Design Guidelines and Deed of Restriction for Residential Units


Ninoy Aquino Avenue; Clark Freeport Zone

OBJECTIVE:

To properly regulate the lease, construction/renovation, utilization and maintenance of existing


housing units in the Clark Freeport Zone for property and estate management purposes.

COVERAGE:

This Deed of Restrictions shall initially cover the row of residential housing units along Ninoy
Aquino Avenue whether:

 Covered by a Lease Agreement, either for a long or short term.

 Currently utilized and maintained by CDC.

DESIGN GUIDELINES:

Concept ~ Preservation and restoration of the architectural and structural design of the
structure as constructed and left behind by the USAF.
Objective ~ To create a harmonious and sustainable architectural design for the entire
Parade Grounds and its immediate environs to make the area as one of the
tourism landmarks in Clark.
Materials ~ Any construction material could be used as long as the design theme is
followed.

DEED OF RESTRICTIONS:

1.0 General Provisions:

1.1 The purpose of these restrictions is to preserve the original architectural and structural
design of the housing units along Ninoy Aquino Avenue, considering their historical
and cultural relevance to Clark.

1.2 Clark Development Corporation, through its CDC-MD and PMD shall be responsible
for the enforcement of this DEED OF RESTRICTIONS, as well as for updating the
restrictions to ensure that herein objective is maintained. Accordingly, NO
renovation/rehabilitation of any housing unit shall be allowed without construction
permit issued by authorized CDC-Building Official. (emphasis underscored)

1.3 The housing units shall not be utilized for any other purposes other than for
“residential” use only.

1.4 The LESSEE/Occupant or their successor-in-interest shall abide by the rules and
regulations laid down by the CDC in the interest of sanitation, security, aesthetics and
the objective herein sought to be achieved.

2.0 Development Considerations:

2.1 Demolition of any housing unit is strictly prohibited. (emphasis italics)

2.2 Exterior Perspective ~

2.2.1 Structural design of the housing unit shall be preserved and maintained
specifically on the following considerations:
 Shape
 Roof features
 Openings
 Projections
 Trims and secondary features
 Materials
 Setting

2.2.2 Exterior finish shall be maintained in its original material and color.

2.2.3 Original roofing material shall be maintained. Any change or upgrade in the
roofing material shall make use of the foregoing as reference. Original roof
color shall be maintained to preserve its historical relevance.

2.3 Interior Finish ~

Interior design of each housing unit may vary according to the desire and preference
of the occupant as to type of finish and materials to be used provided, the structural
integrity of the unit is preserved and maintained.

2.4 Auxiliary Structures ~

2.4.1 The plans and specifications of any subsequent additions thereto, constructed
within the property, shall comply with the Building Code of the Philippines,
rules and regulations, policies in the Clark Freeport Zone and construction
plans must be subject to the approval of CDC.

2.4.2 No barbecue pits or any other permanent structure shall be allowed abut any
fence or on any boundary between lots, open space, and landscaped area.

Barbecue pits, when allowed by CDC, should be made or constructed from


non-combustible materials, and should be located clear of vegetation within a
1.0 meter radius from its center.

2.5 Forbidden Constructions ~

Garage, carport, gate, and fence surrounding the lot’s property line of whatever type
or made are forbidden constructions. No shrubs or any type of vegetation shall be
planted around the property line serving as fence.

2.6 House Use ~

2.6.1 The housing units shall not be utilized for any other purposes other than for
“residential” use only.

2.6.2 Breeding of animals, inside or outside of the housing unit, for commercial
purpose is strictly prohibited. A reasonable number of domestic pets may be
allowed provided they are properly kept to avoid nuisance, physical injury, or
damage to property of occupants of surrounding housing units. (emphasis

2.6.3 No commercial or advertising signs shall be posted any where the housing unit
and lot.

2.7 Sanitation, Grass and Garbage ~

2.7.1 Occupants shall at all times keep and maintain the exterior wall clean and free
of dirt and water stain; and the roof free of any dried leaves and stems.

2.7.2 Lawn grass shall be cut and maintained at a maximum height of ½ inch and
shrubs at 18 inches at every given time. Failure to comply thereof within the
time frame provided in the Notice issued, CDC will cause the cutting/trimming
of grass and shrubs at the expense of the concerned occupant.

2.7.3 Occupants are required to segregate waste and provide garbage bins for this
purpose. Any occupant found in violation of this rule shall pay a penalty
charge doubled the average monthly garbage collection fee. (emphasis italics)

2.7.1 No part of the lot, other than designed as garbage enclosure, shall be used or
maintained as dumping for rubbish, garbage, garden waste and other
materials or aggregates. Trash receptacles should not be placed outside the
property line of each unit. These must be kept inside the garbage enclosure
located within every lot, for collection by the designated garbage/maintenance
crew.

2.7.2 Garbage shall be disposed only through the Metro Clark Waste Corporation.
Any occupant found in violation of this rule shall pay a penalty charge doubled
the average monthly garbage collection fee.

2.7.3 Building of burning furnace and/or burning of garbage and/or garden waste
within the leased property is strictly prohibited. Violation thereof shall be a
ground for eviction and payment of penalty charge. (emphasis italics)

2.8 Cooking and Washing Area ~

2.8.1 No cooking and washing activities of any kind shall be done in any part or
outside the housing unit exposed to view from the roads, walk way, or any part
of the parade grounds.

2.8.2 No clothesline shall be allowed. Occupants are strictly not allowed to hang
clothes or other apparel for drying in any part of the housing unit or lot
exposed to view from the road, walk way, or any part of the parade grounds.
