requested that the following reports be made
available to the public:
- the entire Ernst and Young review (only portions of it have been released to the
public)
- the detailed breakdown of how the $70 million cost estimate for the arena
building had been arrived at.
Staff had previously indicated that releasing this information would compromise
ongoing negotiations. Now that the facility is not going ahead there should be no
reason to keep this information private.
I also want to point out that over 2 months ago, the city released extremely
detailed information on the breakdown of the $10 million road and sewer works
portion of this project . If this could be released then, there seems to be no
reason why similar information on the arena couldn’t also be released.

Hi Tracy,

As requested, here is an outline that describes the Privacy Breaches that have occurred in the last two years; the
processes that we have followed and must follow; and, the status of each.

Process/Procedure:

Section 30.5 (2) of the Freedom of Information and Protection of Privacy Act states:
Notification of unauthorized disclosure
(2) An employee, officer or director of a public body, or an employee or associate of a service provider, who knows
that there has been an unauthorized disclosure of personal information that is in the custody or under the control of
the public body must immediately notify the head of the public body.

Once the Head has been notified, there is a privacy breach checklist that I must go through.  It stipulates the steps I
must take and they are:
1.       Contain the Breach
a.      Do all you can to contain the breach.
2.      Evaluate the risks
a.      This includes evaluating the extent of the breach (internal or public); the sensitivity of the personal
information; the risks to the individual the personal information is about; and, the harm to them and therefore to the
public body.
3.      Notification

a.      This means notifying the individuals whose personal information was breached.  They have a right to know of
the risks to them that their personal information has been disclosed and the steps the public body is taking to deal
with it.
b.      Contact the Office of the Information and Privacy Commissioner.  This is when the decision to call the Office
of the Information and Privacy Commissioner is done as well.
4.      Prevention
a.      This is when steps need to be put in place to ensure a similar breach doesn’t happen again. 

At step 3, Notification, I let an intake officer at the Office of the Information and Privacy Commissioner know that
there has been a breach, and what it is.  I let them know what steps we have taken and plan to take to contain the
breach (recall emails, send letters under Section 73.1 of FIPPA, etc.).
The OIPC then determines if they will open a file.  Whether or not they open a file depends on the Risk Factors
listed above.  They then either will, or will not, decide to investigate a breach and assign an investigator.  Once
investigating a breach, the Commissioner himself determines whether or not the breach warrants the public body be
investigated, or audited, because they have not done a good enough job at protecting personal information and the
public bodies practices are sub-par.

1Q 2017 In Camera release information on our website.
 
I told him that it was recently taken down in order to review  a document that we were advised
should not have been released.
 
Tracy, Sheila and myself met to discuss this last Thursday, as to the documents in question.  The
document has not yet been located.
 
I advised Mr Abasii that once the correction had been made the documents would once again be
back up on the website.  He advised that he would do a media request for the information he was
after and did not disclose what that was to me.

This one I am not sure how I can articulate very well in a report (I will try to though) but I for
now I can explain via response email as well.

I have always, and done so exemplary, the discharging of my statutory obligations.  For eight
years working with FOI, either as the Head or Coordinator, I have done my best to advise,
educate, and enforce the rules of the Act, and other legislation as it relates to the Freedom of
Information and Protection of Privacy Act.  My advice, whether adhered to or not, has always
been backed up with subsequent legal opinions, when required, and I have always responded
dutifully and in good faith to all requests received.  I have done my best to ensure others
adhere to the legislation and have stood up and said something isn't right, or shouldn't be
done, whenever I believed that to be the case.

I have spent the last 3 years educating those that work with FOIPPA, whether it be past
managers, FOI Clerks, and now the FOI/Records Supervisor.  I have put on annual training
courses for FOI through HR that are well received and have benefited the organization.

In my previous role that is now being continued by Anita and Megan, I created a Privacy
Management Program, with 12 different components to be completed and rolled out; created
a Records Catalogue and Personal Information Bank (required under the Act); completed an
FOI quick tips manual for all staff and public (not published); provided other training and
speaking opportunities to educate those on FOI and Privacy; and, continued to oversee the
FOI and other Privacy related files that my staff work on.  I have been the main person of
contact for the OIPC for 8 years.  I have worked through many mediations of files that have
gone through review at their office, and had one of those files I worked on go to Inquiry.  I was
correct in my decision and the City won that case.

I have two designations with Information and Privacy.  One being a "working" designation as a
"Professional" in Information and Privacy having done this work in 5 of the last 7 years, the
other I had to have training and do an exam on Information and Privacy in all sectors all across
Canada and have my designation as a Certified Information and Privacy Professional/Canada.
