Dear Chairman McNair,
Thank you for your time this afternoon. As I said, I think the LAFCO commissioners who have issued
statements in The Press have done a serious injustice to the election process in Brentwood.
First and foremost, these commissioners presented their thoughts as commissioners of LAFCO without
authority required by your rules.
§1.4.F.4 Commission Member Participation in Community Activities – From time to time, Commission
members and alternates may participate in community activities, committees, events and task forces.
Unless specifically authorized by the Commission, when a Commission member or alternate participates in
such activities, the member or alternate is acting as an interested party rather than acting on behalf of the
Commission.
Acting or participating on behalf of the Commission is limited to those instances when the Commission has
formally designated the Commission members or alternate as its representative for the matter.
This section limits participation of commission members in community events, and letters to the editor,
community debates and meetings fall into his category. Unless the commission member has been
formally designated to represent the Commission on the matter, that commission member must act as an
interested party rather than acting on behalf of the Commission. In this case, the three commission
members represented themselves as speaking on behalf of the Commission, in violation of your rules.
Furthermore, the first letter alleged the following: “If Brentwood’s voters indicate their lack of interest in
this area by defeating Measure F…” then LAFCO could act. This is a complete non‐sequitur as a “no vote”
on F does not equate to a lack of interest in the area. The implication of these commissioners is
dishonest.
There can be no doubt that the letters from LAFCO commissioners were submitted under false pretenses
(they were not authorized by LAFCO to issue them and they were not speaking on behalf of LAFCO), nor
can there be any doubt that they have been used by the proponents of Measure F in their campaign
literature. After reading the letters to the editor in the local paper, it is clear that the public has taken
these threats as they were intended, to marshal support for the measure.
I have included several letters that have been submitted that demonstrate the power of the
commissioners’ ill conceived statements and ask that you, and Chairman of LAFCO take a pro‐active step
to ameliorate the damage done by their remarks.
You are certainly well within your rights to submit a short letter to the editor (Rick Lemyre) along these
lines: Dear Editor, I was sorry to see two letters submitted by three LAFCO commissioners regarding
Brentwood’s Measure F. These commissioners were not authorized by LAFCO to submit these statements
and LAFCO does not support or endorse them. In fact, I do not believe there is any reason for Brentwood
voters to react to these statement with a fear of this land being annexed to Antioch, nor do I believe that
a “No vote” is an indication that Brentwood has no interest in the land. It is my sincere wish that none of
the comments issued by LAFCO affect the results of the election. I hesitated to comment on this issue,
however after reading some of the comment that have been made subsequent to the commissioners’ ill
advised statements, it is clear that they have caused confusion. I am sorry for that.
…..well, you see what I’m getting at I think….
There isn’t much time to try to undo the damage that has been done. Doing nothing allows these
commissioners to affect the outcome of an election; I think you owe it to LAFCO and Brentwood to at
least attempt to make this right.
