EXPLANATORY NOTE

In the National Youth Assessment Study last 2015, statistics reveals that only 41.9% youth mem-
bers aging from 18-30 years have attended programs or events arranged by various organizations,
and 30.2% were members of at least one organization. These facts impose a challenge to the gov-
ernment, most especially the Local Government Units.

The Philippine Youth Development Plan 2017-2022 serves as the foundation for a unified action
among the youth and the government. The said framework is composed of the nine (9) centers of
youth participation and one of it is the Active Citizenship that aims for the youth to participate in
community development and nation building through active, meaningful, sustainable, productive
and patriotic engagement in civil society, social mobilization, volunteerism and values formation.

In order for its goal to be attained, strengthening enabling mechanisms for youth organization and
participation is needed by securing allocation of funding source for the implementation of the Lo-
cal Youth Development Plan.

In the near future, this bill will ensure that the government can provide an avenue where the youth
could proactively participate.

Be it deemed necessary for the state to immediately approve this proposed legislation.

AN ACT MANDATING LOCAL GOVERNMENT UNITS TO ALLOCATE AN ANNUAL


BUDGET FOR THE IMPLEMENTATION OF THE
LOCAL YOUTH DEVELOPMENT PLAN

Be it enacted by the Senate and the House of the Representatives of the Philippines in the Con-
gress assembled:

Section 1. Short Title. LOCAL YOUTH DEVELOPMENT PLAN BUDGET ACT

Section 2. Coverage. All provincial, city, and municipal government units through the Sangguni-
ang Bayan/Panlungsod/Panlalawigan Committee on Budget and Appropriation, Committee on
Youth and Development, Local Development Youth Council and Sangguniang Kabataan Peder-
asyon implementing the Local Youth Development Plan shall be covered under this act.

Section 3. Definition of Terms. For the purpose of this act, the following terms are hereby defined:

(a)Local Youth Development Council- a multi-sectoral youth association, which shall be


called, Provincial Youth Development Council (PYDC), City Youth Development Council
(CYDC), and Municipal Youth Development Council (MYDC), respectively headed by the con-
cerned SK Pederasyon President and composed of representatives of youth and youth-serving
organizations in the provincial, city, and municipal level.
(b)Local Youth Development Plan – shall refer to the provincial, city, or municipal youth
development plan as initially drafted by the SK Pederasyon, finalized by the LYDC and approved
by the local Sanggunian and anchored on the Philippine Youth Development Plan (PYDP) and
the local development plans of the local government unit concerned.
(c)Youth – in accordance to the Republic Act 10742, it shall refer to those persons whose age
ranges between fifteen (15) to not more than thirty (30) years old.
(d)Youth Organizations- refers to those registered organizations whose majority of member-
ship or composition are youth.
(e)Youth-Serving Organizations- shall refer to those registered organizations or institutions
whose principal programs, projects, and activities are youth-oriented and youth-related.

Section 4. Rationale. Article II Section 13 of the 1987 Constitution recognizes the vital role of the
youth in nation building and shall promote and protect their physical, moral, spiritual, intellectual,
and social well-being.

Thus, the state shall secure that it provides an avenue of opportunities for the youth in accordance
with Republic Act 10742 Chapter III Sec. 24 which states that the Local Youth Development
Council shall be funded by the respective Sangguniang Bayan, Sangguniang Panlungsod, and
Sangguniang Panlalawigan.

This act hereby mandates all provincial, city, and municipal governments to allocate 1 % of their
annual investment plan for the effective implementation of the Local Youth Development Plan.
Section 5. Appropriation. The source of fund will be coming from the Internal Revenue Allotment
of the concerned local government unit to assure the sustainability of the Local Youth Develop-
ment Council’s youth development programs and services. Such allocation shall accrue to Trust
Fund of the Local Youth Development Fund to be administered by the Council.

Section 6. Oversight Committee. The Department of Interior and Local Government shall be the
head of the Oversight Committee to monitor the implementation of this act together with the Local
Chief Executive of the Local Government Unit concerned.

Section 7. Reportorial Requirements. The Local Youth Development Office as the secretariat of
the Local Youth Development Council shall submit an annual report to the Office of the Mayor
and a copy of it furnished to the offices of the Sangguniang Bayan/ Sangguniang Panlungsod/
Sanggunian Panlalawigan.

Section 8. Implementing Rules and Regulations. Within 90 days from the effectivity of this act,
DILG, COA and such other civil organizations as may be determined are necessary to formulate
the provisions of this bill.

Section 9. Repealing Clause. All laws, decrees, executive orders, proclamations, rules, and regu-
lations, or parts thereof inconsistent herewith are hereby replaced or modified accordingly.

Section 10. Separability Clause. If any provision of this act is held invalid or unconstitutional, the
other provisions not affected hereby shall remain valid and subsisting.

Section 11. Effectivity Clause. This act shall take effect fifteen (15) days upon publication in at
least (two) national newspapers of general circulation.
