Mr. Flint,
Please be advised that in the future, if you have an issue with a member of my staff, I ask that
you take the matter up with me. Your email (below) which was sent last night is an effort to
bully a member of my staff into acquiescing to your demands through intimidation and overt
threats of creating more work because you did not get your way. I am saddened that you chose
this method to communicate your message to the District.
In Ms. Anderson’s email to you, she in no way denied you access to the tape which you had
requested. Her response was pursuant and within the limits of the Brown Act, and she indicated
to you when the tapes would be made available to you. As a matter of record, Ms. Anderson
replied to your request for Public Records 5 full days prior to our obligation to do so.
It has been the practice of the District to provide copies of tapes of Board meetings once the
tapes have been translated into minutes that can then go before the Board for approval. This
has been the practice of the CSD since 2006. I directed Ms. Anderson to continue with that
policy and to convey that to you. She did so in her email to you dated July 14, 2010 and sent at
5:55 pm. There is no attempt, effort, or implication to “deny or delay” the production of the
tapes as you allude.
That said, if you would like to come to the District offices during normal business hours and
listen to all or a portion of the tapes identified in your public records request, you may do so at
your convenience. I will like to remind you that our offices are open from 8:00 am to 5:00 pm
Monday through Friday. As the tapes in question are approximately three hours in length, I
would encourage you to be respectful of staffs time and make certain that your perusal of the
tapes is complete by the close of business.

I appreciate your response to my request. I would like to pick up a copy of tape this week rather
than wait until the minutes have been approved. In the past, I understand that others have
been allowed access to the audio of these meeting prior to the minutes being approved, and
one of the reasons I would like to review the audio is to ensure that there are no issues with the
minutes that require further review. I note with amusement that you did not supply any reason
for delaying my ability to listen to the recording of the meeting. I assume if the DB‐CSD had a
legitimate reason you would have shared it with me.
Just in the past year, several community members and at least one board member have had
concerns with the minutes, and listening to the recording has been utilized to resolve these
issues.
Would you please share with me the identity of the person who has directed you to withhold
the tape from me? I would like to follow up with what I consider an unreasonable delay.
I am copying the President of the DB‐CSD so that he is aware of the delaying tactic that the CSD
is employing. I am also copying Ruth Roberts and Rick Lemyre of ThePress who are no doubt
aware that when ThePress has requested access to recordings they have been produced without
this delay. Finally, I am copying Mary Piepho, Steve Bolen, and LAFCO to ensure that they are
aware of the manner in which the DB‐CSD has responded to my request. Because the meeting
in question dealt with issues for which the DB‐CSD has not sought activation of their latent
powers through LAFCO and is therefore acting as a Community Services District without
authority while “appearing” to advise the Contra Costa County Board of Supervisors.
I expect that the DB‐CSD will make this tape available to me by the end of this week. If not,
please provide a thorough defense of your position so that I may proceed accordingly.
To summarize,
1) please make the tape available for my listening at the CSD office by the end of this week;
2) please share with me the identity of the person who directed you to delay provision of
the tape as described in your email;
3) please provide me with the legal reasoning behind the CSD’s denial/delay of my request.
I do not wish to burden you or the DB‐CSD, but if my request is not satisfied and communicated
to me via email by noon tomorrow I will make a further request for all records of public requests
and provisions of audio tapes or opportunities to listen to such tapes from January 1, 2009 to
current so that I can better understand the application of this delaying tactic.

This email is to acknowledge receipt of your request to the Town of Discovery Bay
Community Services District (“CSD”) for information under the Public Records Act
(California Government Code §§6250 et seq.) for copies of the tapes of the above-
mentioned meeting that was received by our office on July 8, 2010 and we have our
response to your specific item as follows:
The Town of Discovery Bay CSD does have copies of the tapes in response to your
request. The cost to duplicate the tapes is $1.75 each.
We expect to have the tapes available to you after the CSD board approves the minutes at
their July 21, 2010 meeting.
