COUNTER-AFFIDAVIT

I, FRITZ Huesta, of legal age, single, Filipino, and resident

of Veterans Village, Iloilo City, under oath, depose and say, that:

1. I am the respondent in NPS NO. VI-10-INV-18E0044 for

Theft filed by private complainant St. Paul’s Hospital,
Inc. (SPHI) represented by Aimee A. Sillo and now
pending before the Office of the Prosecutor;

2. I deny the allegation in the complaint of theft, that I

stole monies from the complainant;
3. The truth of the matter being as follows:

a. I only learned that there was a case against me for

theft when I received the subpoena sent to me by the Office
of the City Prosecutor;

b. I personally know Mr. Riniel hugnaton and known

to me as Nong Alex (hereinafter reffered as respondent
Molina);

c. I personally know that respondent Molina was an

employee of the complainant’s hospital and as one of the of
the staffs in the Central Sterile Supply Unit (CSSU) therein;

d. Respondent Hugnaton has been kind and generous

to me and my family, hence, when he requested me to help
for making errands for him, I oblige without any doubt;

e. One of the errands that said respondent Molina

requested from me was to request for refund of certain
receipts he provided to me at the CSU of SPHI. He
explained to me that he just wanted to recover his money
which was utilized to pay the articles as reflected on the
receipts he requested me to get a refund on. I am not
knowledgeable of the rules and regulations attending the
process of refund in CSSU of SPHI, but I trusted respondent
Molina knew it since he worked in the said office. With his
reasonable and just explanation, I complied. Once the
refund is made, I turned over to him the money and he tried
to gave me a certain amount but I did not accept;
 f. I am not aware that in doing so, I am abetting
respondent Molina in the commission of an offense of theft.
I have no intention to gain from the said refunds of articles
and I am in good faith, and with full trust and confidence
with respondent Molina that all the transactions regarding
refunds of articles were all by legal means.

4. I am executing this counter-affidavit in order to attest to

the truth of all the foregoing statements and for the
purpose of preliminary investigation.
