LEASE DEED

Draft a deed of lease of open land for agricultural purposes.


THIS AGREEMENT made at _____ this __ day of ____, 20__, between ABC, aged about __
years, son of ___, residing at ____ (hereinafter called “the Lessor”) of the One Part And
DEF, aged about __ years, son of ___, residing at ____ (hereinafter called “the Lessor”) of
the Other Part,
WHEREAS the Lessor has agreed to give and the Lessee has agreed to take on lease
all that piece or parcel of land bearing Survey No. ___, Hissa No. ___, admeasuring ___
acres, situated at Village ___, Taluka ___, District ___, State ___, upon the terms hereinafter
contained:
NOW THESE PRESENTS WITNESS and the Parties hereby mutually agree as
follows:
1. The Lessor shall lease to the Lessee all that piece or parcel of land bearing Survey No.
___, Hissa No. ___, admeasuring ___ acres, situated at Village ___, Taluka ___, District ___,
State ___ for a term of 99 years commencing from the date of handing over the possession of
the said land.
2. It is agreed that the value of the land agreed to be leased is Rs. 10 per square meter.
The Lessee shall pay to the Lessor the yearly rent calculated at 5 % per annum on the total
value of the land as per joint survey, on the basis of the value being Rs. 10 per square meter
net free from all deductions. Such yearly rent shall be paid in equal monthly instalments free
from all deductions whatsoever on the 10th day of every month in advance.
3. The Lessee shall be entitled to use the land agreed to be leased for erecting and
constructing building for residential and shop purposes on the land to be leased, subject
however to the sanction of the proper authorities.
4. The Lessee may enter into an Agreement for sale on ownership basis of the structures
built over the premises agreed to be leased, but in such event also, the Lessor shall have a
paramount lien and a first charge on the structures, and buildings or building given on
ownership basis and the Lessee shall continue to remain liable to the Lessor for the due
performance of all the terms, conditions, covenants and stipulations of this Agreement and of
the lease when granted.
5. All out-of-pocket expenses of this Agreement, including stamp on the lease and the
duplicate thereof, all registration fees, charges for advertisements, searches of encumbrances,
surveys and certified copies of documents shall be borne and paid by the Lessor and Lessee
in equal shares. Each party shall bear and pay the costs of his legal advisers.
6. The Lessor shall have a right of re-entry on breach of any of the terms on the part of
the Lessee.
IN WITNESS WHEREOF the parties hereto have hereunto set their respective hands
the day and year first hereinabove written.
