Oxdinance No. 936 AN ORDINANCE PROVIDING FOR THE LICENSING OF BINGO GANES WITHIN THE CITY OF GRAYSVILLE, ALABAMA, BE IT ORDAINED the City Council of Gr Section I. Definitions vile, Alabama as follows: For the purposes ofthis Ordinance, the following words shall have the following meanings ‘Any and All Games of Bingo. ‘The game commonly or tadtionally known es Bing, whether oF not electronic, computer, or other technologie aid ae sed in connection therewith Bingo. Any eleewonic or mechanical equipment, machine or deviee, oF computer ot other technologic hardvare cr device which is used or can be uted to play Bingo. Bingo Machine includes any machine, device or hardware that assists a player or the playing of Bingo, broadens the Participation levels in a common gue that includes all of the ancillary Bingo Supplies, Examples of Bingo Machines include but are not limited to dispenses, readers, electronic player stations, player terminals, central computer seers containing random number generators and other processing capabilities {for temote player terminals, electronic consoles capuble of providing game results indifferent display ‘modes, telephones and telephone circuits, televisions, cables and other tolocommunication eiteit, and seis and else (ansmniting und receiving equipment. Tradttonal bingo played uizing paper cards and any devices to assis in the playing of tadiional bingo utlzing paper cards shall be exempt under ‘his definition. An organization within this tate, not for pecuniary profit, which consists of a least 15 memes vito are 60 years of age or older and exit fr their mutual support and advancing the causes of elderly or retired person, Service Organization, A branch, lodge, or chapter ofa national or state organization, not for pecuniary profit, which is atthorized by its written constitution, charter, ertieles of incorporation, oF bylaws to engage ina fiateral, civic or service purpose within the state; and a local civic onganization, rot for pecuniary profit and at affilited with a state or national organization, which is recognized by resolution adopted ty the city in which the organization conducts its principal activities, whose constitution, charter, articles of incorporation, or bylaws contain provision for the perpetuation af the ‘organization as @ nonprofit eganization wise entire assets ate pledged to charitable purposes, and ‘whose constituon, charter, ticles of incorporation, or bylaws, contain a provision that all asses, ral ‘propery, and personal propery shall revert tothe benefit of the ety government upon dssoletion ofthe organization ‘Special Occasion, A single gathering or session at which a series of succesive bingo games authorized by this Ondinance are played pursuant to a special permit issued under Section V of this, Ordinance, ‘Veterans? A permitholder may hold only one permit and that pert is valid fr only one loeation, A permits not assignable or transferable. (©), Itstall be unlawful for any person to operate, conduet, or paticipate in any bingo game, or provide ‘uipment ullized inthe opetation of bingo games, unless such a game is operated under acumen, valid bingo permit issued for a qualfied organization atthe permitted location. () The permit described in tas Seton isin ation to and not in ley of any other perils or Hoenses hich may be required by the City of Graysville, and no bingo gue shall be operated until such time as all requisite permits and licenses have been aban, (4) The following types of bingo permits are hereby rested forthe operation of Bingo: 1. “Class A Bingo Permit” shall mean a permit issued to an applicant who desires to ‘operate only Paper Card Bingo. 2. “Class B Bingo Permit” shall mean a permit issued to an applicant who destes to operate Any and All Games of Bingo, Section IL Application for permit and Ringo Machine Fees. (2), Any qualified organization desing to obtain a Class A Bingo Permit shall make application to the City Clerc on forms prescribed by the City Council and shall pay an annual base fe of two hundred fifty oliars ($250), Any qualified organization desiring to obtain w Class B Bingo Permit shall make application tothe City Cen cn forms prescribed by the City Council and shall pay an annual base fe of ‘wo thousand, ve hundred dollars (82,500). No permit shall be issued fo any charitable nonprott organization unless such organiation has been in existence for 24 months immediately prior to the Fssuance ofthe permit. The peomit shall expire at midnight on September 30th following the granting of ‘he permit. Renewal application foreach calendar year shall be ile with the City Cer prior to October IstoFeach year. (©), Esch application fora permit and each application for renewal of a permit shall be on a form proseribed by the City Counc and must contin the following information: (D, The name and tome and mailing address of the applicant and, if the applicant is @ corporation, association, o oer similar legal entity, the names and home and mailing addresses ofeach ofthe fiers of the organization as well s the names and addresses ofthe directors, o¢ other persons similar situated, of the organization, @, The names and home and mailing addresses ofeach of the persons who willbe operating or promoting the bingo game, as well as their date of birth and other information which may be quested bythe City lek; (©), The names and home and walling addresses of any persons, organizations, or other leg nities that will eta surety for the applicant, o to whom the applicant is financlally indebted, ‘orto whom any fnanil obligation is owed by the applicant;
