LEAVE AND LICENSE AGREEMENT

THIS LEAVE AND LICENSE AGREEMENT is made and entered into at


mumbaion this day of april 2007 BETWEEN SHRIMATI KASHIBAI
DATTATRAY KENI an adult Indian inhabitant of residing at 31/3, Kashi
Bhuvan, Sameer Chandavarkar Lane, Dahanukarwadi, Kandivli(west),
Mumbai – 400067. hereinafter called “THE LICENSOR” (which expression
shall unless it be repugnant to the context or the meaning thereof, shall
mean and include her heirs, executors, administrators and assigns) of the
ONE PART; AND : MR TIRUPATI SHANKAR AGOLLAPU, also adults,
Indian Inhabitant of Mumbai, having address at JayBharat Society, Renuka
Nagar, new link road, opp. Chanakya Bldg. Mahavir Nagar, Kandivli(west),
Mumbai- 400067. hereinafter called “THE LICENSEE” (which expression
shall unless it be repugnant to the context or the meaning thereof, shall
mean and include her heirs, executors, administrators and assigns) of the
OTHER PART.
WHEREAS “THE LICENSOR’’ is the owner, fully seized, possessed of and
well sufficiently entitled to a shop premises bearing no Plot 31, Situated at
Kashi Bhuvan, S.C Road, Dahanukarwadi, Kandivli(West), Mumbai-
400067, hereinafter called “THE SAID SHOP”.

AND WHEREAS “THE LICENSEE” is in need of a residential premises, he


approached to “THE LICENSOR” with request to permit and allow him and
his family to use, occupy and stay, in the said shop, as a mere Licensee for a
temporary fixed period of 11 (eleven) months only and on certain terms and
conditions which the parties have agreed to reduce into writing as under :

NOW THIS INDENTURE WITNESSTH AS UNDER:-

At the request of “THE LICENSEE”, “THE LICENSOR” hereby permits


and allows “THE LICENSEE” to use, occupy and stay in the said Shop no
301, in the known as Plot 31, Situated at Kashi Bhuvan, S.C Road,
Dahanukarwadi, Kandivli(West), Mumbai-400067, hereinafter called “THE
SAID SHOP”.
1. i.e period of 11 (eleven) months only which shall be commencing
from 20th March 2007, and expiring on the 19th day of February,2008
(both days inclusive) subject to performance and compliance of all the
terms and conditions made hereunder :-

2. “THE LICENSEE” agrees to pay “THE LICENSOR” a sum of Rs


16,500\- (RUPEES SIXTEEN THOUSAND FIVE HUNDRED
ONLY) being the advance license fee or compensation amount for the
use and occupation of the said Shop, @ of Rs.1,500\- (RUPEES ONE
THOUSAND FIVE HUNDRED ONLY) per month for a 11(eleven)
months inclusive of taxes and maintenance but exclusive of
electricity, water etc. bills charges pertaining to the said shop during
the period of this leave and license agreement for which this shall be
regularly without any default.

3. “THE LICENSOR” doth hereby admits and acknowledges to have


received the sum of Rs. 1,500\- (RUPEES ONE THOUSAND FIVE
HUNDRED ONLY) being the security deposit amount for the due
observation and performance of the ters and conditions contained
herein which shall be refunded by the Licensor to the Licensees
without any interest on the day of expiry of this agreement or on
earlier termination of this agreement and removing the Licensees
their belongings and articles from the said shop and receiving the
vacant and peaceful possession of the said shop after deducting
license fee of any amount found due till then.
4. “THE LICENSEES” shall pay the electricity, water etc. bills/charges
pertaining to the said shop during the period of this Agreement.

5. “THE LICENSEES” shall not claim or put forth any right, title or
interest save and except the mere Licensee and that is too for the fixed
limited period of 11 (Eleven) months only, which is terminable by
“THE LICENSOR” or commiting breach or breaches of any of the
terms and conditions contained in this Agreement.

6. “THE LICENSEES” shall use and occupy the said Shop for his
RESIDENTIAL CUM COMMERCIAL PURPOSE ONLY and shall
not carry out any illegal or immoral business and shall not cause the
waste and damage to the said shop.

7. “THE LICENSEES” shall not create any nuisance or annoyance or


obstruction to the neighbors by any manner.

8. “THE LICENSEES” shall not sell, part with, mortgage, charge,


dispose off or to deal with, sub-let or grant Leave and License or to
create any right or encubrances in respect of the said shop or any part
thereof with any person or persons in any manner of whatsoever.

9. If “THE LICENSEES” does not perform and/or carry out the terms
and conditions of this agreement and/or commits default in payment
of monthly compensation amount and/or commits breach of the terms
and conditions and “THE LICENSOR” shall be entitled to terminate
this Agreement and “The LICENSEES” shall not be allowed to stay
more therefrom.

10. “THE LICENSEES” hereby agrees, undertakes and assures that he


shall remove his articles and belongings immediately on the expiry of
this Agreement and on or the day of termination of this Agreement,
and in case if “THE LICENSEES” fails to do so, “THE LICENSOR”
shall be entitled to stop “THE LICENSEES” to enter into the said
Shop.

11. It is Agreed and understood that for all the legal purposes, the
possession of the said shop shall be construed with “THE
LICENSOR”.

12.It is very clearly agreed and understood that nothing in this agreement
is deemed to create any right of tenancy or sub-tenancy or assignment
or any other interest of whatsoever nature in the said Licensed
Premises, save and except a mere permission for a temporary period
AS LICENSEE.
13.Both the parties are entitled to terminate/cancel this agreement by
giving one month’s notice to either side about their intention.

14.“THE LICENSEES” shall not make any additions/ alternations in the


said licensed premises, without prior written consent from “THE
LICENSOR”. However “THE LICENSEES” shall be at liberty to
bring the necessary fixtures and furniture’s for his use. “THE
LICENSEE” further undertakes to make good the damages caused ti
the said licensed Shop while removing, dismantling such fixtures and
furnitures for the said Shop at the time of termination or earlier
determination of this Agreement.

15.The Licensees further agrees and undertakes to use the Furniture’s,


Fixtures and other articles as mentioned below with due care and
caution and further undertake to return the same at the time of
termination/ earlier determination in the same conditions as it is on
this date.

IN WITNESS WHEREOF the parties here to have set and subscribed their
respective hands on the day and the year first hereinabove written.

RECEIPT

ACKNOWLEDGES to have received sum of Rs. 1,500/- (RUPEES ONE


THOUSAND FIVE HUNDRED ONLY), by cash, being the Interest fees
Security Deposit amount for the due observation and performance of the
terms and conditions contained herein from the withinnamed “THE
LICENSEES” as within mentioned.
