Statement by Chris

I ask that you sanction the three students Josh Grossman, Cody Marshall, and Utsav Gupta for
conspiracy to defraud and to misappropriate funds. These students are attempting to prevent
other students from benefiting from legitimate media organizations by registering 89 (and
possibly counting) other media organizations to challenge their funding.

As evidence of this conspiracy, I offer the following leaked email that describes the conspiracy
in detail and also the fact that they have already begun creating these media organizations.

Hey all! This is Cody Marshall. Some of us have developed a plan to force AS's hand in being
more critical of the way that media organizations are funded on campus. This could potentially
provide an anvenue through which we can get the Koala defunded.

Basically, AS can pick and choose which organizations to fund when there is a financial
justification to do so. Last year, AS over-funded media organizations somewhat, but did not
decide to cut any.

This year, we are going to break their backs! If they want to try and be
neutral, then so be it. We are gonna make them take a second look at the way they fund media
by creating over 100 random media organizations that will all receive funding! Once they
realize that their system is broken, they will have to pick and choose orgs to fund, with the
controversial Koala surely being among one of the top newspapers to be contested.

Check out this funny article from the california review; a conservative
newspaper on campus.

speech/">http://ucsdcalrev.wordpress.com/2010/10/25/king-gupta-returns-to-silence-free-
speech/</a>

Each media org needs a minnimum of 4 members to be approved! We had four members up
until last night, when Mac Zilber who is on AS dropped out because of the potential heat he
could face from conservatives on campus.

Please let me know if you want to take part in this. You don't have to
produce ACTUAL MEDIA; just sign up for the org with your P.I.D. It takes about 20 seconds
for each org.

1) These actions fall under AS Jurisdiction:

22.16. Standards of Conduct: This Conduct Code applies to behavior of Students and UCSD
registered student organizations on UCSD/University owned or leased properties or functions
located or conducted on properties that are owned, leased or administered by UCSD/
University. Students and registered student organizations assume an obligation to conduct
themselves in a manner that is compatible with University policies and UCSD rules and
regulations. Failure of Students and registered student organizations to conduct themselves in
such a manner may subject them to discipline under this Conduct Code.

2) Cause of action:

22.16.10.11. All forms of non-academic dishonesty, including, but not limited to, fabricating
information, any form of bribery or knowingly furnishing false information or reporting a false
emergency to University or UCSD officials acting in the performance of their duties.

Registering 89 media organizations for the purpose of bringing down the funding system was
an act in bad faith and dishonest as to the intentions of those involved and is thus "non-
academic dishonesty". To argue otherwise would be utterly absurd. I hereby request a
temporary injunction with the AS Judicial Board immediately for violating UCSD policies,
which student organizations are bound by.

Given these facts, I ask that you sanction Josh Grossman, Cody Marshall, and Utsav Gupta
without delay as is your duty under your contractual agreements as representatives of the
Associated Students. Thank you.
