Ms. Posadas:

My client Rolando D. Dela Cruz is now the owner of a parcel of land located in Purok 2,
Brgy. Ambalatungan, Santiago City, covered by Transfer Certificate of Title (TCT) No. T-178770
(SC-2321) registered in the name of his late wife Alejandra A. Bayaua, being the sole heir of
Alejandra. A portion of the said lot is presently occupied and used by you as your place of residence.
However, your occupation or possession thereof is merely by reason of my client’s tolerance as he
and his wife and their assigns, out of neighborliness, familiarity, friendship and because they pity
you and your parents and/or the person/s from whom you claim and/or derived your possession, as
you have no place to reside in the meantime, allowed you to occupy the same. This being the case,
you are bound by an implied, inherent and necessary promise to vacate and surrender actual
possession of the said portions upon demand of my client.

Considering that my client have decided to exercise his right of ownership over the whole of
the said lot which includes his right of possession and use thereof and had in fact made several verbal
demands for you to vacate and had also sought the Barangay Officials concerned for such purpose
but to no avail, FINAL DEMAND is therefore made upon you and all those persons living with and
claiming any right from you (which include your husband, your children, heirs and assigns) to vacate
the said portion of the lot occupied by you and to surrender actual possession thereof to my client
within ten (10) days from receipt of this letter. Your failure to do so shall compel us to file
appropriate actions in court against you and members of your family in order to enforce the said
rights of my clients.

Please be guided accordingly to avoid unnecessary embarrassment of forced


eviction/ejectment upon implementation of lawful judgment/order of the Court through the sheriff
with the aid of the police and law enforcement agencies.
