RESOLUTION No. 18

WHEREAS, Chapter 1 Section 384 of Republic Act 7160 otherwise as the Local Government
Code of 1991, provides that the Barangay serves as the primary planning and implementing unit of
government policies and as a forum wherein the collective views of the people may be expressed,
crystallized and considered, and where disputes may be amicably settled;
WHEREAS, Section 1 of Article XI of the Constitution provides that “Public Office is a Public
Trust”. Public officers and employees must all times be accountable to the people, serve them with
utmost responsibility, integrity, loyalty and efficiency, act with patriotism and justice and lead with
modest lives;
WHEREAS, the Sangguniang Barangay shall create a Barangay Grievance Board (BGB) to
receive, hear and act upon complaints filed against appointive officials and employees of the
Barangay;
WHEREAS, the Barangay Grievance Board (BGB) shall composed of the following:

WHEREAS, the Board shall have the power to issue summon against all appointive Barangay
Officials and employees subject to the verified complaint and to require persons to testify before the
Board and/or produce documents and other evidences;
WHEREAS, the Board shall conduct hearings on the cases brought against appointive Barangay
officials and employees and submit their findings and recommendations to the Barangay Chief
Executive concerned within fifteen (15) days from the conclusion on the hearings;
WHEREAS, in the event that there is a prima facie evidence on the case against a respondent
and upon recommendation by the Board, the Barangay Chief Executive may preventively suspend for
a period not exceeding sixty (60) days any subordinate official or employee under his authority
pending investigation if the charge against such official or employee involves dishonesty, moral
turpitude, oppression or grave misconduct or neglect in the performance of duty or if there is reason
to believe that the respondent is guilty of the charges which would warrant his removal from the
service.
NOW THEREFORE, upon motion of Kagawad Mike R. Sagun duly seconded by Kagawad Joel
M. delos Reyes and with the unanimous accord of the members of the Sangguniang Barangay
present;
RESOLVED FURTHER, that copy of this Resolution shall be forwarded to the Sangguniang
Panglungsod, the Department of Local and Government and other offices concerned for their
information and record.
I HEREBY CERTIFY that the foregoing resolution was duly adopted by the Sangguniang
Barangay of Mabayuan, Olongapo City on the date aforementioned.
