In this file the Court extended the time granted to the Claims Commission for its performance.

The Commission, within this extension, admitted, among other claims, the lawyer Ambrosio
Calleja for the amount of P950, and the Court ordered the administrator made this payment, the
Court appointed special administrator to Salustiano Zubeldia to sell assets of the abintestato for
make this payment. The special administrator Zubeldia sold, with this objecto, eleven parcels of
land and the Court approved this sale. Against this resolution approving the sale, an appeal was
filed by the administrator and by Marcial Golingco, who claims to be the heir of the deceased.

It is alleged that the Court extended the period to admit and consider the claims before the
Commission beyond the time allowed by law. This allegation is unfounded. Article 689 of the
Code of Civil Procedure empowers the Court to extend the period during which creditors may
present their claims to the Commission for examination and admission until the maximum time
of eighteen months. The notification made to the creditors by the Commission for the
presentation of the claims against the intestate was made on March 25, 1926. The first
extension granted by the Court on January 21, 1927 was for one month and the second until
December 31, 1927. May 1927. On the same date, the Commission admitted Calleja's claim. It
is, therefore, that from March 25, 1926 to May 31, 1927 had not elapsed the 18 months within
which the Court could, depending on the circumstances, extend the deadline. On the other
hand, the claim of Ambrosio Calleja was filed on May 20, 1926, that is, two months after the
notification made to the creditors for the presentation of claims.
The appellants, when challenging the performance of the Court granting the extensions, are based on
which the notofication to the creditors for the presentation of claims was made on March 25, 1925. But,
it appears that this date is wrong, then, according to the piece of exceptions amended, the notification
was made on March 25, 1926, and not on March 25, 1925.

As has been said, Ambrosio Calleja's claim was admitted by the Commission on May 31, 1927. On July 11
of the same year, the Commissioners presented their report to the Court. The administrator appealed of
this report, with regard to the claim of Ambrosio Calleja, on August 8, that is, within 28 days of its
presentation, having been submitted after the period of 25 days fixed by law. The Court, in effect,
declared that this appeal of the administrator was filed out of time and against this statement no
exception was presented.

On November 4, 1927, the Court ordered the administrator repeatedly to pay Ambrosio Calleja the
amount claimed for P950 and, not having complied with this order, the Court, on January 22, 1935,
appointed Salustiano Zubeldia as special administrator to sell in private, or at public auction, sufficient
properties of the abintestato to pay Ambrosio Calleja his admitted claim, with his legal interests since
November 4, 1929. Salustiano Zubeldia sold eleven plots of land of the abintestato in compliance with
this order. The Court approved this sale. Against this approval of the sale by the Court the appeal was
filed under which the case is now before Us for its decision.
The appeal rests fundamentally on the fact that the Court lacked jurisdiction to extend the deadline for
submitting claims to the Commission beyond the maximum time established by law. From what we have
said before on this point, this claim is completely unfounded.

Therefore, confirm the resolution appealed with the costs to the appellants. This is how it is ordered.
