetings and read the minutes of the previous
meeting at the opening of every meeting;
4. Submit to the Graduate School Dean, Graduate School Student Council
Adviser and Office of the Student Development and Welfare required
reports or documents; and
5. Perform other duties and functions as may be assigned by the
President.

d. The Assistant Secretary
1. Perform all duties and responsibilities of the Secretary in case of
absence, death, permanent disability, removal from office, or
resignation;
2. Assist the Secretary at all times; and
3. Perform other duties and functions as may be assigned or delegated by
the Secretary or other competent authority.

e. The Treasurer
1. Serve as the custodian for funds of the Student Council;
2. Prepare Financial Reports for the information of the Student Council
and the general membership; and
3. Perform other duties and function as may be assigned by the President.

f. The Assistant Treasurer


1. Perform all duties and responsibilities of the Treasurer in case of
absence, death, permanent disability, removal from office, or
resignation;
2. Assist the Treasurer at all times; and
3. Perform other duties and functions as may be assigned or delegated by
the Treasurer or other competent authority.

g. The Auditor
1. Audit, verify and examine all financial transactions of the Student
Council;
2. Render the Audit Report; and
3. Perform other duties and functions as may be assigned by the
President.

h. The Assistant Auditor


1. Perform all duties and responsibilities of the Auditor in case of
absence, death, permanent disability, removal from office, or
resignation;
2. Assist the Auditor at all times; and
3. Perform other duties and functions as may be assigned or delegated by
the Auditor and other competent authority.

i. Project Managers
1. Entertain proposals and propose projects for the organization with the
endorsement of the President; and
2. Perform other duties as may be assigned by the President.

j. Public Information Officer

1. Disseminate information regarding the Student Council’s activities;
2. Develop and maintain media used for information dissemination; and
3. Perform other duties as may be assigned by the President.

k. Program Representatives
1. Serve as a liaison between the CSU Carig Graduate School Student
Council and the graduate students of their respective programs;
2. Represent the graduate students from their respective programs in the
Student Council’s planning and policy formulation; and
3. Perform other duties and functions as may be assigned by the President
and other competent authority.

ARTICLE V

ELECTIONS AND INSTALLATION

Section 1. Officers of the CSU Carig Graduate School Student Council shall be elected
through nomination and show of hands on the last Saturday of September or through other
generally accepted means of nomination and votation.

Section 2. Every officer shall hold office for one academic year or until his successor has
been duly elected, qualified and assumed office, provided that any qualified candidate who
shall fill vacant seats shall hold office only for the remainder of the unexpired term.

Section 3. Every nominee in the CSU Carig Graduate School Student Council, before the
election must:

a. Have at least one semester residence in the Cagayan State University;


b. Not been found guilty of any misconduct with disciplinary notice from any
act involving moral turpitude.
c. Any permanent vacancy in the Office of the President shall be filled by the
Vice President, provided that if the permanent vacancy occurs in the office
of the Vice President, the Secretary shall succeed as the new Vice
President;
d. When both the President and Vice President be temporarily incapacitated,
the remaining officers shall elect from among themselves an Acting
President and an Acting Vice President both whom shall relinquish their
positions upon return of the permanent officials. In no case shall the
Student Council be dissolved or rendered inoperative.
e. If vacancy occurs in the office of other officers, the candidate who
obtained the next highest number of votes in the last elections of the
Student Council shall take over.

Section 4. The induction of members shall take place during the Annual Carig Graduate
School Day. The oath shall be administered by the University President or his duly
authorized representative.

Section 5. Member shall not hold any other major position in other student organizations
without forfeiting his seat in the CSU Carig Graduate School Student Council.

ARTICLE VI

DISCIPLINARY MEASURES

Section 1. The Carig Graduate School Student Council shall have a Committee that will take
charge of disciplining its erring members.

Section 2. Any constituent may file an impeachment or suspension proceeding against any
officer to the Committee.

Section 3. Any Officer may be impeached/suspended on the following grounds:

a. Wilful violation of any or all provisions of this Constitution;


b. Gross neglect of duty;
c. Any unwelcome behaviour during any session of the Student Council;
d. Falsification of documents or malversation of funds; and
e. Any other form of misconduct which tarnishes the integrity of the Student
Council.

Section 4. Disciplinary action shall take effect with 2/3 affirmative vote from the Committee
Member except for impeachment which would require at least 2/3 votes of the majority of the
general membership.

Section 5. Member shall not be subjected to disciplinary measures without due process of
law.

ARTICLE VII

MEETINGS OF THE STUDENT COUNCIL

Section 1. Carig Graduate School Student Annual Assembly shall be held. The venue and
date shall be determined by the Officers in consultation with the Appointed Adviser.

Section 2. There shall be a monthly regular meeting to be determined by the Officers. Special
meetings shall be determined by the Officers as the need arises.

ARTICLE VIII

FUNDS OF THE STUDENT COUNCIL

Section 1. The general funds of the CSU Carig Graduate School Student Council shall
consist of the P20.00 semestral fee collected by the Campus Administration during every
regular registration period and shall be deposited in a special fund.

Section 2. The CSU Carig Graduate School Student Council shall be authorized to collect
nominal fee such as semestral or annual fees from the members and further authorized to
receive donations to form part of its fund.

Section 3. The CSU Carig Graduate School Student Council shall formulate and adopt a
budget which shall embody the work plan of the programs and projects. No money shall be
paid out except in pursuance of an appropriation authorized by the same.

Section 4. Expenditures incurred shall be audited.

Section 5. The balance of the funds for a specific term shall be retained as the funds of the
CSU Carig Graduate School Student Council for the succeeding term.

ARTICLE IX

AMENDMENTS

Section 1. Any constituent/member has the right to propose at any time any amendment for
the improvement of the CSU Carig Graduate School Student Council Constitution and By-
Laws.

Section 2. Any proposal shall be endorsed in writing one month before the regular meeting
for the purpose of discussion and further deliberation and to facilitate the amending/revising
process.

Section 3. Amendment/revision shall take effect after a majority affirmative vote of the total
number of votes cast during the plebiscite to be held for this purpose, provided that the total
number of votes cast shall in no case less than 2/3 of the general membership.

ARTICLE X

EFFECTIVITY

Section 1. The CSU Carig Graduate School Student Council Constitution and By-Laws shall
take effect upon ratification in a plebiscite called for this purpose by a majority of the total
membership.

Adopted and ratified this ____ day of November 2018 at CSU Carig Campus, Carig Sur,
Tuguegarao City, Cagayan, with the list of members, together with their list of signatures
who ratified the same appearing in Annex A hereof.
