• Never agree for marriage in foreign country as in many legal cases, the legal
decrees of Indian courts are not applicable in many countries.

• Brides parents should always be aware of the foreign country laws & rights in
order to defend their daughter if there would be an issue related to abuse or
domestic violence.

• Make sure always that you have scanned copies of important documents like
marriage certificate, visa & passport.
Specific provisions made by the Indian Supreme
Court for NRI Wives

• The marriage held between an NRI and Indian women in residing in India
may not be annulled by any foreign court.

• Adequate alimony should be paid to the wife by an NRI husband in case of

divorce.

• The decree of Indian court is executable in foreign courts under section 44A
of the Civil Procedure Code which talks about the binding nature of any
foreign decree.
 What Indian Govt, has done so far for it:

The Indian Government has launched a Scheme called NCW

(National Commission for Women). The prime motto of this scheme
is to give legal financial assistance to Indian women deserted by
their NRI husbands.

The NCW provide limited assistance up to $1500 per case and then
released to Indian community organizations in order to assist the
women in documentation work so that they file a case against the
deserted spouse.
