Di dalam kes Daud Mamat & Ors v. Majlis Agama Islam/Adat & Anor
(2001) 2 CLJ 161, Hakim Mahkamah Tinggi di muka surat 171
memutuskan:-
“Apart from the above jurisdictional flaw, which could not support their
applications, the plaintiffs have unwittingly alluded to art. 11(1) of the
Federal Constitution as the main ground of their grouses. This provision
reads that every person has the right to profess and practise his religion
and, subject to cl. (4), to propagate it. This brief but meaningful article in
crystal clear terms guarantees the right and freedom of every citizen, of
whatever race or religion to profess and practise his or her beliefs
unhindered...”
Hakim Mahkamah Agung di muka surat 538 memutuskan: “It is trite that
Article 11(1) of the Constitution guarantees the freedom of religion, where
every person has the right to profess and practise his religion. However,
such right is not absolute as Article 11(5) provides that this article does not
authorise any act contrary to any general law relating to public order, public
health or morality. In the context of Service Circular 2 of 1985 prescribing
the mode of dress and prohibiting the wearing of an attire covering the face
by a lady officer in the public services during work, we are of the opinion
that such prohibition does not affect her constitutional right to practise her
religion. ”
Pada hemat penulis, hak kebebasan beragama adalah hak yang dijamin
oleh Perlembagaan. Walaubagaimanapun hak tersebut adalah tidak mutlak
tetapi tertakluk kepada sekatan-sekatan yang diperuntukkan di bawah
Perkara 11 Perlembagaan Persekutuan. Kerajaan pada umumnya
mempunyai kuasa untuk menyekat pengembangan agama lain terhadap
umat Islam.
Sebagai contoh, dewasa kini semakin ramai penganut agama Islam yang
dikatakan murtad atau mempersoalkan ajaran Islam itu sendiri. Untuk
membendung gejala ini, pada pandangan penulis adalah wajar untuk
kerajaan campur tangan agar masalah ini tidak berterusan. Oleh itu, harus
difahami dan diterima dengan hati terbuka bahawa kebebasan beragama
yang diperuntukkan oleh Perlembagaan Persekutuan bukanlah sesuatu
yang mutlak.
