Supreme Court Judgments 2018-19

62 1. A five- judge Constitutional Bench of the Supreme Court unanimously held
that Lieutenant Governor of Delhi, Anil Bajpai is bound by the “aid and advice of
the Kejriwal Government”. The court as reiterated that the L-G has not been
entrusted with any independent decision- making power. In case of difference of
opinion, the L-G should refer the dispute to the President for final decision.
2. Supreme Court struck down Section 497 of the Indian Penal Code (IPC) that
makes adultery punishable offence for men. This provision
gives a husband exclusive right to prosecute his wife’s lover and if found guilty on
charges of adultery, the adulterer faces five years of imprisonment. Observing that
husbands are not their wives’ masters, these colonial provisions were struck down.
Presently, adultery remains only a civil offence and a ground for divorce.
3. In a landmark judgment, a five-judge Constitution Bench of the Supreme
Court decriminalized homosexuality declaring Sec.377 of IPC as
unconstitutional. The Court however, held that the section would apply to
“unnatural” sexual acts like bestiality. Sexual acts without consent continues to be a
crime under sec.377. Uttar Pradesh had the highest number of cases, close to 999
registered under Sec.377 of the Indian Penal Code during 2016.
4. The Supreme Court has upheld the Aadhar as a reasonable restriction on
individual privacy in a majority judgment on the 26th September. In a
landmark verdict, the five judge Constitution Bench in its 4:1 ruling struck down
Sec.57 of the Aadhar Act which allows private companies to avail Aadhar data. The
bench also ruled that bank accounts and Mobile numbers need not be linked to the
Aadhar number. The court noted that Aadhar empowers the marginalised sections of
society by giving them a unique identity. The hearing in this Aadhaar case went on
for 38 days – the second longest hearing in the history of Supreme Court.
The longest was in the landmark, Kesavanandha Bharathi case in 1973.
5. The Supreme Court upheld the plea for live-streaming of its proceedings,
observing that the use of technology is to “virtually” expand the court
beyond the four walls of the courtroom.

6. A Constitution Bench of the Supreme Court has modified a 2006 judgment

of a Scheduled Cast/Scheduled Tribe community in order to provide quota
in promotion in public employment. The Court held that the proportion of data

verdict and held it “invalid”. However, the present judgment upheld that “creamy
layer” applied to SC/ST in promotions.
7. In a landmark judgment through a 4:1 verdict, Supreme Court lifted Sabarimala
temple ban on the entry of girls and women in the 10 – 50 age group from
entering Kerala’s Sabarimala temple. The 5 judge Constitutional Bench termed
this practice as illegal and unconstitutional. It held that Art.25(1) would become a
dead letter if women are excluded from practising their right to worship and set
aside the Rule 3(b) of the Kerala Hindu Places of Public Worship (Authorisation of
Entry) Rules, 1965. In a dissenting judgment given by Justice Indu Malhotra,
she was of the view that courts should not strike down religious practices
except social evils. The PIL seeking to ensure entry of women devotees between
the age group of 10 and 50 at the temple was filed by Indian Young Lawyers
Association in 2006.
